The Round Table: A Next Generation Politics Podcast

You may recall that former President Trump wanted to add a kind of citizenship question that had never been included on every census form. As such, the Census Bureau conducted research in advance of 2020 to test out the anticipated impact of a citizenship question. It sent out a form that looked like the Census, half of which had a citizenship question and half of which didn't. The Bureau found that there WAS a sensitivity and hesitancy amongst Latinx and Asian households when that question was asked, which could lead households with non-citizens not to participate in the Census. He noted that this can particularly imperil mixed status households, where some are citizens and some aren't, risking not only non citizens not being counted but citizens. Hansi noted that if the goal was to get a more detailed count on how many citizens and noncitizens there are, there's a less expensive and more accurate way to do so: using government records already conducted through other agencies. The Citizenship Question battle is over. We are thrilled to report the question will not be included on the census form. Nonprofits must now turn to ensuring a fair, accurate, and complete count. Everyone counts, so everyone must be counted. Seven states began the new fiscal year without full budgets. Governors have not been shy to veto budget bills or use line-item veto power to cut programs affecting nonprofits. Alaska is facing a crisis with the Legislature failing to override $440 million in line-item cuts including education, arts, Medicare, scholarship, and transportation programs. Laurie Wolf of The Foraker Group wrote an article all nonprofits facing budget issues should read called: Have Courage. We have put out a 5-minute survey asking nonprofits about budget constraints caused by the tax on nonprofit transportation benefits. Please let us know how the tax affected your mission. Let's get started. This past week, people closely followed the news about the 2020 Census.  They wanted to know if the 2020 Census would include a Citizenship Question. The answer to this question seemed to change every hour. President Trump wanted to have a Citizenship Question on the 2020 Census.  He said that the Citizenship Question would protect voting rights. The federal courts disagreed that the Citizenship Question would protect voting rights. The courts reviewed what the Constitution said about the Census, state representation, and voting rights. Article 1 Section 2 of the Constitution says that Congress must count all people living in the United States every 10 years. The number of a state's representatives is based on the number of people--not citizens--who live in the state. If some people are not counted, states would lose members in the House of Representatives, plus government money for public services. Also, many people oppose the Citizenship Question on the 2020 Census.  They think that every person must be counted in the 2020 Census.  They contacted their Senators and Representatives by phone, email, or Twitter.  Some people said that they would not answer the Citizenship Question because they are not legal residents or live with people who are undocumented.  There are afraid of being deported. On Thursday, July 11, 2019, President Trump that the 2020 Census will not have the Citizenship Question BUT he issued an executive order for federal agencies to collect and share people's citizenship information.  Trump said that the Citizenship information will show us how immigration changes America.  The citizenship information will help us make stronger immigration laws and give public services.  Trump's executive order wants states to draw voting districts based on number of eligible voters (citizens) instead of total number of people (citizens, legal residents, and undocumented), which many people say will give more power to Republicans & Non-Hispanic Whites voters and may take away the voting power of Democrats, Hispanic, African-American, and other minority voters. While people are still taking about what Trump's executive order, communities are preparing for U.S. Immigration and Customs Enforcement raids this weekend.  All undocumented immigrants can be arrested and deported, not just immigrants who have committed crimes.  Sometimes, U.S. citizens are arrested during ICE raids. Remember, NEVER LIE ABOUT YOUR IMMIGRATION STATUS! All people--citizens and non-citizens--have rights under the US Constitution. DO NOT OPEN THE DOOR if an immigration agent is knocking on the door. DO NOT ANSWER ANY QUESTIONS from an immigration agent if they try to talk to you. You have the right to remain silent. DO NOT SIGN ANYTHING without first speaking to a lawyer. President Trump has decided to drop the effort to get a citizenship question on the 2020 Census and will instead issue an executive order requiring all federal agencies to submit information on citizenship data to the U.S. Department of Commerce.  The president is insisting that he is not backing down and will still find out how many citizens and non-citizens are in the country.  Nicole Narea, immigration reporter for Law360, joins us to explain it all. Next, the FBI is investigating a secret gang-like group within the Los Angeles County Sheriff's Department. The federal probe comes after there were allegations of beatings and harassment by members of the Banditos, a groups of deputies in the East LA Sheriff's station.  The members of the group all share a tattoo of a skeleton with a sombrero, bandolier and pistol.  Maya Lau, reporter for the LA Times, joins us for more. Finally, a skull fragment found in the roof of a cave in Greece is now considered the oldest fossil of Homo sapiens ever discovered in Europe. On June 27, the Supreme Court decided Department of Commerce v. New York, the legal challenge arising from Commerce Secretary Wilbur Ross’s decision to ask about the citizenship of census respondents. The case presents three questions: First, whether the 2020 Decennial Census can ask regarding each person counted at each residential address in the nation whether that person is a U.S. citizen. Second, whether district courts in an Administrative Procedure Act (APA) can order discovery beyond the administrative record to examine a Cabinet officers’ decision-making. And third, whether adding a question on citizenship violates the Constitution’s Enumeration Clause.Chief Justice Roberts delivered the majority opinion (5-4) which claimed Secretary Ross did not violate the Enumeration Clause or the Census Act by reintroducing a citizenship question on the 2020 census, however because of the discrepancy between the Department of Commerce's evidence and the Secretary's explanation for his decision, the case is sent in part back to the District Court.Please join us as our expert shares his reaction to and analysis on the decision.Featuring: Dr. John S. The acting director of the Census Bureau found himself in the hot seat before Congress Tuesday. In the home stretch for the 2020 count, lawmakers are concerned by some questions on the census forms.They're also worried about the rollout of the agency's dress rehearsal in Providence, Rhode Island. The Government Accountability Office reported that only a fraction of Census' IT systems were ready for that test.
