Over-the-counter medications for heartburn, reflux and morning sickness are at the centre of a class action investigation over alleged links to stomach cancer and kidney damage that could involve an estimated 100,000 Australians. Erin Brockovich is probably the most famous name in Law in the world. Making a name for herself when she went up against utility company Pacific Gas & Electric and helped bring together the largest settlement ever paid in a direct-action lawsuit in U.S. history on behalf of the people of Hinkley, CA who had been affected by polluted water.Erin went on to become instrumental in numerous other high profile cases, usually up against massive corporate entities who are using their size to get away with either polluting the environment or otherwise neglecting humans basically. Erin was out in Australia doing work with Shine Lawyers - whom she's been working with for over ten years now, in particular around the issue of PFAS, a toxic chemical contained in firefighting foam used widely in Australia between the 1970s and 2000. The substance was sprayed over defence force bases, shipping ports, and regional firefighting stations for decades. It leaches into the soil and surrounding waterways, causing contamination. In 1987, American authorities wrote to the Australian Government to warn about the dangers of PFAS but nothing was done. Research in the United States has linked exposure to PFAS to cancer and a dozen other diseases. Residents in many Australian towns, including Bullsbrook in Western Australia where Erin visited during her visit, say their dogs have been riddled with cancer and die young. They can't drink the tap water. They bathe infants in bottled water. There have also been reports of birth defects. Unfortunately, it is difficult to prove in Australian law causation between exposure to this chemical and disease. The people at Shine reached out to me to ask if I'd have Erin on the show, so of course I said yes. I'm terrified to speak about this kind of thing, so I know enough that backing away from it is not the path to freedom - I have to lean into it. So I flew my self on a carbon-offset flight down to Melbourne to speak with this incredible human being. Erin is as you would expect. A failed bid to put a teenage serial rapist behind bars has sparked a fresh wave of criticism and possibly more protests. The Crown belatedly appealed Jayden Meyer's sentence of nine months home detention after initially agreeing it was the right one that took a rehabilitation approach. But in a scathing judgement Justice Sally Fitzgerald said they'd left it six weeks too late to try to overturn a punishment she is calling manifestly inadequate. Spencer McNeil led the public protests against the initial sentence of home detention handed down to Meyer for raping four girls and sexually violating another. Lawyers are also questioning what's happened. Adam Simperingham from the Criminal Bar Association says there appears to have been disconnect between the Crown law in Tauranga and the Crown law in Wellington.  Both Crown law and Jayden Meyer's lawyer are refusing to comment. Shine Lawyers represents sexual assault survivors.  Its managing director Angela Parlane spoke to Corin Dann.

Even though I believe all episodes of this podcast series are worth a listen, if you are new to the podcast and are interested in my editor's choice selection, I strongly suggest a listen to Episode 1, 4, and 9 to start, followed by Episodes 17, 18, 22, 24 and 31.Since learning about this class of chemicals in 2018, I have travelled to many states of Australia, and interviewed people in person or over the phone from Oakey, Williamtown, Salt Ash, Fullerton Cove, Richmond, Katherine, Tasmania, Adelaide, Canberra, Sydney, Perth and Newcastle. This year I hope to visit many more people in many more towns to discuss with residents and others how PFAS chemical contamination has affected their properties and their lives.I have also had the privilege of interviewing many international experts to discuss PFAS from their medical, scientific, remediation, political, or expert opinion. I have interviewed some fantastic international guests from California, Sweden, Texas, Washington, Boston, Michigan, Switzerland, Colorado and California.This season I will bring you some more great discussions with Australian and International guests with the one goal being to understand PFAS chemicals better, and learn what is new regarding regulations and scientific discoveries about this complex class of compounds.Whilst health effects are still debated regarding PFAS chemicals, they have definitely been associated by experts with some PFAS compounds. However, one thing is abundantly clear from the experts I have spoken to, the persistence of this class of chemicals is something which warrants a high degree of caution, and attention. Many experts argue that the persistence of this class of chemicals requires swift action and they recommend banning the whole group of PFAS chemicals.In Australia, a class action between three communities in Australia and the Department of Defence settled out of court in 2020, and these communities received a payout of $212 million dollars, which after paying a huge amount of legal fees was divided amongst many thousands of impacted community members, but most as I understand, and I have not spoken to all, have not received enough compensation to move from their contaminated property.The class action payout was awarded due to property value losses that residents with contaminated properties had experienced. One of the conditions of the class action though was that they could have no future claims against the Department of Defence for PFAS contamination to their properties. However, they can still in the future make a claim against the Department of Defence for PFAS related health issues.This season, along with interviewing more experts, and discussing the latest PFAS research and regulatory actions in Australia and around the world, I hope to re-visit some people who were involved in the first PFAS class action in Australia. I will attempt to find out where are they now, and whether their lives have changed since the class action settled. This is important because in Australia right now SHINE Lawyers are involved in a further, larger super class action involving communities in WA, NT, SA, QLD, NSW and VIC.“Shine Lawyers is seeking compensation for property owners for economic loss, including the diminution in value of their land. Any action would be an open class action, meaning residents living in eight affected communities who meet certain criteria will automatically be included unless they choose not to be involved. National Special Counsel Joshua Aylward said he estimates up to 40,000 people live in these communities, and are affected by these chemicals.”Finally, as Australia is facing an election in 2022, I will also hope to find out what the Government intends to do about PFAS more broadly in Australia, and how much money they intend to set aside to contribute to PFAS Research and remediation or compensation in Australia. Erin Brockovich is probably the most famous name in Law in the world. Making a name for herself when she went up against utility company Pacific Gas & Electric and helped bring together the largest settlement ever paid in a direct-action lawsuit in U.S. history on behalf of the people of Hinkley, CA who had been affected by polluted water.Erin went on to become instrumental in numerous other high profile cases, usually up against massive corporate entities who are using their size to get away with either polluting the environment or otherwise neglecting humans basically. Erin was out in Australia doing work with Shine Lawyers - whom she's been working with for over ten years now, in particular around the issue of PFAS, a toxic chemical contained in firefighting foam used widely in Australia between the 1970s and 2000. The substance was sprayed over defence force bases, shipping ports, and regional firefighting stations for decades. It leaches into the soil and surrounding waterways, causing contamination. In 1987, American authorities wrote to the Australian Government to warn about the dangers of PFAS but nothing was done. Research in the United States has linked exposure to PFAS to cancer and a dozen other diseases. Residents in many Australian towns, including Bullsbrook in Western Australia where Erin visited during her visit, say their dogs have been riddled with cancer and die young. They can't drink the tap water. They bathe infants in bottled water. There have also been reports of birth defects. Unfortunately, it is difficult to prove in Australian law causation between exposure to this chemical and disease. The people at Shine reached out to me to ask if I'd have Erin on the show, so of course I said yes. I'm terrified to speak about this kind of thing, so I know enough that backing away from it is not the path to freedom - I have to lean into it. So I flew my self on a carbon-offset flight down to Melbourne to speak with this incredible human being. Erin is as you would expect. Incredibly Clever, Blisteringly Fast, Tall, Powerful, Passionate and a Firehose of Fury.I get why she's good at what she does. The state government says it's going to modernise the Animal Welfare Act to better protect and promote the welfare of animals. The move follows the release of an independent review of the Animal Welfare Act 2002 led by WA barrister and regulatory law specialist Linda Black. State agriculture minister Alannah MacTiernan says there will be five key areas of reform to ensure the welfare of animals. The stolen wages class action on behalf of Aboriginal workers in Western Australia is now set to go to mediation. It's taken nearly two years to get to this stage in the legal action being taken by Shine Lawyers on behalf of former domestic staff, stockmen and farm hands against the State Government. Up until 1972, the state could legally withhold up to 75 per cent of an Aboriginal person's wage. One of Australia's biggest live export companies has gone into voluntary administration, in a sign of how much pressure the industry is under. The North Australian Cattle Company, was started in 1980 and for decades was run by Elders. Four years ago the business was sold to Chinese interests.

In this episode we talk about: overcoming prejudice to advocate for the disadvantaged with our guest Zahida Popal @zahidaaa1, lawyer and president of the Muslim Legal Network. Zahida has wanted to be a lawyer since the age of ten, when she witnessed the most marginalised people in her community suffer due limited legal awareness. She felt that choosing a career in Law would give her the necessary qualifications to reach out to people who needed help. With Law, she has not only found a career that allows her to be an advocate, but she has also found a career that gives her space to constantly learn and grow. This is why she finds the field of personal injuries law particularly rewarding. At Deakin University, Zahida completed a double degree in Bachelor of Laws and Bachelor of Arts (Majoring in International Relations) before finishing her Graduate Diploma in Legal Practice at the College of Law. Prior to joining Shine Lawyers, she was an Employment Outcomes Consultant for a job services provider, which helped deepen her understanding of contract guidelines, professional obligations and authority regulations. She also completed a pro bono clerkship at the West Heidelberg Community Legal Service in 2015 where she gained increased knowledge of legal research, drafting and legal administrative procedures. Zahida is a member of the culturally and linguistically diverse community and has seen how difficult it can be for people to navigate the legal system without expert guidance. She believes she can empathise with those who feel they have no voice and give them a platform to be heard irrespective of the social hierarchy. As well as being the President of the Muslim Legal Network Victoria, Zahida works with charity organisations that provide aid to refugees and victims of war and tragedy. She would also like to be a catalyst for change in the legal field and inspire other women from under-represented demographics to pursue leadership roles.
