Nick Yarris shouldn’t be alive… On December 21 1981, Nick and a friend stole a car. When arrested, he got into a physical confrontation with a police officer who claimed he was trying to kidnap him and attempting to murder him. When in jail, he saw a newspaper headline about the murder and rape of Linda Mae Craig, a woman who had been abducted in Delaware, USA. In an effort to win favour with the authorities and avoid the consequences of his pending charges, Yarris claimed that he knew who had committed the unsolved rape-murder. When the man he named, whom he had wrongly believed to be recently deceased, proved upon investigation to be plainly uninvolved, Yarris became the suspect number one. Nick was then charged with the abduction, rape and murder of Craig. After a short jury trial, Yarris was found guilty. In July 1982, at age 21, he was sentenced to death. He escaped custody when travelling from the sentence hearing. He was arrested in Florida a month later where he was returned to Pennsylvania’s death row. In this interview, Nick discusses how his time in prison was one of the best things that ever happened to him; why Adrian Brody wants to portray him on stage and talks candidly about what it’s like to live on Death Row, knowing that you’re innocent. The State of Texas just set a new execution date of Oct. 16 for Robert Roberson, convicted of killing his two-year-old daughter in 2002. Last October, the Supreme Court of Texas stepped in to stay his execution at the last minute, after state lawmakers raised questions about his potential innocence, but then lifted the stay one month later, clearing the way for this new execution date. For today's episode, we revisit a conversation host Nikki DaVaughn had with Michelle Lyons shortly after the stay to break down Roberson's case and Texas' prolific use of the death penalty. And she knows all about it — Lyons, a former public information officer for the Texas Department of Criminal Justice, has witnessed hundreds of executions and even wrote a memoir about her experiences. Edward Harrison's story is a chilling reminder of how difficult it is to overturn a wrongful conviction, even with compelling evidence of innocence.Harrison describes being accused of raping a woman while he was already incarcerated for a parole violation – a physical impossibility that should have invalidated the case immediately. The complainant, described as a schizophrenic woman with addiction issues, later admitted to fabricating the allegation because she feared losing her bed at a treatment facility. Despite this recantation and numerous procedural violations – including detective-written statements, mismatched physical descriptions, and improperly handled evidence – Harrison was pressured into going to trial for a sexual misconduct he did not commit.The consequences have been devastating. Harrison must register as a sex offender, undergo regular polygraph tests, and faces significant barriers to employment despite his qualifications. For over two years, Staten Island's Conviction Investigation Unit has possessed all evidence proving his innocence but continues to stall with claims they're "still reviewing" materials. Since its formation in 2019, this unit has overturned only one conviction, compared to hundreds reviewed by similar units in other NYC boroughs.This conversation pulls back the curtain on Staten Island's notoriously conservative justice system, where judges, lawyers, and police officers live and work together, creating an environment resistant to acknowledging mistakes. Today we have returning guest Andre Brown. Andre & his legal team joined us at the end of 2022 when he was released from prison. Andre spent 23 years locked up after being sentenced to 40 years for two counts of attempted murder in 1999, but he always maintained his innocence. A Bronx, New York, judge overturned the conviction in 2022, citing ineffective assistance of counsel. That allowed Brown, who trained as a paralegal, to begin a new life with his wife and two children in Connecticut, where he gave back to the community.But Brown's world came crashing in on Christmas Eve 2024, when the Appellate Division reinstated the conviction on a legal technicality — meaning he would have to serve the remainder of the 40 years and be returned to prison for another 41 years. Bronx District Attorney Darcel Clark & Governer Kathy Hochul have the power to do what's right. At the very least they can resentence Andre to time served and allow him to be with his family. Social-Media Hoax Frames Innocent Man, Sean Bailey for Indiana Murder; Real Suspect Caught After DNA Break Imagine getting hauled off to jail for a murder you didn't commit—because someone made up fake Facebook accounts and sent videos of a dead body… pretending to be you. That's exactly what happened to Shawn Bailey, a 33-year-old man from Louisville who spent nearly 10 days locked up for a brutal killing in Indiana that he had nothing to do with. According to investigators, Bailey was set up in one of the most twisted, tech-savvy frame jobs we've seen in a while. It started on April 15, when deputies in Hanover, Indiana—just across the river from Louisville—were called to check on 35-year-old Wilma Gayle Robertson. What they found was horrific: Robertson was dead inside her home on Hickory Drive, stabbed in the back. Hours later, Bailey was arrested for her murder. On the surface, it looked like an open-and-shut case. There was allegedly a confession. There was video evidence—a clip sent through Facebook showing Robertson's lifeless body on the floor, with Chris Brown's “Stutter” playing in the background. One message attached to it taunted: “Tell her baby daddy he doesn't have to worry about her anymore… I did him a solid favor.” Chilling stuff. And the Facebook account? It had Shawn Bailey's name on it. Slam dunk, right? Wrong. As detectives kept digging, the cracks in the story widened. The DNA from the crime scene didn't match Bailey. Not even close. And the digital trail? It didn't point to him at all. Instead, the fake accounts, the video, the entire setup led back to Nigel Thomas, a 34-year-old aspiring rapper from Oxford, Ohio, who goes by the stage name “Nati Bang.” According to Jefferson County prosecutors, Thomas not only stabbed Wilma Robertson but then orchestrated an elaborate scheme to make it look like Bailey did it—going so far as to create multiple bogus Facebook profiles, fabricate a confession, and even send out the murder video under Bailey's name. Prosecutor David Sutter didn't mince words. He said Thomas “engaged in an elaborate plan to frame Shawn Bailey,” and praised law enforcement from Indiana, Kentucky, and Ohio for tearing that web of lies apart. On Friday, Thomas was arrested in Ohio. Bailey's charges were dropped, and he was finally released. The story of Tariq Maqbool is one that had not been told in over 20 years. A man who was found guilty of a brutal double homicide in 2002—of Joong Ahn, 45, and his nephew, Mun Ahn, 28—on the night of November 1. On April 27, 2005, he was found guilty and sentenced to life without the possibility of parole.During his time of incarceration, he decided to keep to himself and would not allow anyone to tell his story or take advantage of his situation for the sake of 'entertainment.' That's why, when I reached out to him, I was honoured that he agreed to allow me the opportunity to help tell his story.Since then, many people have started taking notice of his story and taking an interest in the case. Today, Hunter spoke with journalist Piper French about the wrongful conviction of Jimmie “Chris” Duncan. In 1998, Duncan was convicted of murdering his girlfriend's 23-month-old daughter. Originally, Duncan was charged with negligent homicide as it appeared his story, that he stepped away for a few minutes while the child took a bath and then she fell and drowned, was accurate. However, the notorious peddler of the junk science bite mark “evidence,” Dr. Michael West, conducted a dubious autopsy where he pressed a mould of Duncan's teeth into the body of the girl. With this dubious autopsy and the help of a jail house snitch, the state convicted Duncan of capital murder. A little past midnight on July 30, 1945, the USS Indianapolis, a US Navy cruiser, had just delivered the uranium that would be used in the first nuclear bomb dropped on Japan, and was returning to the Philippines when it was struck by a Japanese torpedo. The ship was badly damaged in the attack and within ten minutes it rolled onto its side, dumping 890 crewmen into the pitch-black ocean and dragging the remaining 300 down with the ship.Those who survived the torpedo strike did what they could to grab supplies before abandoning ship, but there were very few life boats or life jackets, so many of the sailors had to float in the water or cling to the few rafts they did manage to take before jumping from the boat. To make matters worse, their mission had been highly confidential and no one in the Navy knew where the Indianapolis was, much less that it had sank. At 19 years old, Tyree Wallace was sentenced to life in prison for the 1997 killing of a Point Breeze deli owner. Ever since, he argued that he was innocent. Finally in November – with help from lawyer/musician David Perry, who wrote a song declaring Tyree's innocence – Wallace was released from prison. Federal courts have found a man's videotaped confession in the 1984 death of an Ada convenience store clerk to be almost entirely false but the state of Oklahoma is still fighting in court over whether it can be used against him in a new trial. The confession is one of the few remaining pieces of evidence the state has against Karl Fontenot in the abduction and killing of Donna Denise Haraway. Fontenot, 60, and Tommy Ward, 64, were twice-convicted of the kidnapping and murder of Haraway, who went missing from McAnally's convenience store in Ada on April 28, 1984. The two men were arrested for the crime in months later after both allegedly confessed to investigators that they had kidnapped, raped and murdered Haraway. The case was the subject of the 2006 John Grisham book and a popular 2018 Netflix documentary The Innocent Man.In their Dec. 20, 2024 briefing to the state appeals court, Fontenot's attorneys pointed out that more than two and a half years have passed since the state's attempt to have the federal appeals court's decision overturned was denied, opening the door to refiling charges against Fontenot.“Now, 926 days later, the State has not retried Mr. Fontenot, or set a trial date for Mr. Fontenot, or uncovered any new evidence that implicates Mr. Fontenot in the abduction of Denise Haraway,” the brief states. “In fact, the State of Oklahoma has stipulated to the absence of any new evidence on February 23, 2024, and admitted that the loss of evidence admitted at the previous trial, and the unavailability of many witnesses has compromised both side's ability to move forward with the case.”Today on the podcast we're joined by Frontier reporter Clifton Adcock, to update us on the cases against Fontenot and Ward.
