Frank Brennan discusses positive news with the Halo Business Angel Network

Fr Frank Brennan warns Australia could be on the verge of a damaging assimilationist policy towards Aboriginal and Torres Strait Islander peoples. And Germany's richest man has not been forward about how his family built their fortune during World War II.

It's been a year since the Voice referendum was defeated. Now, human rights lawyer Fr Frank Brennan warns Australia could be on the verge of a damaging assimilationist policy towards Aboriginal and Torres Strait Islander peoples. 

The landscape of options for treating people with kidney failure is shifting.  It used to be that the “only” robust option in the US was dialysis.  You can listen to our prior podcast with Keren Ladin talking about patients who viewed dialysis as their only option, and structural issues that led to this point (including this takedown of for profit dialysis companies by John Oliver).  One of the problems was a lack of an alternative robust option to offer patients.  As one of our guests says, you have to offer them something viable as an alternative to dialysis. Today we interviewed Sam Gelfand, dually trained in nephrology and palliative care, Kate Sciacca, a nurse practitioner (fellowship trained in palliative care), and Josh Lakin, palliative care doc, who together with a social worker and other team members started KidneyPal at DFCI/BWH, a palliative care consult service for people with advanced kidney disease.  As a team, they provide a robust alternative to dialysis for patients with kidney failure: conservative kidney management. And “conservative,” as they note, can mean not only a “conservative approach,” as in non-invasive/less aggressive, but also an effort to “conserve” what kidney function remains. We get right down to the nitty gritty of kidney supportive care techniques they incorporate in clinic, including: Communication about the choice between dialysis and conservative kidney management: what are the tradeoffs?  Function often declines after initiating dialysis, at least among nursing home residents. Dialysis may extend life, but those “additional” days are often spent in the hospital or dialysis, away from home. Symptoms are common in both options, though more anxiety and cramping in dialysis, more pruritus and nausea in conservative kidney management.. Approaches to treating fatigue Approaches to treating pain - the second most common symptom (!) - and the answer isn't tramadol (or tramadon't) - rather think buprenorphine patch or methadone, and how to dose gabapentin and pregabalin. Frank Brennan has been involved over decades in the big debates in Indigenous affairs. A Jesuit priest and an academic expert on the constitution, Brennan has advocated for recognising First Nations peoples in that document. But he has concerns about the breadth of Anthony Albanese's proposed referendum question, arguing its reference to the Voice making representations to executive government raises the prospect of many legal challenges. This issue of the potential for legal challenges is one that divides legal experts, with a number of authorities maintaining there is no problem. In this podcast, Brennan elaborates on why he believes the referendum question should be reworded and the form he thinks the question should take.

Frank Brennan, Jesuit priest and member of the expert panel on Religious Freedom set up by Malcolm Turnbull says the Israel Folau matter is a "simple freedom of contract case regardless of Mr. Folau's religious views". "I think the question is, did he voluntarily, and for a very large sum of money, agree with his employer to follow a work code which included an undertaking not to make statements on social media about various things which may or may not have a religious component?" Responding to Senator Concetta Fierravanti-Wells' renewed call this week for a Religious Freedom Act - as distinct from narrower legislation favoured by the Morrison government - Brennan told The Conversation: "I continue to have my reservations about that, mainly on the basis that I don't think religious freedom is an enormous problem in Australia". He sees the way forward as a Religious Discrimination Act, recommended by the review, in line with other existing anti-discrimination laws on race and gender. As for issues to do with religious schools, "Penny Wong's bill was correct" - referring to the Senator's Amendment to the Sex Discrimination Act late last year which sought to remove the capacity of religious schools to directly discriminate against students on the basis of their sexual orientation, gender identity or intersex status. The only addition needed to this, he says, would be a clear commitment that "religious schools are free to teach their doctrine". Fr Frank placed significant emphasis on the need to work in collaboration and cooperation as well as developing trusting relationships as we strive to recreate the manger in our own communities. Who are the people in our own communities that we need to seek out and actively develop trusting relationships with? How do we fire our imaginations and strengthen our witness in order to empower our communities? Bruised but not broken. Fractured but not fallen. There is still a relevance for the church in the modern day. We now have an opportunity to have an open dialogue with respect and dignity, not shame and fear! Frank Brennan has a longstanding reputation of advocacy in the areas of law, social justice, refugee protection and Aboriginal reconciliation. He is known for his 1998 involvement in the debate surrounding the Wik peoples’ landmark court case.
