Từ cuối tháng 08/2020, tại Pháp nổi lên một đề tài khiến công luận bức xúc, phẫn nộ : nạn chiếm dụng nhà vắng chủ và những điều luật mà theo công chúng là bảo vệ những kẻ vi phạm pháp luật thay vì bênh vực các nạn nhân - chủ nhà hợp pháp. Trên các mạng xã hội như Facebook hay Twitter, nhiều cư dân mạng còn hô hào ký đơn kiến nghị tập thể đòi sửa đổi luật. Vụ Théoule, giọt nước làm tràn ly Mọi việc bắt đầu vào cuối tháng 08/2020, tại thành phố Théoule-sur-Mer, vùng Alpes-Maritimes, miền nam nước Pháp. Vợ chồng ông Henri Kaloustian, đã nghỉ hưu, sống ở thành phố Lyon, khi về nghỉ hè tại thành phố Théoule-sur-Mer, đã sửng sốt khi thấy ngôi nhà nghỉ mà họ sở hữu suốt 36 năm nay, đã bị một gia đình người Maroc chiếm dụng. Những người chiếm dụng nhà kể là có ai đó nói đó là nhà bỏ hoang không ai ở và đã đưa cho họ chìa khóa để mở cửa. Còn Hiến binh nói với ông Kaloustian là họ không thể vào nhà vì theo luật, những người chiếm dụng nhà có « toàn quyền » ở lại ngôi nhà cho đến khi Tư Pháp ra quyết định chính thức. Đêm hôm đó, hai ông bà chủ sở hữu hợp pháp ngôi nhà đã phải ngủ tạm trong xe hơi. Ông Kaloustian, 75 tuổi, ngậm ngùi kể lại với báo chí : « Buổi tối, tôi nhìn thấy anh ta ở ban công, điện bật sáng. Anh ta thưởng thức đồ uống, ăn nhậu, vui chơi. Tôi thấy rất đau lòng vì không thể vào trong ngôi nhà của mình (…) Tôi đã phải làm việc vất vả cả đời để có được ngôi nhà này. Tất cả người dân Pháp phải ở vào hoàn cảnh của tôi thì mới hiểu được ! Người ta ngủ trong giường của quý vị, dùng ga trải giường của quý vị, dùng bát đĩa, thìa dĩa của quý vị … Đó là hành vi trộm cắp và xâm phạm. Tôi không thể bỏ qua chuyện này ». Cả cảnh sát địa phương, thị trưởng, hiến binh đều không giúp được vợ chồng ông Kaloustian. Ông Georges Bottela, thị trưởng Théoule-sur-Mer, giải thích : « Hôm thứ Ba, cảnh sát địa phương cuối cùng đã đưa được hai ông bà vào trong nhà của họ. Thế nhưng, sau đó những kẻ chiếm nhà lại quay lại. Để tránh nguy cơ xảy ra va chạm, hiến binh đã được điều đến, nhưng theo lệnh của biện lý, hai ông bà lại bị đưa ra khỏi nhà còn những kẻ chiếm nhà lại được cho vào ở trong nhà. Như thế thật là quá đáng ! ». Quá bức xúc, thị trưởng thành phố Théoule-sur-Mer cũng đề nghị sửa đổi luật.  Cuộc đua vượt chướng ngại vật Trên thực tế, nạn chiếm dụng nhà vắng chủ không phải là mới xuất hiện tại Pháp. Năm nào báo chí cũng nhắc đến những vụ chiếm đoạt nhà vắng chủ, dù đó là nhà ở chính hay những ngôi nhà nghỉ, ngay tại thủ đô Paris sầm uất hay ở vùng nông thôn yên bình, miền núi cao vắng vẻ … Cô Malanie Solay, sống ở Paris, cũng từng lâm vào tình cảnh tương tự : « Khi tôi muốn vào căn hộ, tôi không thể cho chìa khóa vào ổ khóa được. Có một người đứng trên phố nhìn tôi rất kỳ cục và rồi ông ấy nói với tôi : « Tôi sống ở đây ». Tôi nói với ông ấy : « Tôi không nghĩ là như vậy, vì tôi là chủ sở hữu nhà ». Nhưng ông ấy vẫn khẳng định là sống trong căn hộ. Thế là tôi gọi cảnh sát ». Nhưng cảnh sát đã không đến can thiệp vì người đàn ông đang sống trong căn hộ của cô Malanie Solay chứng minh được là ông ta đang sống trong căn hộ với hóa đơn điện và giấy chứng nhận bảo hiểm nhà. Thực ra, ông này đã thuê nhà từ một người với giá 2.400 euro/3 tháng, và theo thỏa thuận người tự xưng là chủ nhà cứ 3 tháng sẽ đến tận nơi để nhận tiền mặt. Nhưng khi được liên lạc để giải quyết thì người tự xưng là chủ nhà đã « lặn mất tăm ». Không thể trông chờ vào sự can thiệp của cảnh sát, cô Solay đã phải chi rất nhiều tiền thuê luật sư và trả nhiều chi phí khác để tiến hành các thủ tục tư pháp đòi lại căn hộ vốn dĩ thuộc quyền sở hữu của cô. Thời gian xử lý vụ việc cũng không phải là ngắn. Bà Marie Simoes, luật sư của cô Malanie Solay, cho biết : « Vụ việc có thể kéo dài trong suốt nhiều tháng. Trong trường hợp mọi chuyện tiến triển thuận lợi nhất, thì chúng tôi có thể có được phán quyết của tòa sau 5 tháng. Còn trong trường hợp xấu nhất, có khi sẽ phải mất đến 1 năm, thậm chí là lâu hơn thế ». Cô Solay hồi tưởng thêm trên đài France 2 : « Tôi đã sửng sốt, kinh ngạc. Tôi chưa bao giờ tin là điều đó đã xảy ra với mình. Ngoài nỗi lo về khoản tiền vay ngân hàng để mua nhà, tôi còn lo sợ không biết người đó làm những gì bên trong căn hộ của tôi ». Sức mạnh cộng đồng mạng Vụ chiếm dụng nhà vắng chủ mới đây ở Théoule-sur-Mer, còn được gọi là « affaire de Théoule », như « giọt nước làm tràn ly », khiến công luận bức xúc, phẫn nộ. Sức mạnh của cộng đồng và các mạng xã hội đã gây tiếng vang lớn, góp phần giúp ông nhanh chóng lấy lại ngôi nhà « chỉ » sau vài tuần. Trên thực tế, không phải ai cũng có được may mắn nhanh chóng lấy lại được nhà như ông bà Henri Kaloustian. Luật hiện hành, cho dù đã được sửa đổi để đẩy nhanh việc thu hồi và trả lại nhà cho người chủ hợp pháp, nhưng vẫn còn nhiều điều bất cập, thậm chí là phi lý. Chẳng hạn, người chủ không có quyền tự đẩy người chiếm nhà đi nơi khác. Điều đáng mỉa mai là nếu bị chủ nhà đuổi đi, người chiếm đoạt nhà trái phép lại có quyền kiện người chủ sở hữu nhà hợp pháp ra tòa về tội « xâm phạm chỗ ở ». Người bị chiếm đoạt nhà, thay vì được luật pháp bảo vệ, bỗng dưng trở thành tội phạm và bị xử hình sự, phải nộp phạt 30.000 euro và có thể chịu án tù lên đến 3 năm tù giam. Trong khi đó, những kẻ chiếm dụng nhà, nếu có bị kết tội, thì án phạt cũng nhẹ hơn nạn nhân : tối đa 15.000 euro tiền phạt và 1 năm tù giam. Trong hoàn cảnh đó, việc duy nhất nạn nhân bị chiếm dụng nhà có thể làm, đó là đến sở cảnh sát khai báo, chứng minh ngôi nhà thuộc quyền sở hữu của họ và trưng ra các bằng chứng về việc ngôi nhà bị xâm phạm, chiếm dụng trái phép, chi tiền thuê luật sư và khổ sở ngóng chờ quyết định của tư pháp, không phải một vài tiếng, một vài ngày mà là nhiều tháng, thậm chí một vài năm, với hàng loạt thủ tục rắc rối. Mọi chuyện càng trở nên khó khăn nếu chủ sở hữu nhà là người cao tuổi, sức khỏe yếu hay những trường hợp được thừa kế bất động tài sản, nhưng chưa hoàn thành thủ tục pháp lý … Nhưng lấy lại được nhà chưa phải đã xong ! Trong rất nhiều trường hợp, chủ nhà phải mất thêm rất nhiều thời gian, công sức và tiền bạc để tu sửa nhà cửa, mua sắm lại nội thất mà không hề nhận được tiền đền bù của thủ phạm hay tiền từ công ty bảo hiểm nhà. Thậm chí, nhiều kẻ chiếm nhà trước khi rời đi còn cố tình « trả đũa » chủ nhà bằng cách làm bẩn, đập phá nhà cửa, làm hỏng đồ đạc … Dự thảo luật mới Tại các nước khác, những vụ chiếm nhà vắng chủ như « vụ Théoule » được giải quyết thế nào ? Có lẽ không phải ở đâu cũng có sự phi lý như tại Pháp. Ông Denis Goeman, phát ngôn viên Viện Công Tố Bruxelles, Bỉ, giải thích đơn giản : « Rõ ràng là đây là một vụ chiếm giữ sai trái, bởi vì rõ ràng là người ta đang chiếm tài sản của người khác, vào nhà người khác bằng cách bẻ khóa. Ở đây có hành vi trộm cắp. Vì thế, nếu chuyện này xảy ra, cảnh sát phải ngay lập tức bắt giữ người này, rồi Viện Công Tố sẽ xem xét xử lý hồ sơ. Trong mọi trường hợp, trong khi chờ đợi một quyết định dân sự, không thể cho phép những người đó ở lại trong ngôi nhà vốn không thuộc về họ ». Trở lại Pháp, công luận hy vọng năm nay sức mạnh của truyền thông và cộng đồng mạng có thể sẽ mang lại nhiều thay đổi. Hai dân biểu đảng cánh hữu Những Người Cộng Hòa LR, Julien Aubert và Éric Ciotti, đề xuất dự luật mới theo hướng trừng phạt nghiêm khắc hơn những kẻ chiếm dụng nhà của người khác. Việc những người này nhởn nhơ, không bị pháp luật trừng phạt, theo chủ tịch Liên hiệp quốc gia các chủ sở hữu nhà là điều không thể chấp nhận được. Quốc Hội cũng đang xem xét dự luật mới nhằm đơn giản hóa thủ tục và rút ngắn thời gian xử lý các vụ chiếm dụng nhà, đặt quyền sở hữu của chủ nhà lên cao hơn quyền có nơi ở của người đi chiếm dụng nhà, tạo điều kiện thuận lợi cho nạn nhân nhanh chóng lấy lại được tài sản. Chính phủ thông báo ủng hộ việc sửa đổi luật và hứa là các chủ sở hữu bị chiếm dụng nhà sẽ có thể lấy lại nhà trong vòng 72 giờ, cho dù đó là nhà ở chính hay nhà nghỉ. Dân biểu Guillaume Kasbarian cho Le Figaro biết luật mới, sau khi được Quốc Hội thông qua, sẽ có hiệu lực vào cuối tháng 10, muộn nhất là vào cuối tháng 12/2020. Luật mới được thông qua sẽ xóa bỏ được phần nào « cơn ác mộng » của các chủ sở hữu nhà ở Pháp, nếu chẳng may bị chiếm dụng nhà cửa.
