In der heutigen Folge spreche ich über Co-Working-Places und die rechtliche Situation dazu. Für Kreative, die gemeinsam an einem Projekt arbeiten und Start-Up-Unternehmen gilt diese Möglichkeit der Büronutzung als sehr angenehm, weil neben dem Raum auch das Mobiliar und immer häufiger auch individuell dazu buchbare Pakete und Services angeboten werden. Das beginnt bei Besprechungsräumen, Kopiererflatrates, Videokonferenzsysteme und geht hin bis zu Start-up-Betreuung und sogar Co-Living-Angeboten. Alles ist möglich – so scheint es zumindest. In der aktuellen Ausgabe von Office-Roxx wird allerdings auch über die rechtlichen Fallstricke von Co-Working berichtet und da seit einiger Zeit vor allem in Großstädten immer mehr Co-Working-Space-Entwickler auf den Markt drängen, finde ich es wichtig, dass die Menschen über die rechtliche Situation ebenfalls informiert sind. Allerdings bitte ich zu beachten: Das hier ist keine rechtliche Beratung, es sind lediglich meine zusammen getragenen Kenntnisse zu diesem Thema, die von unterschiedlichsten Seiten zusammengetragen wurden.  Bislang spielten diese rechtlichen Fragen eher eine untergeordnete Rolle, weil Freiberufler, kleinere Start-ups oder digitale Nomaden überwiegend Co-Working nutzten, mittlerweile wird knapp 1 Mio m2 Fläche als Coworking Arbeitsplatz genutzt. Sprich Coworking boomt. Im letzten Global Coworking Survey gaben 19 % der Mitglieder in deutschen Coworking Spaces an, in einem Angestelltenverhältnis zu stehen, weltweit sind es 36 % (Deskmag 2017) Heute ist nicht mehr der einstige Gedanke vom kreativen Umfeld im Vordergrund, sondern aufgrund fehlender Büroflächen die Argumente Verfügbarkeit, Lage und Flexibilität wie bei NTV zu sehen war. Gerade Unternehmen, die daran denken Coworking zu nutzen, um nicht eigene Flächen vorhalten zu müssen, die sollten sich bei der Vertragsgestaltung mit dem Co-Working – Anbieter Gedanken über die arbeitsrechtlichen Situationen machen. Das klassische Arbeitsrecht in dem es um Arbeits- und Gesundheitsschutz geht sind hier vor allem zu beachten, weiterhin seit Mai diesen Jahres das Datenschutzgesetz. da eine Verletzung der einschlägigen Bestimmungen oft hohe Bußgelder oder gar Strafen nach sich ziehen kann. Gerade durch die sensible Handhabung von Kundendaten, welche durch die unmittelbare Geltung der Datenschutz-Grundverordnung seit dem 25. Mai zwingend erforderlich geworden ist, sind hier ganz neue Herausforderungen im Rahmen des Coworking zu bewältigen. Hierzu werde ich allerdings einen eigenen Podcast mit einem Spezialisten veröffentlichen.  Dann gibt es aber auch immobilienrechtliche Fragen, wie Sebastian Woschech,Senior Associate im Bereich Immobilienrecht in Office Roxx berichtet. Interessanterweise konnte ich nirgends etwas zum Grundgesetz finden, obwohl dies meiner Meinung und auch der Begrifflichkeit nach als Grund-Lage für alles dient. Im Grundgesetz wird von Privatsphäre gesprochen, exakterweise: Privatsphäre bezeichnet den nichtöffentlichen Bereich, in dem ein Mensch unbehelligt von äußeren Einflüssen sein Recht auf freie Entfaltung der Persönlichkeit wahrnimmt. Das Recht auf Privatsphäre gilt als Menschenrecht und ist in allen modernen Demokratien verankert. Wenn das in der heutigen Arbeitswelt mehr berücksichtigt würde, wären viele Probleme schon gelöst, wenn es aber nicht so ist, dann haben die Unternehmen bei der Gestaltung von Coworking – Places das klassische Arbeitsrecht zu berücksichtigen, nämlich dass beispielsweise der Betriebsrat Mitbestimmungsrechte bei dieser Gestaltung hat. Die Rechte des Betriebsrates können sich vor allem in Hinblick auf Fragen der Ordnung des Betriebes oder die Planung der Arbeitsplätze ergeben. Weiterhin müssen die Unternehmen auf eine korrekte Handhabung der Arbeitsschutz-Vorschriften achten, denn der Arbeitgeber muß Sorge dafür tragen, dass Arbeitsstätten so eingerichtet und betrieben werden, dass Gefährdungen für Sicherheit und Gesundheit der Beschäftigten möglichst vermieden und gering gehalten werden. Das kennen Sie bereits aus der Folge Arbeits- und Gesundheitsschutz vom Mai 2018. Hierzu muß ebenfalls eine Gefährdungsbeurteilung erstellt werden. Der Arbeitgeber kann Arbeitsschutz-Pflichten delegieren, hat und behält aber immer die Gesamtverantwortung für die Durchführung. Deshalb wird ganz klar empfohlen, dass vor Einzug in gemeinschaftlich genutzte Arbeitsräume einige Fragen geklärt werden. Diese hab ich jetzt nur auszugsweise: Wer stellt Ersthelfer und Brandschutzbeauftragte? Muss der Vermieter ergonomische Bürostühle zur Verfügung stellen? Ich darf hier nochmal auf die Folge „kein Zuschuss der Rentenversicherung mehr“ hinweisen Wer haftet überhaupt bei Arbeitsunfällen im Co-Working-Büro? Muß der Vermieter den Arbeitgeber bei Gefährdungsbeurteilungen auf eventuelle Gefahrenquellen hinweisen? In der Regel kann der Unternehmer bzw. Mieter dem Vermieter keine Weisungen zu Einrichtung und Überwachung erteilen, bleibt aber seinen Arbeitnehmern gegenüber immer verpflichtet nötige Schutzmaßnahmen zu ergreifen. Arbeitsrechtlich wird somit empfohlen, dass Regelungen im Mietvertrag zum Arbeits- und Gesundheitsschutz getroffen werden, damit fixiert ist, wer welche Maßnahmen veranlasst. Dann aber auch bitte eine Vereinbarung zu Kontrollrechten und Weisungsbefugnissen mit aufnehmen. Wenn man dem Bericht der ASU (Arbeitsmed Sozialmed Umweltmed) aus 2017 glauben darf – und ich tu das – gibt es hinsichtlich der gesundheitsrelevanten Faktoren und Auswirkungen dieser Arbeitsumgebung noch dringenden Forschungsbedarf, aber eines steht fest: gut beraten und geplant, wird es für alle Beteiligten besser werden. Ich zitiere aus diesem Bericht: Eine genaue Analyse der Arbeitsbedingungen in Coworking Spaces wird in Anbetracht der steigenden Zahl von Coworking-Space-Nutzern empfohlen. Dabei sollten sowohl die psychischen und sozialen als auch die ergonomischen Bedingungen berücksichtigt werden, um eine ganzheitliche Beurteilung zu gewährleisten. Dazu bedarf es in erster Linie einer Bewertung durch die Nutzer. Das kennen Sie bereits von mir, bitte nehmt die Beschäftigten ernst und mit ins Boot. Und dabei denkt bitte immer daran: Humanisierung ist die intelligenteste Art der Rationalisierung ! Según la encuesta mundial sobre el mundo coworking nos cuenta que el perfil del coworker suele ser una persona joven, con estudios superiores, que trabaja en nuevas tecnologías, vive cerca de su centro de coworking y está muy satisfecho con su espacio de trabajo. MÓNICA Llevamos ya unos cuantos programas hablando de los coworking: su ambiente, sus actividades, las colaboraciones que surgen en ellos… Pero nos queda analizar un factor fundamental, algo tan vital para un espacio de estas características, que si faltara no existiría: ¡los coworkers! ¡Qué majos los coworkers! Si ahora mismo no estás en un espacio de trabajo compartido y no tienes uno a mano, te invitamos a que cierres los ojos y te lo imagines. ¿Lo ves? Ahí sentado o sentada, con su ordenador, su taza de café con algún mensaje optimista, ¡cuánta concentración! ¡Qué manera de trabajar tan intensa! Vaya, se ha distraído… Ahora, acércate más a esa persona, ¿cómo crees que es? VOCECITA 1 Yo creo que el coworker típico es más bien una coworker, es decir, una mujer que va por libre y que cuenta con unos cuantos años de experiencia en el mercado laboral… VOCECITA 2 (Interrumpiendo) No, no, no, nada de eso… Los coworking son para chavales que no tienen ni barba, los típicos emprendedores de garaje que van de autodidactas, solo que en vez de hacer el Steve Jobs en el garaje están en un coworking… VOCECITA 3 Me vais a perdonar pero no tenéis ni idea… Los coworkers son profesionales independientes que no trabajan para nadie más que para ellos, como Han Solo… MÓNICA No sé yo, no sé yo… La verdad es que es difícil no tener prejuicios cuando nos imaginamos formas de trabajar alternativas, con enfoques diferentes. Por eso, vamos a atenernos a los datos puros y duros de la Encuesta Mundial sobre el Mundo del Coworking, analizados por la publicación DeskMag que nos trae este retrato robot. MÓNICA (¿VOZ ROBOTIZADA O CON ECO?) Características del coworker tipo Primero: no trabajan por su cuenta MÓNICA (VOZ NORMAL) El coworker tipo suele ser empleado de alguna empresa y no trabaja como profesional independiente. Según la encuesta, el 55% de los encuestados poseen una empresa o trabajan para ella. De este 55%, tan solo hay un 18% que es dueño de su propia compañía con empleados a su cargo. MÓNICA (¿VOZ ROBOTIZADA O CON ECO?) Segundo: son chicos jóvenes MÓNICA (VOZ NORMAL) Dos de cada tres coworkers son hombres. El 41% está por debajo de los 30 años y la mayoría, un abrumador 78%, por debajo de los 40. Tan solo el 8% son mayores de 50 años. MÓNICA (¿VOZ ROBOTIZADA O CON ECO?) Tercero: su nivel formativo es alto MÓNICA (VOZ NORMAL) La gran mayoría de los habitantes de un coworking, nada menos que el 75% han completado, por lo menos, una licenciatura. MÓNICA (¿VOZ ROBOTIZADA O CON ECO?) Cuarto: les va la tecnología MÓNICA (VOZ NORMAL) El 44% de los coworkers son desarrolladores web o diseñadores aunque les siguen de cerca los artistas, empresarios, periodistas y consultores, con un 43%. El 13% restante trabaja en Relaciones Públicas y Marketing. MÓNICA (¿VOZ ROBOTIZADA O CON ECO?) Quinto: Están contentos MÓNICA (VOZ NORMAL) Todos los coworkers, bueno, casi todos, concretamente al 95%, están satisfechos o muy satisfechos con su experiencia en el coworking. ¡Y el 85% piensa seguir en su puesto por lo menos un año más! APLAUSOS Y VÍTORES MÓNICA Aprovechando que tenemos por aquí a uno (¿o dos?) de los socios de The Shed Co, vamos a atracarles… Digo, a preguntarles en calidad de expertos cómo ven ellos al coworker tipo. Carlos y Gonzalo o Gonzalo y Carlos, ¿estáis de acuerdo con el perfil que describe esta encuesta o vuestra experiencia es distinta? RESPUESTA DE CARLOS Y GONZALO: “The Shed Co es un espacio particular, tenemos un entorno muy heterogéneo. Por un lado, hay profesionales de desarrollo web, RRSS, editores, abogados, Agencias de marketing, Head-hunters, portales de empleo, start ups, y también un estudio de pintura”. MÓNICA Al margen de su perfil, ¿qué es lo que busca el usuario de un coworking? RESPUESTA DE CARLOS Y GONZALO: “En The Shed Co la gente que viene, viene a trabajar y el espacio está adaptado para trabajar, también es un espacio donde la gran mayoría son profesionales con cierta consolidación, ya tienen sus clientes y quieren trabajar y relacionarse en entornos donde ampliar su cartera de servicios”. MÓNICA ¿Qué hay que ofrecer siempre a los coworkers tengan las características que tengan? RESPUESTA DE CARLOS Y GONZALO: “En The Shed Co hemos apostado por la formación de calidad principalmente focalizada a la creatividad y queremos ser un referente. Todos nuestros coworkers tiene acceso a las píldoras de formación y descuentos exclusivos en los talleres de pago. Además, tratamos que la gente se relacione en eventos puramente lúdicos. Creemos que ese es el momento en el que las personas pueden entablar una relación que pueda desembocar en algo fructífero. Por otro lado, hemos firmado acuerdos con escuelas de negocio para ofrecer descuentos exclusivos y financiación a largo plazo. Además de colaboración con una empresa de dinámicas de networking”. Muchísimas gracias a los dos por hablarnos un poco más del coworker tipo, de tipos de coworkers y de cómo un espacio de trabajo compartido se adapta para contentar a todos los perfiles. RESPUESTA DE CARLOS Y GONZALO MÓNICA No nos extraña que los coworkers estén satisfechos, tienen todo lo que necesitan: colaboraciones, un sitio agradable y equipado donde trabajar, actividades… Además, al margen de su perfil profesional, su edad o su experiencia, pueden interactuar con personas que están en otros coworkings, ¿cómo? ¿Con telepatía? ¿Con señales de humo? No, con una plataforma de la que queremos hablaros porque sabemos que os va a ser muy útil: NomadCoworker.com, el punto de encuentro entre coworkers y coworkings. Se trata de una red social con dos dimensiones, como “Matrix”. En una de ellas, aparecen los espacios que se han inscrito en la plataforma para que los usuarios puedan conocerlos y ver cuáles les interesan más. Y en la otra, están los coworkers que vuelcan allí sus proyectos y colaboran los unos con los otros. Además, la aplicación ofrece utilidades para organizarse y administrarse como la reserva de los espacios o herramientas de facturación. ¡Y con esta recomendación terminamos “Mundo Coworking”!
