SANDY McGREGOR on MR BATES VS THE POST OFFICE First broadcast on FAB RADIO INTERNATIONAL at 19:00 on January 28th 2024 We don't often deal with all that much outrage in the generally cosy world of VISION ON SOUND, where often the most controversial opinion I make is about whether a fifty year old television series is still acceptable for modern viewing, how certain shows came to be wiped, or disagreeing with my guests as to whether certain TV shows can be considered to be absolute rubbish or not, or whether we should, perhaps, only award that dubious accolade to anything produced in the last ten years or so. Equally, we don't often consider much in the way of modern or recent television to come under what we loosely call our watching brief. And yet, because a certain recent ITV television drama has been causing a lot of discussion, and indeed outrage, I felt that we couldn't really ignore it for twenty years in the hope that it might become worthy of our attention. So, having already borrowed - and devoured - his copy of the book THE GREAT POST OFFICE SCANDAL by NICK WALLIS, I invited SANDY McGREGOR back onto the show to have a chat about the implications of the recently broadcast powerful four-part drama series MR BATES VERSUS THE POST OFFICE, the story of what has been called one of the biggest miscarriages of justice in British History, written by GWYNETH HUGHES and directed by JAMES STRONG, which starred TOBY JONES alongside MONICA DOLAN and JULIE HESMONDHALGH as some of the “little people” doggedly and determinedly pursuing justice by taking on the POST OFFICE in a two decade battle to clear the names of over five hundred of his fellow sub-postmasters in a story which, finally, largely because of the broadcast of this production, has rightly been front and centre in the news agenda. And whilst neither of us can claim any insights or personal involvement with the story, other than having taken a keen interest in it, and reading rather a lot about it, as well as discussing the series itself, our discussion does try to consider the power of television to occasionally make great positive changes happen, so we do briefly consider some of the – surprisingly few - other TV shows that can claim to have actually changed lives, and wonder just why it is that an important news story such as this somehow failed to make the same kind of impact in documentary form as it managed to as a drama series, and whether in future, that might be the only way any of us are likely to get the rest of the population to take much interest in some of the important things that are happening but which remain largely ignored. After the introduction of a new computer system in the early 2000s, the Post Office began using its data to accuse sub-postmasters of falsifying accounts and stealing money. Many were fired and financially ruined; others were prosecuted and even put behind bars. But many of the accused insisted that they had done nothing wrong and that they were being held accountable for computer errors they could not control. After being contacted by a man who insisted that his pregnant wife had been jailed for a crime she didn't commit, journalist Nick Wallis started investigating what some are already describing as the widest miscarriage of justice in UK legal history. Conviction rates for rape trials are lower than those for other criminal trials, and the court experience can be intrusive and harrowing for survivors. The Law Commission of England and Wales (the independent body that advises the government on law reform), has just published a new consultation paper for how to change this. Criminal law commissioner Prof Penney Lewis, and before her Independent Sexual Violence Adviser Annabelle Edwards of Rape Crisis, speak about the reforms they'd like to see. The Scottish government's Victims, Witnesses and Justice Reform (Scotland) bill also aims to improve rape trials. If passed, it would abolish the "not proven" option for acquittal, create specialist rape courts, and controversially establish the option of judge-only, non-jury trials as a pilot scheme, as it's feared rape myths might influence some jurors. Fiona Leverick, professor of Criminal Law and Criminal Justice at the University of Glasgow and Tony Lenehan KC, president of the Faculty of Advocates' Criminal Bar Association discuss the bill. The Hollywood stars and former married couple Johnny Depp and Amber Heard faced each other during two separate libel trials that asked whether or not Mr Depp physically abused Ms Heard. Depp lost the first case, against the owners of the Sun newspaper. It was heard by a judge in the High Court in London. Depp won the second case, against his ex-wife, decided by a jury in the United States. Nick Wallis is the only journalist to have covered both trials. He contrasts them in his new book "Depp v Heard, the Unheard Story". by Sarah HepolaI met Nick Wallis in the cafeteria of the Fairfax, VA, courtroom on my first day. I was still looking for the gaggle of reporters I assumed I'd find, but I was also looking for an outlet. My phone was nearly dead. I asked a reporter tapping away on his laptop in the mostly empty room, and he pulled out his ear buds long enough to politely motion to an outlet beside him. He was in a dapper suit, and he looked so familiar, but I thought maybe I knew him from TV — and then I overheard him chatting with a passerby. That accent!“This might sound crazy,” I said, leaning over from a nearby table, “but are you Nick Wallis?”The British are so charming. “Well, yes I am.” Smoke 'Em If You Got 'Em is a reader-supported publication. It'd be so much cooler if you became a free or paid subscriber.I'd been listening to Wallis' podcast, Reporting Depp v. Heard, since I'd become obsessed with the cultural, moral, and psychological tangle that is this sordid drama. Legally, Depp v. Heard is a defamation suit in which a tarnished superstar sues his complicated ex-wife over a 2018 op-ed in the Washington Post. But more broadly, it's a watershed moment in #metoo, the culture of celebrity, and media itself. I went online looking for writers and thinkers who could me piece this puzzle together, and lucky for me, I found Nick Wallis.Wallis learned his trade at the BBC, and he represents an old-school (and increasingly old-fashioned) way of doing business. He seeks to remain neutral. His questions are fair, curious, well-informed, and tough when they need to be. At a time when choosing sides is a guaranteed way to increase followers, he delights in various perspectives, from the legions of Depp super-fans at the courthouse (who come off as reasonable, for the record) to rare Amber Heard supporters (who describe civil treatment at the courthouse, despite Heard's grotesque treatment online). In one interview, Wallis introduces us to a therapist working with male victims of domestic abuse, who sees Depp's testimony as an inspiration. In another, he introduces us to a female barrister who sees the trial as potentially devastating for female victims. This kind of broad-range journalism is fading in influence. The rise of YouTubers and social media personalities marks a media transformation. Some of the #lawtube commentary has been incisive, comprehensive, fascinating, while the viral videos tend to have all the nuance of an emoji. But for better or worse, most people are experiencing this trial via two-minute story reels and sound bites. Wallis, on the other hand, has witnessed the whole bloody ordeal — and lived to tell the tale.We met at a DC apartment building where Wallis was staying. We spoke about how the trial in Britain was different, why so few journalists showed up in person, the women growing weary of #metoo, and how this trial will reverberate for decades.By the way, a British documentarian was filming us as we spoke. She's been trailing Wallis for a project on the changing nature of journalism. A public inquiry opened formally on Monday into the faulty IT system at the Post Office which led to the most widespread miscarriage of justice in British legal history. More than seven hundred Post Office managers were wrongly convicted and thousands of others lost their businesses when the accounting software, Horizon, wrongly showed that money was missing from branch tills. The wrongful convictions of hundreds of sub-postmasters and mistresses will be examined by the inquiry. Today's Mishal Husain spoke to BBC correspondent Colletta Smith, as well as Myra Philp, whose mother who ran the post office in Auchtermuchty in Fife and died in 2018 before the first case won by postmasters. Pauline Stonehouse found herself at the centre of what is one of Britain's biggest miscarriages of justice. Between 2000-2015, the post office bullied and prosecuted more than 700 innocent sub post masters and post mistresses. Those prosecutions carried out by the post office's criminal law division were based on evidence gathered from a recently installed but as it turned out fatally flawed computer system. Some went to prison following convictions for false accounting and theft. Many were financially ruined and shunned by their communities. Others died before their names were cleared. Pauline was forced into bankruptcy, lost her home and in 2007 was convicted of six counts of false accounting. Convictions which were formally overturned only very recently.This is an appalling story of an entirely unnecessary crisis, driven by a misguided, institutional belief that hundreds upon hundreds of sub post masters were not pillars of their communities but instead that they were all, individually and quite independently – sophisticated criminals. Recorded live at Nimbin Town Hall Saturday 4th May for the 2019 Mardi Grass HemposiumDrug Testing Driver Saliva: Safer Roads or Bigger Brother?Panel Discussion: Roadside saliva drug testing is an increasingly commonplace strategy used by police to apparently address road safety issues. However, there is very little research concerning the effectiveness is a zero tolerance policy of traces of cannabis in saliva and reducing harm on the roads. After many years of rigorous research, an agreed limit of allowable alcohol and safe driving was agreed upon. Why can’t the same be done for cannabis? What’s happening in Australia, and around the world?NSW’s controversial Roadside Drug Testing scheme has come under increased scrutiny. The RDT program was first rolled out in Victoria in the early 2000’s, with tests for cannabis and methamphetamine, and a promise of increased road safety. The scheme continues to be promoted as a road-safety initiative similar to breath-testing for alcohol. Each year it costs tens of millions of dollars and leads to thousands of lost licenses. All of this would seem justifiable if each driver removed posed an increased risk on the roads. The problem is that the Securetec Drugswipe devices used by police across Australia do not distinguish between impairment and detection. And research shows that being able to detect whether or not someone uses cannabis has nothing to do with whether or not someone is currently impaired by cannabis.3CR’s Enpsychedelia explores issues at the intersection between drugs and society. When I first started doing the show at 3CR, he was still around but in hospital most of the time. I never expected him to be gone, but suspect deep down I knew what was happening and didn't want to acknwoledge it. I wanted to get him to listen to my show. We were like brothers to eachother and had an intimate, caring relationship.At the start of this episode, I chat with Max's mother, Gabi about some of the things we got up to and how severe disability can sometimes distract from genuine relationships.Liz Wright and Kate Pern then join the program to discuss chronic fatigue and the incessant and uneccesary harassment by security, among a variety of other problems associated with disabled access to venues.
