Chad just wanted to see a movie. He sat next to his wife, Nicole, as the previews rolled. When Chad pulled out his cell phone to check on his toddler, another moviegoer angrily told him to put his phone away. What happened next is the subject of some debate. One thing is for sure: Chad threw popcorn at the man who scolded him, and in response, that man – Curtis Reeves Jr – shot Chad in the chest. Then Kristin tells us about a couple in Natick, Massachusetts, who found themselves the victims of intense harassment and stalking. Ina and David Steiner weren't entirely sure who sent them cockroaches in the mail, or who tailed them when they left the house. But they knew that their harassers were angry with Ina's reporting on the couple's website, EcommerceBytes. They never would have guessed just how powerful their attackers were. On the evening of May 29, 2021, Luis Casado shot and killed a man on a sidewalk outside a bar in St. Augustine FL, after being subject by that man to a barehanded attack. Indicted on a charge of manslaughter with a weapon, Casado demanded a self-defense immunity hearing, as permitted under Florida law. The result of the four-day immunity hearing was a grant of immunity by the hearing judge, freeing Casado of criminal liability for this killing, and preventing the prosecution from bringing him to a costly, time-consuming, and risky trial. The entire immunity hearing was televised, providing us with an unusual opportunity to observe an actual self-defense immunity hearing in the wild, so to speak. Yesterday was the ninth day of testimony in the murder trial of Curtis Reeves, the retired Tampa SWAT Captain who shot and killed Chad Oulson in a local movie theater in January 2014 after the two men had a verbal altercation that became physical.The defense presented only a single witness, whose testimony consumed the entirety of the jury's day—defendant Curtis Reeves, himself.  Over the course of the day, 79-year-old Reeves was subject to a full two hours of direct questioning by Defense Counsel Richard Escobar, then another two full hours of cross-examination by Prosecutor Scott Rosenwasser, and finally a brief 10-minute re-direct by Escobar.The bottom line:  Not only did the prosecution, already far short of disproving Reeves' claim of self-defense beyond a reasonable doubt, not make progress towards achieving their burden of proof necessary for a legally meritorious conviction, they spent their two hours on cross-examination of Reeves flailing around pointlessly and actually losing ground on a guilty verdict.This is a remarkable failure from a prosecution that has had, in effect, two chances to cross-examine this defendant at length and in minute detail—meaning at both the self-defense immunity hearing in which Reeves testified in 2017, and again yesterday—without managing to use that opportunity to advance their narrative of guilt in this case.It was, in fact, a humiliating performance for Prosecutor Rosenwasser.Popcorn Shooter Trial Day 9:  Reeves Testifies, Prosecution Train Wrecks on Cross, & Defense Restshttps://lawofselfdefense.com/podcast/popcorn-shooter-trial-day-9-reeves-testifies-prosecution-train-wrecks-on-cross-defense-rests/POPCORN BUNDLE! Yesterday was the eighth day of testimony in the murder trial of Curtis Reeves, the retired Tampa SWAT Captain who shot and killed Chad Oulson in a local movie theater in January 2014 after the two men had a verbal altercation that became physical.The defense presented only three additional witnesses yesterday, all expert witnesses—Dr. Michael Foley, a forensic radiologist whose testimony was delivered in the form of a previously recorded video, Dr. Michael Knox, a crime scene investigation expert, and finally Dr. Roy Bedard, a use-of-force expert.The reason there were only three was largely because of the extensive arguments made outside the hearing of the jury prior to the testimony of the latter two experts.  Unfortunately, much of the argument preceding Dr. Bedard's testimony revealed a substantive ignorance of fundamental aspects of self-defense law on the part of the court, the same type of ignorance we've seen lead to injustice in verdicts in other recent high-profile cases. Yesterday was the sixth day of testimony in the murder trial of Curtis Reeves, the retired Tampa SWAT Captain who shot and killed Chad Oulson in a local movie theater in January 2014 after the two men had a verbal altercation that became physical.The defense presented an additional three witnesses throughout the day. Two of those—Vivian Reeves, the wife of Curtis Reeves, and Dr. Donna Cohen, an expert on aging—were frankly of limited interest, for reasons I'll discuss below.The final witness of the day, Bruce E. Yesterday was the second day of testimony in the murder trial of Curtis Reeves, the retired Tampa SWAT Captain who shot and killed Chad Oulson in a local movie theater in January 2014 after the two men had a verbal altercation that became physical.The shot that killed Chad Oulson also penetrated the hand of his wife, Nicole Oulson, leading to a second charge of aggravated battery.  If convicted on both charges the 79-year-old Curtis Reeves is looking at a mandatory minimum of 50 years in prison—a sentence unlikely to be served in full for obvious reasons.Yesterday's continued presentation by the State of its case-in-chief was remarkable less for the strength of the State's narrative of guilt—which has not been very robust—than it was for the strength of the defense cross-examination of State witnesses.This performance of the defense on cross continues a very solid cross-examination of Nicole Oulson the prior day, but follows an almost shockingly poor opening statement by the defense on Monday morning.  The State's opening was also not great, coming across as intentional deceptive and full of half-truths and deceptive phrasing, as we described yesterday here:  Popcorn Murder Trial Day 1: Poor Opening Statements, Victim's Wife Testifies.  You can find our prior coverage of this case covered in detail here:  http://lawofselfdefense.com/popcornPOPCORN BUNDLE! It is the latest controversial case involving Florida’s “stand your ground” law. Curtis Reeves testified that he feared for his life when Chad Oulsen tossed a bucket of popcorn at him. If the judge decides Reeves’ fear was reasonable, the 75-year-old man will avoid a murder trial. Oulsen’s wife, Nicole, also suffered a wound to her left hand in the shooting. Her lawyer T.J. Grimaldi discusses the case with Nancy Grace in this episode of “Crime Stories.”

This week the true-crime media has been abuzz reporting the verdict of the Michael Dunn "Loud Music Murder Trial." On Sword and Scale we do things a little different, so we'll let you get your fill of that case from other media outlets while we break the case of Curtis Reeves, who like Michael Dunn allegedly shot and killed someone because he didn't like what they were doing and then tried to claim self defense afterwards. Instead of loud music, it was the simple act of texting at a movie theater. I know if someone uses a phone during a movie it can be extremely annoying, but texting isn't really that big of a deal unless you're sitting right next to someone with a particularly big and particularly bright phone. Even then, is it enough to get into an argument about, much less shoot someone? During former cop Curtis Reeves' bail hearing, we learn about all the details that led up to this senseless and tragic outcome where a man died for bad movie theater etiquette.

On the January 22nd, 2014 episode of Liberal Dan Radio: The worst kept secret in Louisiana politics was revealed this week. Louisiana's junior senator David Vitter has announced his candidacy for governor. Current governor Bobby Jindal is term limited and has to sit out a term before running again. Vitter is already pushing a "family values" campaign via his surrogates and that means the gloves come off when it comes to his involvement in the DC Madam scandal. Regardless of his "serious sins" I will go into why Vitter is bad for Louisiana. I will also explain why his own words make him inelligible to serve office according to his own standards. Florida is at it again. Yet another shooting has taken place for no reason. Curtis Reeves, a former police captain, shot somebody over him sending text messages during the previews. And, of course, Reeves is claiming "self defense". Now, nobody can say if that claim will be successful in court until the trial happens. However, if it does, this will be evidence that Florida law is absolutely ridiculous. A Milwaukee couple was running a private, Christian, voucher school and that school abruptly closed down last month. What students did they serve? What happens to them now? And where are the owners? The answers to at least some might surprise you.
