This episode features a special guest Michelle Giddings, head of anti-money laundering at the Institute for Chartered Accountants in England and Wales (ICAEW). Giddings joins Rachel Wolcott, senior editor at Thomson Reuters Regulatory Intelligence in London.TRRI usually covers anti-money laundering (AML) strictly from a financial services viewpoint. However, with the focus on accountants' and law firms' role in preventing financial crime like money laundering and sanctions evasion since the advent of the Ukraine war and now the war in Gaza, it is instructive to look at how these professionals are supervised in the UK.Five years ago, the Office for Professional Body Anti-Money Laundering Supervisors (OPBAS) was established to supervise the 25 professional body supervisors in the legal and accountancy sector of which the ICAEW is one. OPBAS is part of the Financial Conduct Authority (FCA).The OPBAS approach has been criticised from lawmakers as not being robust enough to manage AML risks arising from accounting and law firms. The most recent OPBAS report in April, however found improvements but said many professional body supervisors were falling short of expectations.The UK government is considering changing its approach to supervising professional services firms like accountants and lawyers for anti-money laundering purposes. One of the options on the table is eliminating OPBAS and moving to a single regulator or a consolidated professional body supervisor—which could see one regulator supervising 100,000 firms.Giddings talks Compliance Clarified through the ICAEW's response to the government's consultation on professional body supervisory reform, criticism of professional body supervisors' performance, ICAEW thematic review of money laundering reporting officers (MLRO) as well as its annual review of AML supervision. That original command was rooted in a legal context. Matthew Martens, a lawyer, seminary graduate, and author talks with Brian and Aubrey about his what it means to recover that goal in a legal context in his new book, Reforming Criminal Justice: A Christian Proposal. In Reforming Criminal Justice, Matthew argues that love of neighbor must be the animating force for true reformation of the criminal justice system, obligating us to seek the best for both the criminally victimized and the criminally accused.Using his theological training, Martens reveals how Scripture provides several guideposts (accuracy, due process, accountability, impartiality, and proportionality) for loving our neighbors as it relates to criminal justice. Then, drawing on his near quarter century practicing criminal law, he examines how America's justice system falls short of the biblical standard. By understanding how our current system operates and considering how love of neighbor relates to issues of crime and justice, we will be better equipped to seek true Christian reform of the justice system. In Croatia, a new draft media law brought forward by the government which critics say would weaken media freedoms has sparked intense debate, international attention and demands for urgent reform. If adopted in its current form, there are fears it would roll back journalistic freedoms, limit critical reporting, jeopardize journalistic source protection, and could allow for greater politicization of media regulation and funding. The appearance of the controversial draft law surprised even the working group that had been established specifically to help develop such a piece of legislation, causing uproar and criticism from international media freedom groups. His new buildings have captured the attention and imaginations of everyone who's seen them. I joke with him that at every conference session I've seen, he's the most popular presenter. But it's no joke; people are enthralled by his newly constructed homes.Clay talks about how he became the country's most famous bricklayer (ok, that's my moniker for him), and the ins and outs of building new homes with structural masonry. We talk about the difference between brick veneer and structural masonry, some of the details, and how this type of work can scale.Clay now mostly works at Carlton Landing, a new development on Lake Eufaula in Oklahoma. Muzzafar Chishti, a lawyer, is a senior fellow at the nonpartisan Migration Policy Institute (MPI) and director of MPI's office at New York University School of Law.
