Nearly a year after workers voted to authorize a strike, non-union city and commercially contracted security officers in Baltimore, MD, walked off the job on April 9 on an Unfair Labor Practice strike against their employers, Abacus Corporation, Metropolitan Protective Services, and Urban Development Solutions. Now, Local 32BJ of the Service Employees International Union (SEIU) say that workers have been retaliated against by Metropolitan Protective Services (MPS), alleging that the city contractor "fired and harassed workers following [the] lawful strike." MPS denies these allegations and claims "that no employees have been terminated due to union involvement." In this episode of Working People, we speak with Victoria Cox, a former MPS employee who worked to reach the rank of sergeant, and Daril Riley, a former MPS employee who reached the rank of corporal. Both Cox and Riley have had their shifts taken off the schedule—and, essentially, their jobs taken away—and both have been put under investigation by MPS since the strike in April. In the policy debate on artificial intelligence (AI) in the military domain, there is a growing consensus that international humanitarian law (IHL) must be a central consideration in the design of military AI systems. The imperative to make military AI systems “lawful by design” has, naturally, led to a sharper focus on the role of industry. But what this means in practical terms for AI suppliers – and how states can and should collaborate with industry to strengthen IHL compliance – remains an open question. In this post, Laura Bruun and Netta Goussac from the Stockholm International Peace Research Institute (SIPRI) argue that while focusing on IHL at the design stage makes sense, it carries the risk that states over-rely on industry to make military “lawful by design”. Efforts to elaborate what it means to make military AI “lawful by design” must be grounded in realistic expectations and limits, as well as clear legal responsibilities.

In particular, of course, the homeowner could have shot down intruder Nichols inside his home. But had the homeowner done so, would it have been a legally justified killing? California law does allow for the use of deadly force in defense of one's home—but very specific conditions must be met, and the conditions set by California are different than the more common similar provisions in other states. What about those states with more common defense of dwelling statutes?  What if this had occurred in, say, Fayetteville, NC instead of Fairfield, CA.  What would North Carolina's more common defense of dwelling law have allowed this homeowner to do in fighting off this home invader?Let's talk about defense of HIGHLY-DEFENSIBLE PROPERTY!Join me LIVE at 11 AM ET as I break it all down!Episode # 1285.

Last Friday, Secretary of War Pete Hegseth declared AI company Anthropic a "supply chain risk", the first time this designation has ever been applied to a US company. The trigger for the move was Anthropic's refusal to allow the Department of War to use their AIs for mass surveillance and autonomous weapons. A few hours later, Hegseth and Sam Altman declared an agreement-in-principle for OpenAI's models to be used in the niche vacated by Anthropic. Altman stated that he had received guarantees that OpenAI's models wouldn't be used for mass surveillance or autonomous weapons either, but given Hegseth's unwillingness to concede these points with Anthropic, observers speculated that the safeguards in Altman's contract must be weaker or, in a worst-case scenario, completely toothless. The debate centers on the Department of War's demand that AIs be permitted for "all lawful use". Anthropic worried that mass surveillance and autonomous weaponry would de facto fall in this category; Hegseth and Altman have tried to reassure the public that they won't, and the parts of their agreement that have leaked to the public cite the statutes that Altman expects to constrain this category. Altman's initial statement seemed to suggest additional prohibitions, but on a closer read, provide little tangible evidence of meaningful further restrictions. Some alert ACX readers1 have done a deep dive into national security law to try to untangle the situation. Their conclusion mirrors that of Anthropic and the majority of Twitter commenters: this is not enough. Current laws against domestic mass surveillance and autonomous weapons have wide loopholes in practice. Further, many of the rules which do exist can be changed by the Department of War at any time. Although OpenAI's national security lead said that "we intended [the phrase 'all lawful use'] to mean [according to the law] at the time the contract is signed', this is not how contract law usually works, and not how the provision is likely to be enforced2. But now we were talking about public confrontation. Cameras on sidewalks. Musicians are being recorded without permission. Journalists challenged by police. Business owners are angry about being filmed. The professor, who was a Pittsburgh-based media attorney who represented creative professionals, would lean back and say something that stuck with me: "Most people arguing about rights don't understand the structure underneath them." That line applies perfectly to modern public recording debates. Today, anyone with a phone can film in seconds. Anyone can upload. Anyone can monetize. The General Services Administration has proposed draft contract language that would define the government's relationship with AI service providers in a major federal acquisition program in the aftermath of the fallout between the Defense Department and Anthropic. The proposed language includes terms and conditions for government data use, defines what it means for AI to be unbiased, creates a requirement to use only “American AI,” and establishes a responsibility for contractors to enforce terms and conditions on the AI they deploy. Notably, it also includes language that echoes the very policy at issue in Anthropic's ongoing battle with the Pentagon that led to the company's governmentwide ban and designation as a “supply chain risk.” Under the draft, the government would be granted a “contract for any lawful Government purpose.” According to Anthropic's legal challenge, its dispute with the Defense Department hinged on a policy that the military could make “all lawful use” of the technology. That change, Anthropic says, would have eliminated the company's restrictions on use of its products for “lethal autonomous warfare” and mass-scale surveillance of Americans. A nonprofit advocacy group is suing the Social Security Administration to release records on an agreement DOGE made to share voter data with a non-government source, and other documents regarding the improper use of Americans' data. In a lawsuit filed Monday in the U.S. District Court for the District of Maryland, Democracy Forward seeks to compel the SSA to comply with Freedom of Information Act requests linked to a “voter data agreement” revealed in a January court filing. That filing from the Department of Justice, which is part of a lawsuit by several labor groups over DOGE's handling and exposure of personally identifiable information, detailed coordination between two members of Elon Musk's tech collective embedded at SSA and an advocacy group seeking “evidence of voter fraud.” The DOJ said in that filing that in March 2025, a political advocacy group asked those DOGE representatives for Social Security data to analyze state voter rolls. Per the filing, the group's “stated aim was to find evidence of voter fraud and to overturn election results in certain States.” One of those DOGE members signed a “Voter Data Agreement” in his capacity as an SSA employee and sent the document back to the group on March 24, 2025. Democracy Forward, which represents the federal unions at the center of that lawsuit, immediately filed a FOIA seeking a copy of the voter data agreement, plus all emails between the parties.
