Episode 353: On April 23, 2018, a bright spring afternoon turned into a nightmare when a rented van plowed through pedestrians along Yonge Street in North York, a Toronto neighbourhood. In just minutes, 10 lives were tragically lost, and 16 others were injured; one of those later passed away from her injuries, bringing the death toll to 11. The community was left mourning, and the country grappled with questions of how and why such a senseless act could occur. The man behind the wheel was 25-year-old Alec Minassian, a self-proclaimed member of the so-called "incel" community—short for "involuntary celibate." This online subculture, rooted in misogyny and resentment, has been linked to acts of violence, often targeting women. Minassian's actions that day were not random; they were a calculated act of terror fueled by a toxic ideology that glorifies hatred and violence against those perceived as rejecting or oppressing men like him. The driver — along with the vehicle's passenger — fled from the attempted stop and then ran from the vehicle only to be apprehended nearby after a foot chase. The police searched the car and later — using a K9 — found a loaded handgun under a bush not far from where the driver was arrested. The defence lawyer alleged police action was tainted by racial profiling — the vehicle had been targeted because its occupants were young, black males driving late at night. Was this a valid claim? Was searching the vehicle incident to arrest for the offence of flight from police justified? Or did searching it exceed the scope of the common law power?Thanks for listening! This case concerns the third party spending limits most recently added to the Election Finances Act, R.S.O. 1990, c. E.7 (“EFA”), in 2021, and whether they infringe the informational component of the right to vote (i.e., a citizen's right to exercise their vote in an informed manner), which is protected by s. 3 of the Charter. The amendments to the EFA sparked constitutional challenges. The application judge heard and decided two sequential proceedings. In the first proceedings: Working Families Ontario v. Ontario, 2021 ONSC 4076, 155 O.R. (3d) 545 (“Working Families 1”), the application judge concluded that the extension of a 6-month pre-writ restricted period to one that was doubly restrictive was unjustifiable as it did not minimally impair the free expression rights of third party advertisers. In response to that ruling, the Ontario government announced its intention to invoke the notwithstanding clause in s. 33 of the Charter, and introduced Bill 307, which received Royal Assent five days later as the Protecting Elections and Defending Democracy Act, 2021, S.O. 2021, c. 31 (“PEDDA”). Other than the addition of the notwithstanding clause, the PEDDA amendments to the EFA are identical to the amendments that were invalidated in Working Families 1. In the second proceedings, which give rise to these appeals, the legislation was challenged as a violation of s. 3 of the Charter, and as an improper use of s. 33 of the Charter. The application judge concluded that the use of the notwithstanding clause in enacting PEDDA was not improper, and that the re-enacted spending limits on third party advertising during the pre-writ period did not infringe the right to vote under s. 3. The majority of the Court of Appeal agreed that the notwithstanding clause was properly invoked. However, it concluded that the appeals should be allowed and declared the challenged spending restrictions invalid, but would suspend the effect of the declaration for 12 months. Defender Radio: The Podcast for Wildlife Advocates and Animal Lovers
Investigations into farms by animal advocacy groups is an essential tool to exposing serious, systemic abuses of animals, failures to follow basic policy, and have led to criminal charges. But the Ontario government wanted to stop that – and introduced Bill 156 in 2020. The Bill, Security from Trespass and Protecting Food Safety Act, was challenged in court by Animal Justice, with applicants Jessica Scott-Reid (a journalist) and Louise Jorgensen (an advocate with Toronto Cow Save). Intervenors who joined Animal Justice included Animal Alliance of Canada, the Centre for Free Expression at Toronto Metropolitan University, and The Regan Russell Foundation. After some serious legal work by the aforementioned team, Justice Markus Koehnen of the Superior Court ruled that elements of the law and its regulation violate the right to freedom of expression guaranteed under the Canadian Charter of Rights and Freedoms. La Confederación de Organizaciones de Funcionarios del Estado (COFE) presentará un recurso de inconstitucionalidad y un recurso administrativo contra el decreto que el Poder Ejecutivo aprobó la semana pasada para reglamentar el régimen de licencia y subsidio por enfermedad de los empleados públicos. En un comunicado que difundió ayer, el sindicato afirma que el decreto se elaboró "sin ninguna convocatoria a la negociación colectiva" a pesar de que, según la legislación vigente, las condiciones de trabajo, la salud o la higiene laboral "son materia obligatoria de negociación entre las partes". Además el gremio sostiene que el nuevo régimen “tiene fines recaudatorios a costa de los trabajadores”. “La arremetida del gobierno no respeta leyes, siempre que en el horizonte esté el descuento, la rebaja salarial y el ajuste hacia los trabajadores”, señala el comunicado. En rueda de prensa citada por Subrayado, el dirigente Martín Pereira agregó otros cuestionamientos. “Es un decreto muy improvisado para nosotros. Quedan muchas cosas por resolver y se le dan 60 días a la ONSC para reglamentar el listado de enfermedades laborales y cuáles son las enfermedades invalidantes. No sabemos si la ONSC puede plantear eso o si debería ser el BPS o el Banco de Seguros. Hay muchos grises en la reglamentación y desde COFE la vamos a recurrir”. El decreto establece que los empleados abarcados por la norma «tendrán derecho a un máximo de nueve días hábiles al año de licencia remunerada, para cubrir períodos de inasistencia […] por enfermedad o accidente». Podrán pedir esos días de manera alternada o consecutiva por el período de un año. A partir del décimo día en que estén certificados comenzarán a recibir el subsidio, que irá del 75% al 100% del salario. El monto sobre el cual se realizará el cálculo excluye beneficios sociales, la antigüedad, las partidas por locomoción, viáticos y horas extra. Hasta ahora, los empleados públicos cobraban normalmente todos los días mientras estaban certificados. En effet, entre 10 et 20 personnes meurent chaque année foudroyées.La foudre se manifeste de diverses façonsC'est quand les gens se promènent dans la nature, ou font du sport, qu'ils sont le plus souvent touchés par la foudre. Et ces accidents sont encore plus fréquents l'été.La foudre peut se manifester de plusieurs manières. Elle peut atteindre ses victimes de façon directe. En effet, l'organisme humain, et notamment la peau, souvent mouillée au cours d'un orage, est un excellent conducteur pour la charge électrique propagée par la foudre.Celle-ci peut également toucher une personne de manière indirecte, par l'intermédiaire de l'arbre sous lequel elle s'est réfugiée par exemple. De même, elle peut être foudroyée par le biais d'un objet atteint par la foudre.Elle peut encore se diffuser dans le sol sur lequel marche une personne qui sera alors atteinte de cette manière. Enfin, la foudre provoque parfois des lésions auditives ou oculaires ou bien projette des éclats ou des objets susceptibles de blesser des personnes situées à proximité de l'impact.Les effets de la foudre sur l'organismeLes effets de la foudre sur l'organisme humain dépendent en partie de la manière dont elle le touché et des zones du corps qu'elle atteint.Si la foudre n'entre en contact qu'avec la peau, cet impact ne se traduit parfois que par des brûlures superficielles. Mais la foudre peut aussi pénétrer à l'intérieur du corps.Dans ce cas, elle peut causer des lésions osseuses ou musculaires. Victime d'une électrocution, la personne foudroyée se retrouve parfois dans une véritable situation de détresse respiratoire, voire d'asphyxie.Mais il arrive que la foudre provoque aussi une perte de connaissance ou un traumatisme crânien. Les pertes de mémoire sont également fréquentes. Enfin, si la foudre atteint le cœur, elle peut provoquer un arrêt cardiaque.Faute d'une réanimation cardiaque adéquate, qui n'est pas toujours efficace, une telle atteinte entraîne le décès de la personne foudroyée.
