Missouri state auditor Scott Fitzpatrick released his office's audit of the St. Louis Circuit Attorney's office earlier this week. Auditor Fitzpatrick joined us live on 939 the Eagle's "Wake Up Missouri." The audit began in June 2021 under former Missouri Auditor Nicole Galloway (D), but Fitzpatrick, a Republican, says Galloway's audit staff met resistance from then St. Louis Circuit Attorney Kim Gardner. Fitzpatrick says Gardner wanted to prevent the audit from progressing. Auditor Fitzpatrick slammed Kim Gardner on "Wake Up Missouri", telling listeners that she was an "absolute disaster" as circuit attorney, adding that he had to put out a public appeal to help find her. Andrew Bailey, Missouri's Attorney General, calls in to discuss his suit against St. Louis Circuit Attorney Kim Gardner despite the 95-page motion to dismiss it. Bailey points out that a statute, section 56.450, holds the circuit attorney responsible for all criminal cases under the law. He goes on to say that the circuit attorney, Kim Gardner, has not devoted her full time and energy to her official duties due to her involvement with the Vera Institute, which focuses on dismantling the criminal justice system and ending incarceration. Gardner is accused of dismissing or treating differently entire classes of offenders and entire classes of cases, Bailey suggests that her actions have led to blood in the streets. Also, he mentions the McCloskey case and other instances where Gardner went after people who were exercising their Second Amendment rights while letting murderers off the hook. St. Louis Circuit Attorney Kim Gardner is facing the fight of her political life after a man on house arrested seriously injured a 17-year-old girl. Republicans and Democrats are calling for her to resign, contending she has neglected her duties in office. Gardner has refused to step aside, adding that St. Louis' judges bare responsibility for what happened to Janae Edmondson. Attorney General Andrew Bailey subsequently filed what's known as a quo warranto motion aimed at ousting her from office. This is not unprecedented. Back in 2009, Joe Dandurand played a major role in then-Attorney General Chris Koster's efforts to remove Dent County Prosecutor Jessica Sparks from office. Dandurand also was a Cass County judge when the Missouri Supreme Court decided a landmark quo warranto case known as Fuchs v. Foote. Dandurand talked with STLPR's Jason Rosenbaum what the quo warranto process entails and why Gardner's fate could be hugely significant to the legal profession.

And Kamala Harris was a prosecutor. From her time as San Francisco district attorney and as California's attorney general, critics argue that she locked up parents of truant children, left a potentially innocent man on death row, and didn't support a measure mandating statewide standards for police body cameras. She caught a lot of flack over her criminal justice record during the Democratic primary, especially from the progressive wing of the party. Even so, Kamala Harris labels herself a “progressive prosecutor.” She's far from alone. But what does that label even really mean? When she took the oath of office as district attorney of Durham County, North Carolina, in January 2019, it was a momentous occasion—for the city of Durham and for her, as a Black woman elected to an office historically held by white men, whose “tough on crime” policies have devastated communities of color for decades. She ran her campaign being vocal about the over-policing of Black and Brown folks, promising sweeping reform. Now, more than a year into office, she faces the complicated realities of seeking to reform a deeply flawed criminal justice system and support a community ravaged by gun violence. She's learning that implementing change will be harder than she could have anticipated.
