This week, we're looking at the dueling reactions to the Annunciation school shooting. On the left, Minnesota Governor Tim Walz (D.) is calling for a special session of the legislature to pass a gun-control package likely to include an AR-15 ban. On the right, the Department of Justice is reportedly considering an effort to ban all trans people from owning guns. The Second Amendment Foundation is opposed to both of these ideas. So, we have Kostas Moros, a lawyer who was recently hired by the gun-rights group, back on the show to explain why he doesn't like the proposals and how they might fare legally and politically. Moros said any attempt to blanket-ban people who identify as trans or who have been diagnosed with gender dysphoria from owning guns would run into serious legal and constitutional trouble. He explained that current law requires an individual finding of dangerousness for the government to strip anyone of their gun rights on the basis of mental health. He argued, even if Congress changed the law, it would run afoul of the Second Amendment, and the Supreme Court would likely strike it down. Moros argued the same is true for the potential "assault weapons" ban that could come out of Minnesota. He said four Supreme Court justices have already signaled they'd strike down a ban, and a Minnesota law could actually provide further reason for the Court to get involved. The bar exam is in a state of flux. A new "NexGen" test is about to debut, while several states now offer licenses to attorneys who haven't taken the exam at all. These bar exam alternatives, many of which originated as emergency pandemic measures, are proving successful in smaller states, like South Dakota and New Hampshire, and even some larger ones, like Arizona and Oregon. But a nationwide bar exam alternative is not on the horizon, and large corporate firms have shown little willingness to hire attorneys licensed through these alternative programs, according to Bloomberg Law reporter Maia Spoto. Maia spoke to Jessie Kamens, the host of our On The Merits podcast, about how these programs work and why some advocates say we need to finally ditch the grueling, multi-day test. TVC 694.1: Ed welcomes back Tom Lisanti, renowned historian of sixties cinema, and the author of such books as Carol Lynley: Her Film & TV Career in Thrillers, Fantasy and Suspense and Ryan's Hope: An Oral History of Daytime's Groundbreaking Soap. Tom's recent books include Dueling Harlows: The Race to Bring the Actress's Life to the Silver Screen, everything you wanted to know about the two major motion pictures released in 1965 about screen legend Jean Harlow—both of which happened to be named Harlow—and the highly publicized efforts by rival producers Bill Sargent and Joseph Levine to out-do each other. Sargent's Harlow, a quickly made independent movie starring Carol Lynley, was filmed in black and white, using Sargent's patented technology Electronovision. Levine's Harlow, a big budget biopic starring Carroll Baker, was filmed in color for Paramount Pictures. Both Harlows were originally released within a few weeks of each other in 1965; both are available now on home entertainment. Dueling Harlows is available from McFarlandPub.com.
