Meet Cheryl Morgan - The code that I live by is: Don't live with would'a, could'a, should'a done that - go ahead and do it! Short Bio: Grew up in Biloxi, Mississippi College in Jackson, MS Dental School in Birmingham, AL Specialty training in Prosthodontics in Buffalo, NY (if you know what that is without looking it up - you are a rock star). Joined the military on active duty afterwards. Spent 27 years on active duty in the military. Retired in October 2020. My career wasn't the tradition for a Prosthodontist in the Army. I had the opportunity to deploy to Guatemala, Bosnia-Herzgovina, Afghanistan, Uzbekistan, and Iraq. I got to spend three years as an exchange Officer with the British Military. I was the sole American Soldier on the base in Aldershot, United Kingdom (England) - which was the highlight of my career. My “Air Sports” career started after I finally got of school and had some free time. I started by making a tandem skydive in Louisa, Virigina. Skydiver History: United States Parachute Association Member D licensed Skydiver (the highest license you can obtain) Pro Rated Skydiver (spent 6 years on a demonstration team - Not the Golden Knights.) Have participated in large formation events - the largest was a 96 person formation Was a member of the North Carolina women's largest formation (29 way) Have participated in competitive FS (Formation Skydiving) at the National level for about a half decade now. Have done 4-way, 8-way, 10-way and 16 way. A few years into skydiving, I became a pilot - why? That is a great question to ask me!! I don't want to spoil the answer. Pilot: Private / Instrument / Commercial Pilot Ratings - Single Engine Land, Single Engine Sea, Tailwheel Endorsement, Complex Endorsement, Gyrocopter rating, Weight Shift Trike rating, SailPlane Rating Owned a PA24-260 (Piper Comanche) for 10 years Currently own a Moyes-Bailey Dragonfly C (used in ranching in Australia, and to tow up hang gliders in the US) BASE jumping: Have done bridge day in Fayetteville WV several years, so have my “S”. Payment of Renewal Premium is Acceptance of Policy as Written Ronald Morgan and Cheryl Morgan appealed from the trial court's grant of summary judgment in favor of Dickelman Insurance Agency, Inc., Dickelman Insurance, Inc., Jason Dickelman, and State Farm Fire and Casualty Co. (collectively Defendants) on the Morgans' complaint for breach of contract, promissory estoppel, negligence and fraud. In Ronald Morgan and Cheryl Morgan v. Dickelman Insurance Agency, Inc., Dickelman Insurance, Inc., Jason Dickelman, and State Farm Fire and Casualty Co., No. 22A-PL-892, Court of Appeals of Indiana (December 30, 2022) the Court of Appeal of Indiana made clear that an insured is required to protect their rights by reading the renewal notice of a policy. FACTS The facts most favorable to the Morgans as the nonmovants show that in 2007, they purchased a log home in Lafayette, Indiana. In 2008, they acquired homeowners insurance with State Farm. The Morgans paid insurance premiums through escrow funds held by their mortgage company. Each year, State Farm mailed the Morgans "renewal notices." The insureds did not recall looking at the notices. In 2015 the Morgans submitted a claim to State Farm for extensive water damage to their home with a repair estimate of $712,000 to $800,000. Ultimately, State Farm paid the Morgans $330,034.88 for the claim, which represented their dwelling coverage limit for the policy period April 4, 2015, to April 4, 2016, plus inflation guard protection and the cost of debris removal. On September 20, 2017, the Morgans sued Defendants alleging breach of contract, promissory estoppel, negligence, and fraud. The trial court issued an order granting summary judgment for Defendants on all of the Morgans' claims. DISCUSSION AND DECISION In their complaint, the Morgans alleged that Defendants breached an oral agreement to increase their dwelling coverage by $150,000. In an affidavit, Dickelman attested that the Morgans never authorized Dickelman Insurance to increase the dwelling limits. Thus, Defendants' designated evidence established that they did not commit breach of contract. In this case, State Farm mailed renewal certificates to the Morgans that clearly and unambiguously informed them of the amount of their policy dwelling coverage. In Indiana, "[I]nsureds have a duty to read and to know the contents of their insurance policies." [Safe Auto Ins. Co. v. Enter. Leasing Co. of Indianapolis, 889 N.E.2d 392, 397 (Ind.Ct.App. 2008).] A casual scan by an unsophisticated customer of the first page of the two-page 2013 renewal certificate would inform that person that the dwelling coverage was limited to $297,100 and that the premium charged was for this amount of coverage. By retaining the policy and paying the premium through an escrow account held by their mortgage company, the Morgans accepted the offer to renew. The readings were followed by the traditional Q&A session hosted by Cheryl Morgan. There was discussion of apocalypses and their attraction for readers, particularly teenagers. There was also a great deal of discussion of feminism. Given that the announcement that The Doctor would be regenerating as a woman had been made the previous day, this was a very topical matter. For reasons that will be obvious once you have listened to the podcasts, there was also some discussion of pornography. In the announcements we congratulated Jo Hall, Roz Clarke and Pete Sutton for their places on the British Fantasy Awards short lists, and wished Emma & Pete Newman best of luck in the Clarke and Hugos. This introduces us to the main character in the novel, Carlos Moreno. He is a detective, but also the son one of the passengers on the Atlas, the colony ship from Planetfall. This story takes place many years after the Atlas left Earth. When introducing Emma, Cheryl Morgan mentions some top secret news that she can't divulge at the time. As well as quieting the mind Cheryl and Diane discuss how to exercise the body and how to find moderation with your workout schedule. It can be tricky to find the time to fit exercise into a busy schedule so Cheryl has some advice about how she makes the time. Exercise is a necessary part of a lifestyle to maintain a healthy mind however both Diane and Cheryl have experienced what happened when you take this too far and they have some advice for finding a balance. Cheryl and Diane end with some wonderful advice about learning who you are which will help in relationships, work and for your own mental health. What you will learn: Cheryl quiets her mind using Farmville Cheryl’s first pet was a fish – but you can’t stroke a fish! You have to look after yourself but too much time in the gym can end you up in hospital. Do lots of walking to keep your body going. Learn to define yourself, by yourself. Don’t define who you are by who you’re attached to. For the first time in two years we had show notes, we had plans, and we had news: surely nothing could go wrong!  Surely! We had much to discuss: the Nebula Awards winners, which had just been announced; feedback from Cheryl Morgan on Episode 101 and whether women write rigorous SF; gender and whether the gender of the author affects how we perceive the genre of their work; and more! Really. For those seeking show notes, we did discuss all of the above, along with mention of the Tiptree Centenary (time to start planning!), Gary's upcoming attendance at Wiscon and Readercon, and other stuff. Graham is the business manager for the enterprise. The encyclopedia is being written primarily by John Clute, David Langford and Peter Nicholls, with a large number of guest specialist contributors. In this episode of The Writer and the Critic, Ian Mond and Kirstyn McDermott speak briefly about listener feedback, in particular Cheryl Morgan's musings about spoilers and the lack thereof in this podcast. They summarily decide to lift the ban on spoilers to allow more open discussion of all aspects of the books they are reviewing, including ... gasp ... endings and plot twists! Ian promises not to put his hands over his hands and make annoying humming noises while doing so. *** SPOILER ALERT *** THIS PODCAST CONTAINS SPOILERS *** Ahem. Don't say you were never warned. They also talk about the forthcoming Twelve Planets from Twelfth Planet Press and why a series of collections featuring Australian female spec fic writers is far from being a silly gesture. (And it's not just because Kirstyn is writing one of those collections!) Still on the topic of gender, the soon-to-be controversial guidelines of a new horror anthology from Ticonderoga Press are thrown on the autopsy table, with much made of the request for stories with a "masculine tone". This month books up for discussion are The Windup Girl by Paolo Bacigalupi (recommended by Ian) and The City and The City by China Mieville (Kirstyn's choice), both joint winners of last year's Hugo Award for Best Novel. A review by Jonathan McCalmont by The Windup Girl is possibly badly paraphrased by Ian. For those wishing to avoid spoilers and skip ahead, discussion of The City and the City begins at 28:30, while The Windup Girl chat starts around 50:00.
