New Zealand's new bill is finding support from a women's sport advocacy group. The new bill wants to codify sex-based language, defining a woman as an “adult human biological female” and a man as an “adult human biological male”. It comes as Britain's Highest Court ruled that only biological women —not trans women— meet a definition of a woman under equity laws. Save Women's Sport Australasia NZ Spokeswoman Ro Edge told Francesca Rudkin the bill is a protection for the sex-based rights of women. She says all it does is reinforce the urgent need for the likes of Sport New Zealand to prioritise and protect safety and fairness for biological women. His book is a must read, and our conversation a must listen. Shapiro is a senior fellow and director of constitutional studies at the Manhattan Institute. Previously he was executive director and senior lecturer at the Georgetown Center for the Constitution, and before that a vice president of the Cato Institute and director of Cato's Robert A. Levy Center for Constitutional Studies. Shapiro is also the author of Supreme Disorder: Judicial Nominations and the Politics of America's Highest Court (2020). He writes frequently, including at his Substack Shapiro's Gavel. Earlier in his career, Shapiro was a special assistant/adviser to the Multi-National Force in Iraq on rule-of-law issues and practiced at Patton Boggs and Cleary Gottlieb. Before entering private practice, he clerked for Judge E. Grady Jolly of the U.S. Court of Appeals for the Fifth Circuit. Karen Read and her defense team appeared before the Massachusetts Supreme Judicial Court to get two criminal charges against Read, thrown out on the grounds of double jeopardy. Read's second criminal trial is supposed to start in January of 2025. However, this week both the prosecution and defense teams filed a motion to delay the retrial until April 1, 2025. Critics are urging Australian judges serving on Hong Kong's highest court to resign. Fellow foreign justices have stepped down, some in response to the enactment of national security laws, which aims to stifle dissent and democratic freedoms. The involvement of foreign judges on Hong Kong's Court of Final Appeal has a long history. Hong Kong was aiming to maintain its common law system after it was handed back by the British to China in 1997. But some critics say Hong Kong's current retention of this system is a move to preserve the city's international image, and prove the independence of Hong Kong's judiciary from Chinese rule.

Well, it happened again. The hIgHeSt CoUrT will hear arguments Tuesday in a case based on made up facts! This time it's mifepristone, the abortion drug at the center of Alliance for Hippocratic Medicine v FDA. The claim was that the FDA approval process (three decades ago), for mifepristone, one of two medication abortion drugs, was haphazard and slapdash.. Alliance for Hippocratic Medicine also argued that the FDA's 2021 decision to allow telemedicine abortion and mailing of abortion pills violates a 19th-century anti-vice law called the Comstock Act. This week on the show Dahlia Lithwick speaks with Carrie N. Baker, Smith College professor and author of the forthcoming book Abortion Pills: US History and Politics. Baker says taking away the rights to access abortion pills in the mail could have catastrophic consequences for pregnant people, drug development, and privacy for all Americans.
