We’ve talked about auto insurance reform in Michigan a few times on this show. I can remember back to a beautiful day on the porch of the Grand Hotel on Mackinac a little over a year ago, when I was with Governor Gretchen Whitmer and our legislative leaders who were hailing a deal that was supposed to save Michiganders money - which is a top concern among residents as we in Detroit and statewide pay the most for vehicle insurance in the nation. At the time, there was a lot of excitement by media pundits and politicians, mostly repeating talking points without really looking into the numbers. Lots of back-patting. Now that the reform has taken effect, it’s a confusing mess. What coverage should people get? You might pay less on your auto insurance, but more with health insurance. And the reforms for equity? Sure, insurance companies can't use zip codes, but they can use territories to define your rates. They can't use your credit score per se, but they can use your credit report. And depending on your specific situation, your choices are going to be different. So Attorney Todd Berg of Michigan Auto Law joins me to unpack this. Detroit police are investigating after one of their officers drove an SUV through a crowd of protesters over the weekend. Ford unveiled its redesigned F-150 pickup truck for 2021, while Lordstown Motors revealed its production Endurance, which aims to be the first battery-electric pickup on the market. And I add my thoughts about Rivian moving operations from Detroit to California. We discuss some of the region’s most dangerous intersections from 2019, based on this post from Michigan Auto Law. Perhaps you’ve heard that, because people are driving so much less and accident claims have plummeted during the coronavirus lockdown, your benevolent automobile insurance carrier is planning to give you a big wet kiss in the form of a refund. Well, our guest today not only gives us the lowdown on why this might be happening, but he suggests that in reality, it’ll more likely be a credit rather than a check for cash. Steven Gursten is the managing partner at Michigan Auto Law. He tells us that the amounts insurers are promising to refund pales in comparison with the decrease in actual driving and, likely, accident claims. Meaning they’re seeing a windfall at this time when claims are way down and they’re enjoying a reprieve from court cases stemming from accident claims. Our guest on the podcast today is Steve Gursten. He’s the head of Michigan Auto Law and has been named one of Michigan’s top lawyers by multiple publications. Today’s episode is a response to many listeners who are seeing their auto insurance rates go up in metro Detroit, anywhere from 10 to 30 percent. We discuss how that could be a huge boost for the company as it eyes the launch of its first vehicle in fall 2020. But what does it say about GM and Amazon? Next, Detroit Mayor Mike Duggan was in Lansing today to talk auto insurance reform. As a reminder, Michigan has the nation’s most expensive car insurance. Republicans have signaled the issue as a priority for the current legislative session, and Gov. Gretchen Whitmer has signaled an openness to working on it. Whitmer’s discussion of the need to “fix the damn roads” in last night’s State of the State address, her first. Whitmer also discussed wanting to strengthen civil rights protections for gay and transgender people in her SOS speech, and she targeted the practice of making controversial legislation referendum-proof. Dan Gilbert made headlines this week when he issued an ultimatum to state lawmakers: Find a fix for Michigan's broken no-fault auto insurance system by mid-2019 or I'll bankroll an effort to put a proposal on the statewide ballot in 2020. On today's show, Jer interviews Jared Fleisher, vice president of government relations for the Quicken Loans Family of Companies, about why Gilbert and Quicken are jumping into the fray. Fleisher, who is running point for Gilbert's push to overhaul no-fault, says Quicken has 17,000 employees working in the city and has invested $3.5 billion to date in Detroit. He calls auto insurance reform "the single biggest but also most solvable barrier to the growth of the city." He also draws a comparison between Michigan's no-fault auto insurance system and the much-criticized Obamacare health overhaul. Fleisher says that while the Affordable Care Act requires people to buy insurance, it offers them a choice of benefit levels to pay for. Michigan's auto insurance law similarly requires that every driver be covered, but it essentially forces everyone to buy the top-tier "platinum" level of benefits. We spoke last month on the pod with attorney Steve Gursten, the head of Michigan Auto Law, all about Michigan's no-fault auto insurance system and Detroit Mayor Mike Duggan's recent federal lawsuit accusing it of being unconstitutional. Gursten argues that Duggan's suit has a real chance of prevailing, but he says it's tough to know how to fix the law without more transparency into insurance company practices. Many previous efforts to reform Michigan's no-fault system have run into a brick wall, but now it seems no-fault may be on a collision course with the forces of change.
