Die Terminvergabe in Vertragsarztpraxen ist immer wieder Streitpunkt zwischen Krankenkassen und Ärztinnen und Ärzten. Da geht es um Vorwürfe der Bevorzugung von Privatpatienten vor Kassenpatienten, da geht es um Honorare, die angeblich nur für die Terminvergabe verlangt werden – oder darum, dass Kassenpatienten, um Wartezeiten zu verkürzen, Termine in einer Privatsprechstunde angeboten werden. Was Ärzten erlaubt und was klar verboten ist – und wo vielleicht Grauzonen liegen: Darüber klärt Rechtsanwältin Katharina Vogtmeier im neuen „ÄrzteTag“-Podcast zum Thema Recht in der Praxis auf. Beispiel Termin gegen Honorarzahlung: Hier zieht die Fachanwältin für Medizinrecht aus der Kanzlei D+B Rechtsanwälte in Berlin eine klare Grenze. Da die Terminvergabe selbst weder in der GOÄ noch im EBM als Leistung verzeichnet sei, dürften dies weder Kassenärzte noch Privatärzte tun. Im Gespräch erläutert sie, warum das nicht nur nach den Abrechnungsregeln nicht lege artis wäre, sondern auch nach Berufsrecht und sogar nach Vertragsarztrecht – mit allen möglichen Konsequenzen für Vertragsärzte. Nicht ganz so einfach ist laut Vogtmeier die Antwort auf die Frage, ob Vertragsärzte Termine für Kassenpatienten ablehnen dürfen, wenn gleichzeitig noch Termine für Privatpatienten und Selbstzahler vergeben werden. „Im Prinzip spitzt sich das auf die Frage zu, wann bin ich als Vertragsarzt an einem Punkt, wo ich legitimerweise sagen kann, ich darf Termine für Kassenpatienten ablehnen.“ Das Erreichen der Budgetgrenze beispielsweise sei kein solcher Punkt. Ein anderer Punkt sind die Kapazitätsgrenzen einer Vertragsärztin oder eines Vertragsarztes. Die bisherige Rechtsprechung sei zwar eher ärzte-unfreundlich, aber die Rechtslage habe sich inzwischen auch geändert an einigen Punkten. Im Gespräch führt Vogtmeier im einzelnen aus, unter welchen Bedingungen es möglich sein könnte, nur noch Privatpatienten Termine anzubieten, Kassenpatienten aber abzulehnen – und welche Rolle die Mindestsprechzeiten für Vertragsärzte oder auch die verpflichtend angebotenen „offenen Sprechstunden“ dabei spielen.

The band's use of harmonies, threading of the needle between pop and aggression, and flair for the uncanny and occluded have made them one of the new bands we're most impressed by these days, and they were happy to speak with us about all that and more. We're also offering some thoughts on the Vancouver stop of the ongoing Nine Inch Nails tour.
One of the enduring powerhouses of our era returns for RA.1000 with a riotous mix. When Helena Hauff made her first RA Podcast appearance back in 2013, she was on the eve of releasing her debut production on Actress' Werkdiscs imprint. In the 12 years that have elapsed, she's become not just a household name within electronic music, but the kind of rare talent that lives in seclusion from industry tumultt. (Hauff, enviously, has never even owned a smartphone.) Her calling card continues to be her penchant for rough and ready EBM, electro and new wave. You'll also hear "Riot" by Underground Resistance, the definitive mission statement for a world ablaze. This is musical anarchism, executed to the highest degree.
