Send us a textMarijuana in large part accelerated Fairfax criminal lawyer Jonathan Katz's transition from working at a corporate law firm to becoming a criminal defense lawyer many years ago. Jon Katz one day read about a federal prosecutor's issuance of a subpoena for High Times Magazine's advertiser records. Jon figured that the prosecutor was going after customers of hydroponic indoor marijuana growers. In protest, Jon took out a subscription to High Times, and told the same by letter to the then-federal attorney general and High Times. As a result of that subscription, Jon learned about criminal defense lawyer Don Fiedler, who was then national director of NORML, who helped Jon steer his path towards criminal defense. In rapid order, Jon joined the National Association of Criminal Defense Lawyers, and met its then-executive director Keith Stroup. the founder of the National Organization for the Reform of Marijuana Laws (NORML), which is devoted to marijuana consumers, rather than to manufacturers and sellers. Jon had previously read the authorized NORML biography High in America, and has been fascinated by Keith's story. Keith has for many years been back with NORML, where he is current legal counsel. The story of marijuana legalization and decriminalization provides strong lessons for criminal defense lawyers and their clients, about perseverance, team building and reversing roles. Marijuana remains criminalized at the federal level, but its odor is no longer a basis under Virginia law for a police search, and possession of designated amounts is no longer an offense in Virginia, which still needs legalized retail sales beyond medicinal sales. Many marijuana reformers have worked tirelessly and creatively over the decades to get us to where we are now. The team building involved in obtaining marijuana reform goes well beyond so-called political progressives. The reversing roles looks at what makes politicians and other policymakers tick for no longer demonizing marijuana. Marijuana was integral to the evolving culture wars of the 1970s, with long criminal sentences meted out to some while others flouted the law with alacrity. No one was more central to the battles over marijuana policy than Keith Stroup, who founded the National Organization for the Reform of Marijuana Laws (NORML) in 1970 and directed the organization for most of the decade. His allies spanned the spectrum of respectability from Harvard professors and former high level government officials to Gonzo journalist Hunter Thompson, Yippie activist Abbie Hoffman, Playboy founder Hugh Hefner and assorted marijuana smugglers, most notably Tom Forcade, who started High Times magazine. We talked about President Richard Nixon's efforts to block marijuana law reform and President Jimmy Carter's support for decriminalization. Eleven states decriminalized marijuana during the mid-1970s but the momentum faded rapidly as the decade neared completion. Keith Stroup is a Washington, DC public-interest attorney who founded NORML (National Organization for the Reform of Marijuana Laws) in 1970. Stroup obtained his undergraduate degree in political science from the University of Illinois in 1965, and in 1968 he graduated from Georgetown Law School in Washington, DC. Stroup first smoked marijuana when he was a first-year law student and has been a regular smoker since. Following two years as staff counsel for the National Commission on Product Safety following law school, a job that allowed him to avoid the Vietnam War with a critical skills deferment, Stroup founded NORML and ran the organization through 1979, during which time 11 states decriminalized minor marijuana offenses. Stroup has also practiced criminal law, lobbied on Capitol Hill for family farmers and artists, and for several years served as executive director of the National Association of Criminal Defense Lawyers (NACDL). In 1994 Stroup resumed his work with NORML, rejoining the board of directors and serving again as Executive Director through 2004. He is currently NORML's Legal Counsel. In 1992 Stroup was the recipient of the Richard J. Dennis Drugpeace Award for Outstanding Achievement in the Field of Drug Policy Reform presented by the Drug Policy Foundation, Washington, DC. In 2010 he received the Al Horn Award for Advancing the Cause of Justice from the NORML Legal Committee. And in 2012 Stroup received the High Times Lifetime Achievement Award. New York’s legal weed program is set to be the best in the nation, according to David Holland, executive and legal director of Empire State NORML. How great is New York State’s legal cannabis program? First of all, possession of up to three ounces of cannabis and 24 grams of concentrate is effective immediately for adults. Home GrowHome cultivation, the bane of our collective existence, is permitted once regulations are adopted. Adults can grow a maximum of three mature plants and three immature plants. Households with two or more adults are permitted to grow twice that amount. “Home grow was a critical element as far as NORML was concerned,” said Holland, former legal counsel for High Times and president of the New York City Cannabis Industry Association (NYCCIA).Social Equity and Automatic ExpungementNew York’s Marijuana Regulation and Taxation Act (MRTA) provides for automatic expungement or resentencing for anyone “with a previous marijuana conviction that would now be legal under the law and provides necessary funding.”In terms in fair reinvestment, the law stipulates that 40% of cannabis tax revenue will be reinvested in communities that have been disproportionately targeted by cannabis enforcement and the racist war on drugs as well as women and disadvantaged farmers. “We were no longer going to tolerate rampant abuse of law enforcement against people of color especially black people who suffered under the war on drugs with over policing,” Holland said.Twenty percent of revenue will go to schools, and 40% to drug treatment facilities and public education.Home DeliveryHolland pointed out that there is already an informal yet extremely efficient infrastructure functioning among the legacy cannabis market operators. “Legacy market operators are very capable of continuing to operate efficiently and effectively. We’d like these so-called ‘outlaws’ to become in-laws. They clearly know how to run the industry whereas legislators in Albany have no idea.”Public Consumption New York will have public consumption spaces, pop-up shops, and eventually catering licenses will be available. How many operating licenses? That has not been decided yet, so stay tuned. A tribute Holland ended the interview with a tribute to those who worked long and hard for legalization. He specifically named two people. “We would not be here discussing this if it were not for people like [former High Times Magazine Chairman and civil rights attorney] Michael Kennedy and [NORML founder and attorney] Keith Stroup.”

In a heartbeat, her life changed from one of optimism, vibrancy, enthusiasm, confidence, and extroversion, to one of constant pain, withdrawal, depression, and hopelessness.While trying to help administer a routine vaccine to a young boy, Nikki was thrown against the wall, suffering a significant TBI and cervical instability in the process. Nikki’s TBI has caused cognitive deficiencies, confusion, memory loss, anxiety, and pain. She found herself unable to work, unable to interact with others, and in a very dark place. From the moment Illinois' Medical Cannabis program was signed into law, he became deeply involved in the complex process of positioning himself as a medical expert on cannabis. And Carla Lowe, is the founder of Citizens Against Legalizing Marijuana (CALM). She has been a volunteer anti-drug activist since 1977. Carla co-founded Californians for Drug-Free Youth and Californians for Drug-Free Schools. In addition, she chaired the Nancy Reagan Speakers' Bureau of the National Federation of Parents for Drug-Free Youth. Lowe is a mother of five grown children, grandmother of nine, and former high-school teacher. Carla states: "During my past 33 years as a volunteer anti-drug activist, I have been involved in non-profit 501 (C) (3) organizations, several that I started A non-profit group is limited by law as to its political expenditures. We could not lobby openly against any marijuana legislation. In 1979, I think, I heard Keith Stroup, new director of NORML (National Organization to Reform Marijuana Laws) say that in their quest to see smoked marijuana become legal around the country, it would first need to be accepted as a “medicine,” that this would be the “red herring” necessary to give it a good name among the public." Keith Stroup, Founder of NORML, may be a down-home country boy, from Southern Illinois, but he sure did make it in the big city (from Box #10 w/Jim Croce). Keith takes me on a walk, through the annals of his legendary history as a founding father of the marijuana legislation movement in the US. From his early years growing up in Southern Illinois, to Georgetown Law School where he became politically radicalized by the Vietnam anti-war movement, and he started using cannabis. After getting his law degree and working with Ralph Nader, he was inspired to start a consumer group for cannabis users and using his legal skills to try and impact public policy rather than simply "to assist your individual clients get richer, stay out of trouble or whatever" On founding NORML: "First off, I enjoyed smoking it but I also had become part obviously, of the underground culture of millions of smokers around this country, and began to be aware of the hundreds of thousands of people who were being arrested and having their lives destroyed because of a senseless policy. So I got some friends together a couple of colleagues of mine at the time and we found it normal as marijuana smokers lobby. " From here Keith goes on to outline his work with NORML over the years along with key moments in the history of marijuana legislation, starting with the foundational motivation of avoiding being drafted, "but for that Vietnam War and that experience of having lived through that terrifying experience and thinking you're going to be drafted and sent to war, I don't think I ever would have had the interest to start NORML, but because of that, it that I jumped into it with both feet. I think I was a bit naive at the time. I remember someone asked me how long I thought it was going to take. And I said I thought it would take at least 10 years. Well, that was in 1970. So it's taken us a little longer than that, where I think we're in our 45th year at NORML, but it is now finally happening" Keith discusses the shift in public opinion under the influence of more conservative leaders; "Well, we underestimated the possibility of the public mood shifting. And as of the late 70s, early 80s, you had Ronald Reagan and Nancy Reagan. (The) "Just say no" movement, the parents movement, there was a period there where we began as a country to evaluate drug proposals on whether they were good for children. Well, no one is suggesting that children should be using marijuana or alcohol or any other drugs. But nonetheless, that was started the test and as a result, after we got the 11th state to decriminalized in 1978, we didn't win another statewide victory for 18 years" Bringing us to the current day, Keith discusses the latest legislation approved by the house judiciary committee, " And one of the reasons that the bill at the House Judiciary Committee approved just yesterday, right is so important is because it's called the MORE act. And among the things that would do the most important is it wouldn't just lower marijuana to a lower schedule under the Controlled Substances Act, it would, in fact, remove it altogether from the Controlled Substances Act. Keith Stroup is a Washington, DC public-interest attorney who founded NORML in 1970. Stroup obtained his undergraduate degree in political science from the University of Illinois in 1965, and in 1968 he graduated from Georgetown Law School in Washington, DC. Following two years as staff counsel for the National Commission on Product Safety, Mr. Stroup founded NORML and ran the organization through 1979, during which 11 states decriminalized minor marijuana offenses. Stroup has also practiced criminal law, lobbied on Capitol Hill for family farmers and artists, and for several years served as executive director of the National Association of Criminal Defense Lawyers (NACDL).
