Clause 4: Adjournment. Neither House, during the Session of Congress, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting. Neither House may adjourn, without the consent of the other, for more than three days. Often, a House will hold pro forma sessions every three days; such sessions are merely held to fulfill the constitutional requirement, and not to conduct business. Furthermore, neither House may meet in any place other than that designated for both Houses (the Capitol), without the consent of the other House. Section 6: Compensation, privileges, and restrictions on holding civil office. Clause 1: Compensation and legal protection. The Senators and Representatives shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the United States. They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place. Senators and representatives set their own compensation. Under the Twenty-seventh Amendment, any change in their compensation will not take effect until after the next congressional election. Paying senators and representatives out of the federal treasury was a departure from the practice under the Articles of Confederation, where they were paid by the state in which they were elected. Members of both houses have certain privileges, based on those enjoyed by the members of the British Parliament. Members attending, going to or returning from either house are privileged from arrest, except for treason, felony or breach of the peace. One may not sue a senator or representative for slander occurring during Congressional debate, nor may speech by a member of Congress during a Congressional session be the basis for criminal prosecution. The latter was affirmed when Mike Gravel published over 4,000 pages of the Pentagon Papers in the Congressional Record, which might have otherwise been a criminal offense. This clause has also been interpreted in Gravel v United States, (1972) to provide protection to aides and staff of sitting members of Congress, so long as their activities relate to legislative matters. Clause 2: Independence from the executive. No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States, which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office. Senators and representatives may not simultaneously serve in Congress and hold a position in the executive branch. This restriction is meant to protect legislative independence by preventing the president from using patronage to buy votes in Congress. It is a major difference from the Westminster political system in the British Parliament as well as those of some other nations using the parliamentary system, where cabinet ministers are required to be members of parliament. Furthermore, senators and representatives cannot resign to take newly created or higher-paying political positions; rather, they must wait until the conclusion of the term for which they were elected. If Congress increases the salary of a particular officer, it may later reduce that salary to permit an individual to resign from Congress and take that position (known as the Saxbe fix). --- Send in a voice message: https://podcasters.spotify.com/pod/show/law-school/message Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

GREEGREE #127 starts with the great ANDREA MILLER of the Center for Common Ground as she explains her legendary organization's grassroots work in the upcoming Wisconsin Supreme Court  race.  Because the Court in WI is evenly divided (3-3) between progressives v. conservatives, this oddly timed (April 3) election will have huge impact.   As Andrea explains, a woman's right to choose is on the line, as is redistricting, voter registration and much more in a state that could well decide the 2024 presidential campaign. We hear further from KARLA SAND in Minnesota, who gives important detail on the unexpected victory of KEITH ELLISION for the AG office in Minnesota. DR. RUTH STRAUSS asks Andrea about the Virginia election that has now sent the state's first woman of color to the US Congress. DOROTHY REIK and CYNTHIA PAPERMASTER also add to our discussion, in particular about the potential US Senate candidacy of Rep. Barbara Lee, the only Congressperson to vote again the Afghan War. WENDI LEDERMAN then presents a crucial overview of the use of the state-wide referendum in protection critical rights like abortion, legal pot, medicaid expansion, democracy-based districts and more. GEORGE RIPLEY tells us of the Ballot Initiate Strategy Center formerly affiliated with the great Senator Mike Gravel. This discussion of grassroots referenda will be critical to our work all the way through the 2024 nation election.

In an era of expanding authoritarian violence overseas and crippling political divisions in the United States, three generations of activists will explore how democracy can be saved through our current political system. Using lessons from the unconventionally innovative presidential candidacies of the late Senator Mike Gravel, Marianne Williamson, and Andrew Yang, the panel will demonstrate how social media, film, and provocative progressive language expanded the range of policies politically acceptable to the mainstream voting population. The relevance of these strategies has become even more critical now than in the 2020 campaigns in which they were developed.

This episode of Across The Margin: The Podcast introduces you to American Gadlfy, a documentary that tells the story of how, a decade since his last campaign, 89-year-old former senator and 2008 presidential candidate Mike Gravel came out of retirement when a group of teenagers convinces him to run for president one last time. Through the senator's official Twitter account, the four “Gravel teens” embark on an unlikely adventure to qualify him for the Democratic debates in order to advance an anti-war, anti-corruption, and direct democracy agenda in the 2020 presidential race. Working together, the young activists and the experienced politician confuse and amaze the generations between them. To properly delve into this powerful, inspiring documentary, this episode features an interview with the director of American Gadfly, Skye Wallin. For over a decade, Wallin has been deeply immersed in the worlds of documentary, journalism, and activism. He spent several years filming with scientists and activists at more than twenty water-related disasters across the United States. Wallin worked closely with Mark Ruffalo on this project, leading video and short documentary production for Ruffalo's organization Water Defense for three years. Wallin's work helped to expose multiple water pollution scandals that had been covered up, including EXXON's poisoning of Lake Conway in Arkansas and millions of organic crops being watered with oil-contaminated water sold to farmers by Chevron, the latter of which resulted in front page coverage in the Los Angeles Times. His latest effort, American Gadlfy, isn't simply a documentary about an underdog trying to win an election. It's about how the next generation understands democracy, engages in politics and influences ordinary people with passion, humor and honesty. So tune in to learn all about this rousing political adventure on this latest episode of Across the Margin: The Podcast. See acast.com/privacy for privacy and opt-out information.

The effects of the clause were discussed in 1937, when Senator Hugo Black was appointed an associate justice of the Supreme Court with some time left in his Senate term. Just prior to the appointment, Congress had increased the pension available to Justices retiring at the age of seventy. It was therefore suggested by some that the office's emolument had been increased during Black's senatorial term, and that therefore Black could not take office as a justice. The response, however, was that Black was fifty-one years old, and would not receive the increased pension until at least 19 years later, long after his Senate term had expired. --- This episode is sponsored by · Anchor: The easiest way to make a podcast. https://anchor.fm/app

Senator Mike Gravel passed away on June 26, 2021 at the age of 91. Leaving an amazing activist and political career behind him Robbie and Abby decided to reflect on and celebrate his *true* legacy, one that has been white washed and cherry picked even in the recent newspaper obituaries. A legacy that included sticking his neck out on taboo issues like advocating for a new 9/11 investigation and pushing legislation that encouraged cooperation with the formerly People's Republic of China. Gravel had been a huge inspiration to Media Roots since the very beginning, leaving a lasting imprint on both Abby and Robbie since they watched him on the presidential debate stage VS Barack Obama in 2008. Because of this admiration, Robbie and Abby felt lucky they got Senator Gravel on Media Roots Radio twice as a guest over the years. Early internet independent journalists Eric & Mike Jackman also known as the Jackman brothers had an opportunity to meet Gravel during the 2008 primary, as they happened to live in New Hamphshire, a prime spot for visiting campaigning candidates during the presidential primary season. While Gravel was campaigning in New Hampshire, Mike Jackman landed a job working for Senator Gravel as his driver. Of course one of the more entertaining aspects of the job was hearing many hilarious and fasccinating anecdotes in long car rides with the Senator. The Jackman brothers then continued to keep in contact with Senator Gravel for the next 13 years. There's nothing complicated about today's episode, this is a celebration of the life and career of Senator Mike Gravel featuring Robbie Martin, Abby Martin, Mike Jackman & Eric Jackman. Scott and Matthew Hoh have a wide-ranging conversation about America's war on terrorism. The latest news is that the U.S. troop withdrawal from Afghanistan is essentially complete, with the exception of a small number of soldiers, contractors and CIA operatives ostensibly remaining behind for diplomatic purposes. Hoh is optimistic about the possibility of the American military really being finished with Afghanistan now, though he and Scott both fear that the resulting instability could be used as an excuse to lobby for continued intervention. Hoh also discusses veteran suicide rates from the post-9/11 wars, which have surged way beyond those of the general population in recent years. Discussed on the show: "High Suicide Rates among United States Service Members and Veterans of the Post-9/11 Wars" (Cost of War Project) "The Redirection" (The New Yorker) No Good Men Among the Living: America, the Taliban, and the War through Afghan Eyes "Mike Gravel and An Ongoing Road to Courage" (CounterPunch.org) The Pentagon Papers Matthew Hoh is a senior fellow at the Center for International Policy and formerly worked for the U.S. State Department. Thank you for tuning in and supporting the pod, and shout out to my patrons, you are the fuselage on my gunship and the black and white pattern on my zebra! Your veggies this week are very tasty indeed. A bit fucked, admittedly, but tasty. As always, I sweeten the meal with some zany audio tidbits, and I share an original poem I've recently written.First, we unpack the effing Supreme Court's ruling that Nestle and Cargill are legally allowed to profit off of child slavery in Cote D'Ivoire. Abolish SCOTUS! Grrr. It's an utterly undemocratic institution whose primary function is to defend Capital. Only one justice dissented from the 8-1 decision allowing corporations to profit off child slavery. She is Sonia Sotomayor, born in the Bronx to Puerto Rican parents, the only good SCOTUS Justice. I tip my hat to her, she showed courage and did the right thing despite her colleagues' grotesque miscarriage of justice. Sonia can stay after we abolish SCOTUS. Secondly, I pay homage to Mike Gravel, who recently passed on at the age of 91. As a freshman Senator from Alaska in 1971, Gravel was the only person in the entire Senate with the balls to take custody of the top secret Pentagon Papers leaked by whistleblower Daniel Ellsberg. Gravel then spoke the Papers into the public record, risking imprisonment or worse. The Pentagon Papers were crucially important for the American anti-war movement, as they demonstrated, among other things, that the LBJ administration had "systematically lied, not only to the public but also to Congress" about the goings on in the Vietnam War. Gravel also bravely fought to prevent the Vietnam War draft, and did more than any other Alaskan Senator to improve the quality of life and access to education for Indigenous Alaskans. Rest in Power, Mike Gravel. Help the BNP stay on the air for as little as $1/month at www.patreon.com/noetics. Former senator and two-time presidential candidate Mike Gravel died this weekend. His presidential runs were more a curiosity than serious, and Gravel was often the butt of jokes. But he was an American hero, dating back to his first term in the senate. It was 1971. Daniel Ellsberg desperately wanted a member of Congress to read the Pentagon Papers into the official congressional record. The one who stood up and did it was Mike Gravel. Today on the show, I'll share a bit of the background of the story, John Nichols' article for The Nation that pays tribute to the man, and the interview he did with me in April of 2019 during his final run for the presidency. At a time when we need elected officials who are in it for the correct reasons, I honor the late Mike Gravel.
