This Day in Legal History: New York Grants Women Right to VoteOn November 6, 1917, New York became one of the first eastern states to grant women the right to vote, a pivotal victory for the suffrage movement in the United States. Currently, there is a split among federal circuits on this issue, with the Fourth Circuit requiring a "clear and convincing" evidence standard, while other circuits apply the lower "preponderance of the evidence" standard, which means the employer must show it is more likely than not that an exemption applies. The case has significant implications for both workers' rights and business costs.Representing E.M.D. Sales, attorney Lisa Blatt argued that the default civil standard, preponderance of the evidence, should apply to FLSA cases, as imposing a stricter standard would burden employers and potentially lead to layoffs. Conversely, Lauren Bateman, representing employees and supported by Public Citizen, contended that because FLSA regulations protect critical worker health, safety, and economic welfare, a higher standard is warranted to ensure these protections are meaningful.Justice Ketanji Brown Jackson underscored that the FLSA aims not only to provide fair pay but also to ensure a safe workplace and expand employment, suggesting the importance of potentially adopting a stricter standard. Plaintiff Taylor Devorak filed the complaint in California, alleging that Pfizer and other manufacturers had a duty to research and disclose potential links between Depo-Provera, as well as similar progesterone-based drugs, and intracranial meningiomas, a type of brain tumor. The lawsuit seeks damages based on claims of failure to warn, defective design, negligence, and misrepresentation.Devorak's case follows similar lawsuits filed recently in California and Indiana. Her complaint notes that although the drug has been FDA-approved for over 30 years and widely used, Pfizer has not updated the U.S. labeling to reflect these risks, even as health authorities in the EU and UK now include warnings about meningioma for such medications. A 2024 study published in the *British Medical Journal* found a substantial increase in risk for brain tumors with prolonged use of medroxyprogesterone acetate, the active ingredient in Depo-Provera.In response, Pfizer asserts that Depo-Provera has been a safe option for millions and plans to “vigorously defend” against the claims. The case has brought renewed attention to safety and disclosure practices in the pharmaceutical industry, particularly around long-established medications.Pfizer Accused of Hiding Contraceptive's Brain Tumor Link (1)Following Donald Trump's recent election as U.S. president, the criminal cases against him are likely to be halted for the duration of his term. Trump, the first former president to face criminal charges, had four active prosecutions, including charges related to attempts to overturn the 2020 election results, a hush-money payment linked to Stormy Daniels, and unlawful retention of classified documents. Trump, who has pleaded not guilty to all charges and dismissed the cases as politically motivated, has stated he would immediately dismiss Special Counsel Jack Smith, responsible for the federal prosecutions on election interference and document retention.While Trump can halt federal cases, he has less control over state cases, such as the New York hush-money and Georgia election interference cases. However, his presidency could still effectively delay or complicate these proceedings. The lawsuit, initiated by Amalgamated Bank in 2018, argues that Facebook violated the Securities Exchange Act by failing to disclose the 2015 Cambridge Analytica data breach, which affected over 30 million users and contributed to Donald Trump's 2016 presidential campaign. Shareholders allege that Facebook presented data privacy risks as hypothetical even though the breach had already occurred.Facebook contends that it was not legally required to disclose the prior breach and that reasonable investors would interpret risk disclosures as forward-looking. A federal judge initially dismissed the case, but the Ninth Circuit Court revived it, noting that Facebook's statements misrepresented an already-realized risk. Aimee Brown is the first known person in Ireland to be given a ministerial license for legal cannabis to treat the chronic pain she endures as a result of endometriosis. But her battle to get to this point is the most maddening and incredible story. Endometriosis is a whole-body disease but is often characterised in relation to the menstrual cycle. Typical symptoms include painful periods, painful sex, urination and bowel movements but can encompass a wide range of symptoms from chronic fatigue to nausea. 30 year-old Aimee was first hospitalised with symptoms at the age of eight, three years before she started her period. Medical gaslighting underscores her struggle to get treatment for the condition, which affects one in ten women and people assigned female at birth. In this episode, host Róisín Ingle is also joined by medical scientist and advocate Kathleen King, who explains the condition and the unnecessary suffering of women due to lack of awareness surrounding it. As a graduate of Loyola University New Orleans, Aimee has worked with some of the finest non-profit organizations for hospitality in the country. She started as an Assistant at Tales of the Cocktail Foundation and was given the task to plan their Spirited Awards. From here, Aimee felt that she found where she wanted to be; at gatherings with great wine, food, and people. Shortly after becoming a mom, Aimee started at a new non-profit as the Assistant to the Executive Director at the New Orleans Wine & Food Experience, or NOWFE. This was the perfect opportunity for someone with aspirations of running large festivals. Aimee was tasked with helping out with day-to-day operations, vendors, sponsors, and everything in-between. When it was time for NOWFE to select the successor of the Executive Director, Aimee had the background to be considered and earned the job. New Orleans is all about a good time, and that what you get with NOWFE events. They do a great job of getting wineries and restaurants together to make a fun and safe experience for the community. Since COVID happened in 2020, NOWFE Wine Dinner series has become an all-year extravaganza; and people are still excited about their bigger events like Vinola and Grand Tastings. The New Orleans Wine & Food Experience, with the help of it's sponsors and donors, has raised over 1.5 million dollars for so many organizations in the city. Hospitality, food, and live entertainment are what New Orleans does best. Aimee Brown is a writer and avid reader, often blogging her thoughts on chick lit books. Little Gray Dress is her first novel published. She’s currently studying for her Bachelor’s degree in English Writing. She spends much of her time writing her next book, doing homework, raising three teenagers, binge watching shows on Netflix and obsessively cleaning and redecorating her house. She’s fluent in sarcasm and has been known to use far too many swear words. Aimee grew up in Oregon but is now a transplant living in cold Montana with her husband of twenty years, three teenage children, and many, many pets. Playworks is a leading nonprofit that brings safe and healthy play to children. One keystone element of the Playworks program is leveraging the power of play to encourage social emotional learning, which empowers kids with lifelong skills like empathy, leadership, and conflict resolution. Chris Conard has been working with Playworks since 2007 and is continually inspired by the power of play in education. Beginning as a program coordinator in the Bay Area, he has worked his way up the Playworks ladder including such positions as the administrative associate and national expansion manager. He is excited to bring his love for Playworks to Salt Lake City and help others spread the power of play. Chris is continually motivated by the way play can be a vehicle for social change. In today's episode we get the chance to talk to Dr. Kanold about his book Balancing the Equation. Dr. Kanold is an award-winning educator, author, and consultant. He is former director of mathematics and science and served as superintendent of Adlai E. Stevenson High School District 125, a model professional learning community (PLC) district in Lincolnshire, Illinois. Dr. Kanold is committed to equity and excellence for students, faculty, and school administrators. He conducts highly motivational professional development leadership seminars worldwide with a focus on turning school vision into realized action that creates greater equity for students through the effective delivery of PLCs for faculty and administrators. Dr. Kanold currently serves as the director of Mathematics at Work, a comprehensive K-12 school improvement program to promote and improve student learning in mathematics. He is past president of the National Council of Supervisors of Mathematics (NCSM) and coauthor of several best-selling mathematics textbooks since the late 1980s. He has served on writing commissions for NCTM and NCSM and has authored numerous articles and chapters on school leadership and development for education publications. Dr. Kanold received the prestigious international 2010 Damen Award for outstanding contributions to the leadership field of education from Lyola University Chicago the 1986 Presidential Award for Excellence in Mathematics and Science Teaching, and the 1994 Outstanding Administrator Award (from the Illinois State Board of Education). He serves as an adjunct faculty member for the graduate school at Loyola University Chicago. Dr. Kanold earned a bachelor's degree in education and a master's degree in mathematics from Illinois State University. He completed a master's degree in educational administration at the University of Illinois and received a doctorate in educational leadership and counseling psychology from Loyola University Chicago. Last year, Aimee Brown got the opportunity of a lifetime a job writing for National Geographic. Excited, she packed her Subaru and moved east. After a few weeks of living in D.C. a nagging feeling set in. Were days looking out an office window, lonely treadmill runs and sun salutations without the sun success? It took six thousand miles of driving for her to answer that question.
