Why is it seemingly so difficult to find a human to speak to when having an issue with your bank or mobile phone company? And if you do, why do they sound like robots and/or aren't empowered to make a decision that will solve your problem? More broadly and worryingly, why is it nearly impossible to hold an individual accountable for decisions that led to a major societal or organisational calamity like the Global Financial Crisis, or the UK's Post Office Scandal? Something is going on, and today, we're going to talk about it. My guest is author Dan Davies, and we are talking about his latest book, The Unaccountability Machine - Why Big Systems Make Terrible Decisions and How the World Lost Its Mind. The book was long-listed for the Financial Times and Schroder's Business Books of the Year. Dan is a former investment banker turned author. His previous book, Lying for Money, was about the 2008 global financial crisis in which no banker went to jail. Dan became interested in why that was the case and to see if the same types of causes for that exist elsewhere. And they do. And it led him to write The Unaccountability Machine. Dan also has a wonderful term called the “accountability sink”, in which a human system delegates decision-making to a rule book rather than an individual, which means that when something goes wrong, no one is to blame. "They've been waiting far too long": Alan Bates digs into the fight against the Post Office In 1999 the British Post Office introduced a faulty piece of accounting software, the consequences of which would see over 900 subpostmasters wrongly prosecuted for theft, fraud, and false accounting. Some lost their businesses, jobs, and homes, and many were left financially ruined. Others were convicted and sent to prison, some dying while they waited for justice. The case has been highlighted in the ITV drama Mr Bates vs the Post Office; the prosecution of Post Office subpostmasters being described as ‘Great Britain's worst miscarriage of justice'. Alan Bates, a former subpostmaster, has been leading the charge and this week gave a strong witness statement at the public inquiry into the Horizon IT scandal. He told Newstalk ZB's Jack Tame that the outpouring of support from across the nation has been absolutely wonderful, and they may need to engage it going forward. “Some of the, if you might call them, the baddies in all of this might be trying to get away scot-free,” Bates said. “We have real concerns that they need to be held accountable for their actions in all of this, and often that fails to happen in so many of these big scandals with big firms.” Bates told Tame that he's never really struggled with accounting, so when the Horizon system was introduced to his own Post Office, he could see it was lacking from the outset. “Once problems started occurring, it was pretty obvious what was the root cause of it all.” He's worked with computer systems before so he could not only see the issues with the programme itself, but with the stances the Post Office was taking on it. Bates said they could never give him an assurance over the accuracy of the system, and they kept swearing no one else could access it, despite it being a network system that anyone could access if they had the right codes. “They just terminated me, given me three months' notice and walked off with the investment.” Bates professes to be something of a stubborn man, telling Tame that he knew his stance on the system was right and so he dug his heels in on it. “We started meeting others over the years, and then we found out we weren't the only ones, and they weren't the only ones, and we sort of grew from there.” In Bates' opinion, a lot of this whole event has been about controlling the narrative, which the Post Office with its significant resources was able to do for ‘donkey's years'. “It wasn't until we got them in the court, into the high court, and we got the judgements, the outstanding judgements from Judge Fraser, that the narrative changed.” “They started losing their footing in all of this, and we started to take over.” The most important thing in all of this, Bates told Tame, is getting the financial redress for the victims. “They've been waiting far too long.” LISTEN ABOVE See omnystudio.com/listener for privacy information.

Sarah and Michael also discuss the recent UK government announcement of a public inquiry into the murder of solicitor Pat Finucane as well as Michael's role in representing NI sub-postmasters wrongfully convicted in the infamous Post Office Scandal, widely regarded as one of the UK's most significant miscarriages of justice.  Michael Madden graduated in Law from Queen's University Belfast in 2002, was admitted as a Solicitor in 2006, and qualified as a Solicitor-Advocate in 2009. He previously worked for a respected London criminal firm where he completed his training contract.   About Michael Madden is a qualified solicitor-advocate specialising in criminal law. He represents clients throughout each stage of the criminal justice system, from clients under arrest in police stations, through to the Magistrates' Court, Crown Court, High Court, and the Court of Appeal. He also regularly represents prisoners before the Parole Commissioners of Northern Ireland. Michael also acts as a solicitor-advocate for clients detained under the Mental Health Order before the Mental Health Review Tribunal. He has a special interest in Human Rights Law. Michael has attended the Office of the United Nations High Commissioner for Human Rights in New York as part of a human rights campaign team concerning the independence of lawyers, highlighting the murder of Pat Finucane in particular. Notable cases: NI Court of Appeal • R v Alan McLaughlin First Post Office / Horizon scandal case in Northern Ireland to have convictions overturned in 2022. • R v James Alexander Smith First referral in NI from the CCRC regarding joint enterprise for murder cases in 2022. • DPP Ref (Number 5 of 2019) Harrington Legen Jack Guideline sentencing case in NI for fraud and theft where the offender is in a position of trust. It also gave guidelines for the appropriate remedy where a court has found there has been a breach of the right to have a criminal hearing within a reasonable time. • R v Gerard Connors [2011] NICC 35 Successful application to reduce the tariff length of a life sentence for murder. • EM Successful application to overturn an extradition order to Germany in 2015. Other notable cases • Inga Maria Hauser murder Represented man arrested for murder but received a “no prosecution” decision from the PPS in 2020. • PPS v GK Represented man in the Magistrates' Court accused of being a “paedophile hunter” who received a non-custodial sentence in 2019. • R v BM Represented man in Belfast Crown Court who received a non-custodial sentence in 2016 for offences concerning bomb hoaxes and threats made to various individuals and airports in the USA and other countries. • PPS v TH Represented man accused of possessing a large amount of semtex acquitted in 2014. • R v FC Represented man accused of “sex slave ring” at Belfast Crown acquitted in 2012.

Between 2009 and 2015 more than 700 people who ran Post Offices, also known as sub-postmasters, were wrongly accused of embezzling money and subsequently prosecuted. The fault was actually that of a dodgy computer accounting system.In addition to having to pay back the money from their own pockets, the strain, stress and stigma of this wrongful conviction destroyed the livelihoods of many of the sub-postmasters who were subject to criminal convictions, imprisonment, and bankruptcy. In some cases this also led to illness, divorce, and suicide.In 2019, the High Court ruled that the Horizon system was faulty and in 2020 the government set up a public inquiry. He spent his entire professional club career with Southampton Football Team before transitioning to non-League football in 2002. Known as "Le God" by Southampton's fans, he was also a TV commentator with Sky until 2020 and has been a vocal critic of many policies in recent years. GUEST 3 OVERVIEW: Bernard de Haldevang has a 40-year career in credit and political risk, dealing with issues such as war, terrorism, piracy, and kidnap for ransom insurance. He became involved in the vaccine safety movement after one of his children was injured by the MMR vaccine 18 years ago. Bernard is an advocate for Swiss-style Direct Democracy and works with Neil Petrie on this initiative, with support from Andrew Bridgen for his re-election campaign. Direct Democracy will support Bridgen's bid for re-election.
