Sandie Morgan is joined by Derek Marsh, Associate Director of the Global Center for Women and Justice. They discuss Derek's BJA Fellowship on human trafficking and how law enforcement and task forces can be more proactive in investigating and assisting labor trafficking. Derek Marsh, MA, MPA Derek Marsh retired from the Westminster PD, CA, after more than 26 years of service. In 2004, Marsh helped start the Orange County Human Trafficking Task Force (OCHTTF). He served as the co-chair of the OCHFFT from 2004-12. During that time, he developed and taught courses in human trafficking across the state of California, provided oversight to human trafficking investigations, assisted in creating HT DVDs, wrote multiple grants, and provided Congressional testimony twice as a HT expert witness. He has presented anti-HT trainings across California and the United States, Saipan, Italy, and Argentina. He taught HT as an undergraduate course at Vanguard University, CA, from 2009 to present. He develops and teaches criminal justice and human trafficking courses. He has served with the United Nations to train Rwandan immigration officials, law enforcement, prosecutors, and NGOs over four intensive seminars in 2017. He has an MA in Human Behavior, an MPA in Police Management & Leadership, and graduated from FBINA Class #224. Currently, D.C. Marsh works as the Assistant Director at the Global Center for Women and Justice. He is researching how human trafficking task forces identify, investigate, and prosecute labor trafficking cases throughout the United States through on-site visits and review of historical task force and federal performance documents. He is helping to develop and provide training and technical assistance through the BIA, TTAC, and OVC-TTAC agencies. His expertise in Criminal Justice will contribute to the research, education, and advocacy mission of the Global Center for Women and Justice. Key Points From 2015-2018, Derek Marsh was a visiting fellow with the Bureau of Justice Assistance to conduct research on human trafficking. Across the board, we are missing labor trafficking cases due to a lack proactive investigations. The history of trafficking investigations in the U.S. shows a striking shift from labor to sex trafficking in 2009. To successfully address labor trafficking, we need to redefine what success means. The goal for law enforcement and prosecution should be to seek justice and closure for victims, whether it be via a criminal or civil case. Building a task force that is equipped to address labor trafficking looks different than a task force to address sex trafficking. Responsável pelo maior crime ambiental da história do país, com o rompimento da barragem de rejeitos minerais em Brumadinho (MG), em janeiro de 2019, a mineradora Vale já está administrando os R$ 250 milhões em recursos das próprias multas aplicadas pelo Instituto Brasileiro do Meio Ambiente e dos Recursos Naturais Renováveis (Ibama) por causa da tragédia. O acordo foi anunciado no início de julho pela empresa e pelo ministro do Meio Ambiente, Ricardo Salles, e incluem também o Ibama e o Instituto Chico Mendes de Conservação da Biodiversidade (ICMBio). Algumas semanas depois, o pacto foi homologado pela 12ª Vara Federal de Belo Horizonte. Pelos termos assinados entre as partes, a mineradora vai apresentar e executar os projetos a serem financiados com o valor das multas, que devem incluir melhorias na infraestrutura de sete parques nacionais localizados em Minas Gerais e em programas de saneamento, manejo de resíduos e áreas verdes urbanas em municípios do estado. Não há obrigatoriedade de aplicação dos recursos em projetos relacionados à região atingida pelo rompimento da barragem. O prazo para a realização dos investimentos é de três anos. O acordo, convertido em sentença transitada em julgado, agora é alvo do Ministério Público Federal em Minas Gerais (MPF-MG). Em recurso interposto na semana passada, procuradores da República pediram a nulidade da sentença que homologou o acordo sob alegação, entre outras coisas, de que a 12ª Vara Federal de Belo Horizonte não teria competência para analisar o caso e de que o MPF nem sequer foi intimado a se manifestar sobre o assunto, como determina a legislação. Segundo o MPF, ao receber o pedido para que homologasse o resultado da negociação extrajudicial, o juízo da 12ª Vara Federal acatou os argumentos das partes e invocou o Termo de Transação e Ajustamento de Conduta (TTAC) firmado no caso rio Doce, relacionado ao rompimento da barragem de Mariana (MG), em 2015, para fundamentar sua competência. Sua justificativa foi a de se evitar “confusão e/ou sobreposição de obrigações jurídicas reparatórias e/ou compensatórias ambientais, tendo em vista tratar-se de desastres distintos”, de acordo com a decisão. Porém, conforme argumenta o MPF no recurso, o novo Acordo Substitutivo de Multa Ambiental não se relaciona em absolutamente nada com o TTAC ou mesmo com o desastre de Mariana. Pelo contrário: as multas aplicadas pelo Ibama “referem-se tão somente ao desastre de Brumadinho, que ocorreu três anos depois, em outro local geográfico e de responsabilidade exclusiva da Vale, não da Samarco ou da BHP, empresas também responsáveis pelo desastre de Mariana”, dizem os procuradores do MPF. Eles também sustentam que, por falta da obrigatória intimação do Ministério Público, não houve o trânsito em julgado da decisão e ainda há prazo tanto para o MP como para terceiro interessado impugnarem a sentença. "A escolha do juízo da 12ª Vara Federal não foi realizada sem objetivo, nós observamos que as decisões sobre o processo do Rio Doce têm beneficiado mais as empresas que os atingidos e o processo de reparação. Ou seja, não é só um problema formal, mas uma verdadeira movimentação política para que os objetivos do acordo fossem aceitos sem nenhuma contestação, que são conceder a Vale poderes de gestão e de polícia nas unidades de conservação objetos do acordo, territórios esses que são de interesse econômico da própria mineradora, o que significaria um total retrocesso a gestão dos recursos ambientais." "Além disso, o acordo não prevê a participação dos atingidos na gestão desses recursos", afirma Anna Galeb, assessora jurídica popular e militante do Movimento dos Atingidos por Barragens (MAB).
