Not only is DEI hiring creating bureaucracy bloat in higher education country-wide, it is beginning to fundamentally alter our institutions. One place where the erosion of excellence is already apparent? Our legal institutions – just last year, 12 Federal Judges boycotted hiring clerks from Yale Law School (some of the crème de la crème of legal education) due to the aspiring lawyers' inability to practice good faith, unbiased law. And no wonder: The Federalist Society at Stanford Law School hosted Judge Kyle Duncan of the Fifth Circuit Court of Appeals – he was shouted down by a group of students. Our guest Ilya Shapiro was nearly fired for tweeting about Biden's Supreme Court nominations. We are, as a nation, beginning to forget… this is a representative democracy. We are not governed by a mob. Free speech is a foundational tenet of the Constitution that defines this country and its institutions. College sophomoric groupthink on social issues is one thing; but the next generation of Supreme Court prosecutors already radicalized enough that they are being barred by current sitting judges? That's quite another problem. Ilya Shapiro is a senior fellow and director of constitutional studies at the Manhattan Institute. Previously he was executive director and senior lecturer at the Georgetown Center for the Constitution, and before that a vice president of the Cato Institute, director of Cato's Robert A. Levy Center for Constitutional Studies, and publisher of the Cato Supreme Court Review. Shapiro is the author of Supreme Disorder: Judicial Nominations and the Politics of America's Highest Court.Download the transcript here.
In January, Shapiro — a prominent lawyer who had just been hired as a law professor at Georgetown — became the center of controversy over his tweet about President Biden's Supreme Court nominee Ketanji Brown Jackson. The Senate confirmation hearings for Biden's Supreme Court nominee, Ketanji Brown Jackson, have been following a familiar script: opponents look for scandal, and nominees say very little about how they'll decide cases. Progressives instead should be arguing—inside and outside the hearings—that the Constitution requires protecting our “republican form of government” from becoming a “moneyed aristocracy” or “oligarchy,” Joseph Fishkin and William E. Forbath explain. Their new book is called The Anti-Oligarchy Constitution: Reconstructing the Economic Foundations of American Democracy. Also this week, P.E. Moskowitz talks about the dangers and the benefits of antidepressants, from both a scientific and personal perspective. Their piece, Breaking Off My Chemical Romance, is featured in The Nation's new special issue on drugs.Advertising Inquiries: https://redcircle.com/brandsPrivacy & Opt-Out: https://redcircle.com/privacy

This week, Hillary continues her series on the state of our democracy. On today's episode, we take a look at how our courts, and our laws, are holding up under pressure from powerful interest groups. First, we hear from Dahlia Lithwick, who has covered the Supreme Court for Slate since 1999. Dahlia shares some rather grim predictions on what we can expect from the Court this term with regard to abortion rights, gun regulations, and more. After that comes a conversation with Sherrilyn Ifill about President Biden's Supreme Court nominee, the Court's decimation of voting rights, and Sherrilyn's next project, once she steps down as President and Director-Counsel of the NAACP Legal Defense and Educational Fund this spring. Bios: Dahlia Lithwick is a senior editor at Slate, where she writes her award-winning “Supreme Court Dispatches” and “Jurisprudence” columns and hosts Amicus, a podcast about the law and the Supreme Court. Her forthcoming book, Lady Justice: Women, the Law, and the Battle to Save America, is due out this fall. Sherrilyn Ifill is the outgoing President and Director-Counsel of the NAACP Legal Defense and Educational Fund known for her work on voting rights, police violence, and racial justice.
