Sam discusses "The Great Capitulation" and the need for us to come together now to defeat Trump/MAGA fascism through collective action. Then she interviews veteran legal scholar, activist and political analyst, Marjorie Cohn, to discuss the implications of the "unitary executive" theory with Trump returning to power next month. They explore how this theory has evolved over time, its impact on the system of checks and balances, and the alarming agenda outlined in Project 2025, which aims to consolidate executive power. Cohn warns of the threats to civil liberties and democratic norms, emphasizing the need for organized resistance against fascism. It's been seven months since Donald Trump's supporters stormed the Capitol building in Washington DC in an attempt to overturn the general election results. Was it merely a short but shocking fluke perpetrated by a handful of fanatics, or a sign of the right's long (and continued) political slide towards open authoritarianism? In our first segment for this week's episode of The Marc Steiner Show, Marc talks with author, journalist, and historian of the American right Rick Perlstein about the historical roots of the Capitol riots and the very dangerous political path we're still on, even with Trump out of office. Perlstein's most recent book, the fourth in an award-winning series investigating the history of modern American conservatism, is Reaganland: America's Right Turn 1976–1980.In our second segment, we bring you the latest installment of our ongoing series “Not in Our Name,” which highlights the diverse voices of Jewish activists, artists, intellectuals, and others who are speaking out against the Israeli occupation. In this installment, Marc is joined by author and scholar Marjorie Cohn to discuss the significance of current Palestinian resistance to, and international condemnation of, the violence of Israeli occupation. Marjorie Cohn is professor emerita at Thomas Jefferson School of Law, former president of the National Lawyers Guild, and a member of the bureau of the International Association of Democratic Lawyers and the advisory board of Veterans for Peace. Today on Sojourner Truth: On Tuesday, January 12, the House of Representatives is expected to vote on a measure calling for Donald Trump to be removed from office through the 25th Amendment following the armed and violent insurrection at the US Capitol last week. Democratic lawmakers in the House have introduced a single charge of impeachment " incitement of insurrection " against Trump. The impeachment measure has the backing of over 200 Democratic co-sponsors, according to MSNBC. According to the latest polls, 56 percent of the public support Trump's removal. Despite their lives being put in danger with the armed insurrection that took place on Wednesday, January 6, House Republicans refused to give unanimous consent to the resolution urging Pence to start the process. Nevertheless, support is growing for Trump to be indicted under federal, state and DC laws for his role in inciting the deadly event. On Monday, January 11, newly-elected Congresswoman Cori Bush filed formal legislation urging the removal of any elected officials involved in inciting last Wednesdays deadly terrorist insurrection. The legislation invokes Section 3 of the 14th Amendment to the Constitution, which allows Congress to remove any legislators engaged in insurrection or rebellion against the United States. Also on Monday, January 11, the U.S. Supreme Court formally refused to put on a fast track election challenge filed by Trump and his allies. The top court denied pleas for quick consideration of cases involving the outcome in five states won by Joe Biden: Arizona, Georgia, Michigan, Pennsylvania and Wisconsin. Our guests are Congresswoman Maxine Waters, Jody David Armour and Marjorie Cohn.

Today on Sojourner Truth: A possible sweep by Democrats in the Georgia Senatorial election. Victory has been declared for 51-year-old Raphael Warnock, who makes history as the first Black Senator from the southern state of Georgia. He narrowly defeated Kelly Loeffler. Loeffler was appointed to her seat by the governor of Georgia to fill a vacancy left by Johnny Isakson, who resigned his Senate seat due to health reasons. Loeffler is an ardent Trump supporter and is one of the Senators who today will challenge the election of Biden/Harris. Liberal Democrat Jon Ossoff maintains a narrow lead over Republican Trump supporter David Purdue. If he wins, Jon Ossoff will be the youngest Senator to be seated since Joe Biden. Ossoff is of Jewish descent. Are we witnessing a resurgence of Black-Jewish alliances reminiscent of the civil rights era? What role did Black voters play in the outcome? Our guest is Jill Cartwright, Georgia statewide organizer for Southerners for New Ground (SONG). All this, as drama unfolds in Congress today as elected officials on both the House and Senate side will attempt to stop the electoral college vote certification of the Biden/Harris administration. Donald Trump has made a phone call that may have been illegal to a Georgia election official pushing him to nullify the vote count there and instead give the Georgia vote to him. Trump is also making the false claim that Vice President Pence has the power to nullify the electoral college vote, but thus far Pence is said to have explained to Trump that he does not have such power. Meanwhile the streets of Washington, D.C. will be hot today with thousands of Trump supporters descending on the nations capital to demand that Trump remain President. Trump and other elected officials who stand with him are expected to speak to the crowd and D.C.s mayor has requested assistance from the National Guard. Law professor and attorney Marjorie Cohn joins us. Trouble in Los Angeles for the new District Attorney George Gascon. He was elected with the support of BLM and other community based organizations. He promised major criminal justice reforms and then proceeded to implement them only to be met by resistance by Los Angeles County prosecutors, who have filed a law-suit against him. Whats going on? For our ongoing Campaigners for Black Lives, we speak with Dr. Melina Abdullah, founder and coordinator of BLMLA.

They will also decide who will fill 435 seats in the House of Representatives and 35 of the 100 seats in the U.S. Senate. Within the Senate, the GOP is defending 23 seats. Furthermore, thirteen state and territorial governorships, as well as many other state and local elections, are up for grabs.
