He then went down the product management track, which set him up for the leadership side of the field.  The Best PM (10:27) When asked about his stepping stone from product manager to manager, Bryan reflects on what motivates him to work hard and improve the team around him.  Feeling Intimidated (13:00) Steve presses Bryan on how intimidation and imposter syndrome impacts career goals. Bryan shares that he's primarily looking for team members who are jacks of all trades and that he believes having a diverse set of knowledge will set you up for success. With multiple skills, you will be able to work well in the security field, even if it's initially uncomfortable.  Developing as a CISO (16:26) Bryan shares what CISOs can do in their position to develop further. Once getting into a management position, you should always support your team and prepare them for their subsequent roles.  Improving as a Salesperson (24:02) As you pitch executive leadership on programs you want to implement, make sure you can explain what you need simply, without technical jargon, to convey the key points you are trying to make. Crafting a clear elevator pitch will help you make the sale. Solving Business Problems (31:18) Early in Bryan's career, Lexmark was experiencing challenges due to the nature of the printing industry. Noticing that the company could experience a certain level of risk, Bryan built a highly capable team to harden the system and create a security development lifecycle for both the company and the customers.  Third-Party Risk Management (38:16) When Bryan started his third-party risk management program at Lexmark, he had to partner with the procurement and legal team. Due to experience with other aspects of the business, Bryan was well-prepared to oversee this endeavor and communicate with others about their needs. Business Savvy (42:07) Steve presses Bryan on the future of CISOs. Considering the CISO today, Bryan understands they likely worked their way up in the security field. However, Bryan recognizes that this field will mature as we uncover new risks, and the CISO role will change with it. Bryan predicts that future CISOs will have the immense business knowledge needed to keep the company moving and make necessary trade-offs. The New CISO (45:47) To Bryan, being a new CISO means focusing on diversity in the workplace by hiring individuals different than you. As is the case with many finance leader resumes, Cort Townsend’s reveals a repetition of professional advancement and achievement that allows casual readers to quickly validate his CFO credentials. However, like those of many, Townsend self-tale is only a shorthand rendering of a career path filled with twists, turns, and high-stakes industry drama. Such was the case in 2015 and 2016, a period in Townsend’s career annals with enough M&A high jinks and boardroom intrigue to fill an entire volume. Subsequently, though, in July 2017, Townsend landed neatly inside the CFO office of Kofax via an appointment that casual readers of his resume might have assumed was the natural next step for a dedicated senior executive who had already served as the firm’s controller and vice president of finance. So, where was all the drama? Lost between the lines of Townsend’s resume was the acquisition of Kofax by Lexmark International in 2015 and the subsequent acquisition of Lexmark by Apex Technology in 2016. Along the way, Townsend was named finance chief of Lexmark’s enterprise software group, which turned out to be an abbreviated tour of duty that made him the obvious choice for a C-suite posting when Lexmark opted to spin off the software group in late 2016 and later sell it to private equity firm Thoma Bravo. The sale of the group would be completed in July 2017, the very month in which Townsend was appointed CFO of newly branded Kofax. Vin McCaffrey is a former college basketball player at Lehigh University and is now the Founder & CEO of Game Plan.  Game Plan is a student-athlete development platform that unifies the student-athlete experience and aligns athletic departments, athletes, and employers for the good of all.  As a member of the men’s basketball team at Lehigh University Vin saw first-hand the challenges student-athletes face.  Early on in the interview we talk about the giant GPA holes we dug for ourselves in our first semester of freshman year. Vin eventually went on to earn a Bachelor’s in International Relations in 1998 and started his professional career with Lexmark International. Following Lexmark, Vin worked in the financial and technology industries leading various business development initiatives.  His passion for the student-athlete experience never left him and after he completed his Master’s in Business Administration in 2008 from Indiana University, he started Game Plan.  In this episode Vin and I talk all things related about an athletes journey to a life after sports.  We hope to prevent athletes from going through some of the things we struggled with throughout our athletic careers and after retirement from sport. On May 30, 2017, the Supreme Court decided Impression Products, Inc. v. Lexmark International, Inc. Lexmark International, Inc. (Lexmark), which owns many patents for its printer toner cartridges, allows customers to buy its cartridges through a “Return Program,” which is administered under a combination single-use patent and contract license. Customers purchasing cartridges through the Return Program are given a discount in exchange for agreeing to use each cartridge once before returning it to Lexmark. All of the domestically-sold cartridges at issue here and some of those sold abroad were subject to the Return Program. Impression Products, Inc. (Impression) acquired some Lexmark cartridges abroad--after a third party physically changed the cartridges to enable their re-use--in order to resell them in the United States. The U.S. Court of Appeals for the Federal Circuit reversed the district court’s judgment as to the domestically sold cartridges but affirmed dismissal regarding the cartridges sold abroad. -- There were two questions before the Supreme Court: (1) whether a “conditional sale” that transfers title to the patented item while specifying post-sale restrictions on the article's use or resale avoids application of the patent-exhaustion doctrine and therefore permits the enforcement of such post-sale restrictions through the patent law’s infringement remedy; and (2) whether, in light of this court’s holding in Kirtsaeng v. John Wiley & Sons, Inc. that the common-law doctrine barring restraints on alienation that is the basis of exhaustion doctrine “makes no geographical distinctions,” a sale of a patented article – authorized by the U.S. patentee – that takes place outside the United States exhausts the U.S. patent rights in that article. -- By a vote of 7-1, the Supreme Court reversed the judgment of the Federal Circuit and remanded the case. In an opinion by Chief Justice Roberts, the Court held that (1) Lexmark exhausted its patent rights in toner cartridges sold in the United States through its "Return Program"; and (2) Lexmark cannot sue Impression Products for patent infringement with respect to cartridges Lexmark sold abroad, which Impression Products acquired from purchasers and imported into the United States, because an authorized sale outside the United States, just as one within the United States, exhausts all rights under the Patent Act. The Chief Justice’s majority opinion was joined by Justices Kennedy, Thomas, Breyer, Alito, Sotomayor, and Kagan. Justice Ginsburg filed an opinion concurring in part and dissenting in part. On March 21, 2017, the Supreme Court heard oral argument in Impression Products, Inc. v. Lexmark International, Inc. Lexmark International, Inc. (Lexmark), which owns many patents for its printer toner cartridges, allows customers to buy its cartridges through a “Return Program,” which is administered under a combination single-use patent and contract license. Customers purchasing cartridges through the Return Program are given a discount in exchange for agreeing to use each cartridge once before returning it to Lexmark. All of the domestically-sold cartridges at issue here and some of those sold abroad were subject to the Return Program. Impression Products, Inc. (Impression) acquired some Lexmark cartridges abroad--after a third party physically changed the cartridges to enable their re-use--in order to resell them in the United States. Lexmark then sued, alleging that Impression had infringed on Lexmark’s patents because Impression acted without authorization from Lexmark to resell and reuse the cartridges. May a patent owner use contracts to prohibit any resale or reuse of its patented products beyond the initial purchaser? OnTuesday, March 21, 2017, the Supreme Court will hear oral argument in Impression Products v. Lexmark International, which raises this important question. -- Lexmark makes patented toner cartridges and sells them with a contract restriction that the cartridges not be resold or refilled. Impression Products buys used Lexmark toner cartridges, refills, and resells them. Lexmark argues that because the license accompanying the original sale of the cartridges prohibits transferring the cartridges, any reuse and refilling of the cartridges is an unauthorized use and thus a patent infringement. If Lexmark’s argument wins, then manufacturers of patented goods will be able to restrict downstream uses of their goods by use of licenses, and no privity of contract will be required to hold third parties liable. On the other hand, defendant Impression Products argues that the “patent exhaustion” doctrine should operate here to restrict Lexmark from asserting any patent rights after a first, authorized sale. Also at issue is whether first sales in foreign countries instead of the U.S. should affect the outcome. -- The case will have significant effects on the ability of patent owners to control the downstream uses of their patented products, and may affect the ability of patent owners to prevent the importation of “grey market” goods that have been lawfully sold in other countries, similarly to the Supreme Court’s holding in the 2013 copyright case of Kirtsaeng v. The Federalist Society will host a teleforum discussion of Impression Products v. Lexmark International, which is scheduled for argument before the Supreme Court March 21, 2017. At issue in the case is whether a patent owner may use a combination of patent rights and contract law to restrict what purchasers of patented printer toner cartridges may do with the cartridges. Lexmark makes patented toner cartridges and sells them with a restriction that the cartridges not be resold or refilled. News Items Lexington, Kentucky-based Lexmark International, a manufacturer of laser printers and enterprise software serving a variety of industries, including retailers and sign manufacturers, announces that its acquisition by a consortium of investors. The investors were led by China-based Apex Technology Co. Ltd., which designs, manufactures, and markets inkjet and laserjet cartridge chips for remanufacturers and distributors; and PAG Asia Capital, an investment management firm. Legend Capital, which is also based in China, is part of the consortium also. I think as an industry we are getting better at cooperating a little bit, but there are still too many “old school” mind sets out there that feel like they have this great info they need to keep under wraps because if they let it out someone will steal it. Well the real fear is that if they let it out someone will do it better. Well guess what the information is out there. There is very little new other than the way we do things, the way we treat our customers and our stakeholders. 2) Terry: I'm doing a DAX Seminar called Sportswear Garage, where I talk about starting either a screen printing or direct-to-garment business from your home. The final Showcase panel examines Justice Scalia's transformation of five very important areas of Supreme Court doctrine. First, Justice Scalia transformed freedom of expression doctrine by entrenching a rule of viewpoint neutrality in place of different tests for different kinds of speech. In the five to four flag burning cases, Justice Scalia teamed up with Justices Brennan and Marshall to protect political speech. In the five to four decision in Citizens United he did the same thing with a different block of Justices. In another five to four opinion, Justice Scalia recognized constitutional protection for hate speech in RAV v. City of St. Paul. He joined a summary affirmance of a Seventh Circuit opinion by Judge Frank Easterbrook banning Catherine MacKinnon's anti-pornography laws. Second, Justice Scalia revolutionized the law of the religion clauses by largely burying the Lemon test and leading the Supreme Court in affirming the constitutionality of education vouchers for religious schools. Third, Justice Scalia revolutionized the Second Amendment by finding that it protected an individual's right to bear arms to defend himself, and he was very libertarian and protective of criminal defendants' rights in his criminal procedure jurisprudence. Fourth, Justice Scalia surprised some observers with his criminal law and procedure opinions on searches, the Confrontation Clause, and more. Finally, Justice Scalia played what some describe as a unique role in standing, including in his opinion in Lexmark International, Inc. v.
