Bedrijven en milieu-organisaties over de hele wereld keken vandaag gespannen naar wat er in een rechtszaal in Den Haag gebeurde. Daar sprak de rechter namelijk het vonnis uit in het hoger beroep tussen Milieudefensie en Shell. En dat draaide voor Milieudefensie uit op een teleurstelling: het hof wees de vorderingen van Milieudefensie af. Presentator Hans van der Steeg gaat in gesprek met Roger Cox. Hij was in deze zaak de advocaat van Milieudefensie, en is degene die het idee bedacht om bedrijven en overheden voor de rechter te slepen om ze aan klimaatafspraken te houden. Hij was ook de advocaat in de succesvolle klimaatzaak tegen de staat, aangespannen door actiegroep Urgenda. Wat zegt de uitspraak van vandaag over die aanpak?

Deze advocaat spande in 2013 samen met stichting Urgenda een zaak aan tegen de Nederlandse staat. En jawel, hij won. In 2018 dagvaardde hij samen met Milieudefensie het olie- en gasbedrijf Shell. In deze aflevering van PepTalk praat Pepijn met schrijfsters Anoek Nuyens en Rebekka de Wit over de voorstelling De Zaak Shell. Sinds kort is de rechtszaak die Millieudefensie aanspande tegen Shell bezig. Anoek en Rebekka maakten daar een hele mooie voorstelling over. Eigenlijk gaat de voorstelling niet over die zaak, maar over de klimaatcrisis die volgens hun meer een verantwoordelijkheidscrisis is. Pepijn zag die voorstelling, was blown away en wilde heel graag met ze praten over de klimaatcrisis, de voorstelling, de zaak tegen shell en het thema verantwoordelijkheid.

Meer dan de helft van de bedrijven in ons land heeft een zwakke of slechte financiële gezondheid. Milieudefensie wil dat de rechter Shell dwingt serieus werk te maken van het tegengaan van klimaatopwarming. En Rotterdam wil af van het label 'meest vervuilende stad van Nederland'.

Julie Blussé in gesprek met advocaat Roger Cox

Wat kan één mens betekenen in de strijd tegen klimaatverandering? Heel veel, zo bewijst Roger Cox (1967). Wereldwijd staat hij bekend als de klimaatadvocaat. Een reputatie die hij verwierf toen hij namens Urgenda in 2015 de Nederlandse staat voor het gerecht daagde, om de overheid te dwingen tot beter klimaatbeleid. De rechtszaak was de eerste in zijn soort, en werd door velen kansloos geacht. Maar de rechter gaf Urgenda gelijk. Inmiddels wordt de Urgenda-zaak in aanklachten overal ter wereld aangehaald om overheden tot meer klimaatactie te dwingen. Cox werd bij een aantal van die zaken ingeroepen voor advies. Dit jaar heeft Roger Cox namens Milieudefensie een nieuwe klimaatzaak aangespannen, ditmaal tegen Shell. In 2020 verwacht hij de olie- en gasgigant in de rechtszaal te treffen. Of ook deze keer David Goliath zal weten te verslaan – niemand durft het meer te voorspellen. Julie Blussé werkt voor de VPRO als redacteur en presentator van het radioprogramma OVT. Ze maakte eerder de podcast Tijdgeest, over vreemde ideeën uit het verleden. Ze praat met Roger Cox praten over waarom hij gelooft dat het recht een energierevolutie kan ontketenen, of hij zichzelf als klimaatactivist ziet, en hoe hoopvol hij is over onze toekomst op een steeds warmere aarde.

Roger Cox comes from Rabun Gap School, Georgia in America where he coaches, amongst other sports, basketball. His school has a Presbytarian history and the teaching still has a very holistic approach based on its religious background. Students may be pushed but always in a caring and encouraging way. Roger Cox comes from Rabun Gap School, Georgia in America where he coaches, amongst other sports, basketball. His school has a Presbytarian history and the teaching still has a very holistic approach based on its religious background. Students may be pushed but always in a caring and encouraging way. It was very interesting to talk with Roger and in many ways I felt not all education has such a positive and practical approach. De strijd tegen de klimaatverandering vindt behalve in de politiek en op straat ook steeds vaker in de rechtszaal plaats. Het begon met de beroemde rechtszaak van Urgenda tegen de Staat der Nederlanden, geïnitieerd door Limburgse advocaat Roger Cox. Urgenda won deze zaak uiteindelijk in 2015. Inmiddels zijn er wereldwijd meer dan 40 juridische procedures gestart. Niet alleen tegen tegen regeringen, ook tegen energiereuzen als Shell en Exxonmobil lopen zaken.Hoe kansrijk zijn deze juridische acties? Valt uitzonderlijke spelers wel iets te verwijten bij een groot, collectief probleem als klimaatverandering? De Shells van deze wereld zullen zelf volhouden van niet. Als bedrijf geven zij enkel gehoor aan de vraag naar fossiele brandstoffen van de consument. Maar hoe kijkt de rechterlijke macht naar het feit dat meerdere energiebedrijven al veel eerder dan de consument wisten dat het verbranden van fossiele brandstoffen bijdraagt aan klimaatverandering en die kennis bewust hebben achtergehouden? Of sterker nog, dat die bedrijven ook lobbyisten hebben ingezet om de politiek af te houden van eventuele vergroenende maatregelen?
