This Day in Legal History: Louisiana PurchaseOn this day in legal history, April 30, 1803, the United States signed the Louisiana Purchase Treaty with France, dramatically altering the legal and territorial landscape of the country. The treaty, signed in Paris by American envoys Robert Livingston and James Monroe, officially transferred approximately 828,000 square miles of land west of the Mississippi River from French to American control. President Thomas Jefferson, though uncertain whether the U.S. Constitution explicitly authorized such a land acquisition, ultimately supported the deal, citing the necessity of expanding the republic and securing trade access to the port of New Orleans.The purchase, which cost $15 million (roughly four cents an acre), effectively doubled the size of the United States and set a precedent for executive power in foreign affairs. It raised important legal questions regarding the role of the executive branch, the powers of Congress, and the interpretation of constitutional authority in territorial expansion. The acquisition also intensified debates over the expansion of slavery and the treatment of Indigenous peoples, both of which would become central legal and political issues throughout the 19th century.In addition to expanding national territory, the Louisiana Purchase laid the groundwork for the exploration and legal organization of new states. A state court previously blocked the school, ruling it would act as a “governmental entity” and violate the First Amendment's Establishment Clause, which bars government endorsement of religion.The school's supporters, including Oklahoma's governor and President Trump, argue that denying the school solely because it is religious constitutes a violation of the Free Exercise Clause of the First Amendment. Meanwhile, opponents, including the state's attorney general, warn that the move would amount to taxpayer-funded religious indoctrination and could erode public education standards, particularly around non-discrimination.Charter schools in Oklahoma are considered public entities, which complicates claims that St. Isidore would operate as a private, independent institution. Under the current Supreme Court composition, it is likely we will see an expansion of the former at the cost of the limits in the latter. US Supreme Court mulls legality of milestone religious charter school | ReutersGoogle CEO Sundar Pichai is set to testify in a high-stakes antitrust trial where the U.S. Department of Justice is pushing to break up parts of Google's business to restore competition in online search. The DOJ is urging the court to force Google to divest its Chrome browser and stop paying major tech partners like Apple and Samsung to be the default search engine on their devices. Prosecutors argue these deals entrench Google's monopoly and hinder innovation, especially as search overlaps more with emerging generative AI tools like ChatGPT.U.S. District Judge Amit Mehta has already found that Google maintains a dominant position in the search market with no real rivals. The government is also asking the court to make Google share search data with competitors to level the playing field. Google, in response, claims that such measures would harm user privacy and undercut smaller partners like Mozilla that depend on Google funding.Pichai is expected to argue that the proposed remedies would have unintended consequences across the tech ecosystem. Google has already made some adjustments, allowing phone makers to pre-install alternative search and AI apps, but it still plans to appeal any adverse ruling. Though the order doesn't name specific firms, it expands Trump's broader effort to harness the legal industry to support his administration's priorities.This follows recent agreements between the Trump administration and nine major law firms—including Paul Weiss, Skadden, and Kirkland & Ellis—to commit $940 million worth of pro bono work to causes the administration endorses, such as veterans' services and combating antisemitism. Critics, including the National Association of Criminal Defense Lawyers and 20 Democratic state attorneys general, have raised concerns about political pressure and lack of transparency in how these firms were selected and what they've agreed to.The order also calls for improved pay and training for police while denouncing efforts to “demonize law enforcement.” Critics warn this could undermine accountability and place pressure on firms to align their legal services with political goals. Meanwhile, some firms have publicly stated they will maintain control over their pro bono work, even as Trump claims the right to “use” them for administration-selected causes.Trump executive order seeks law firms to defend police officers for free | ReutersIn a piece I wrote for Forbes this week, I examined President Trump's renewed push to replace income taxes with tariffs, particularly targeting relief for Americans making under $200,000. The idea sounds populist, but it's economically misleading. Tariffs, after all, are simply hidden taxes that show up in the form of higher prices on imported goods. For lower- and middle-income Americans—those Trump claims to want to help—this shift would likely increase, not reduce, their financial burden.The proposal doesn't change the amount of money the government needs—just where it's extracted. Instead of the IRS, the “bill collector” becomes stores, suppliers, and foreign producers, with consumers footing the bill at checkout. Trump's approach, I argue, banks on the psychological difference between writing a tax check and absorbing incremental price hikes, though the economic effect is the same.Historically, tariff-based revenue systems led to inequality and volatility—conditions that helped inspire the adoption of the income tax through the Sixteenth Amendment. And practically speaking, tariffs simply cannot generate the hundreds of billions needed to sustain modern federal programs. Relying on them also cedes revenue control to foreign exporters, which undermines national fiscal stability.Ultimately, this policy doesn't tackle the real issue—Americans' frustration with a high cost of living. Instead, it disguises taxation while dodging the deeper structural question of who should be paying more. Jon Katz in this first Beat the Prosecution episode in a year without a guest, illustrates how he won an assault trial by supporting his client's alibi by illustrating the alleged assault's happening in Club Blah, where the defendant at the time was in Club Ah, and could not bring himself to stepping foot in Club Blah any more than he could bring himself to drinking a cask of prune juice mixed with vinegar. The persuasive story at trial usually is not found overnight, but is discovered with close attention and listening, visiting the incident scene, and bringing the listeners to the scene and the circle and center of the story, often incorporating all five of the human senses. Read more about persuasive storytelling in court, with Jon's article published in the Virginia Association of Criminal Defense Lawyers newsletter, entitled "Story power – DID YOU DO IT? Send us a textMarijuana in large part accelerated Fairfax criminal lawyer Jonathan Katz's transition from working at a corporate law firm to becoming a criminal defense lawyer many years ago. Jon Katz one day read about a federal prosecutor's issuance of a subpoena for High Times Magazine's advertiser records. Jon figured that the prosecutor was going after customers of hydroponic indoor marijuana growers. In protest, Jon took out a subscription to High Times, and told the same by letter to the then-federal attorney general and High Times. As a result of that subscription, Jon learned about criminal defense lawyer Don Fiedler, who was then national director of NORML, who helped Jon steer his path towards criminal defense. In rapid order, Jon joined the National Association of Criminal Defense Lawyers, and met its then-executive director Keith Stroup. the founder of the National Organization for the Reform of Marijuana Laws (NORML), which is devoted to marijuana consumers, rather than to manufacturers and sellers. Jon had previously read the authorized NORML biography High in America, and has been fascinated by Keith's story. Keith has for many years been back with NORML, where he is current legal counsel. The story of marijuana legalization and decriminalization provides strong lessons for criminal defense lawyers and their clients, about perseverance, team building and reversing roles. Marijuana remains criminalized at the federal level, but its odor is no longer a basis under Virginia law for a police search, and possession of designated amounts is no longer an offense in Virginia, which still needs legalized retail sales beyond medicinal sales. Many marijuana reformers have worked tirelessly and creatively over the decades to get us to where we are now. The team building involved in obtaining marijuana reform goes well beyond so-called political progressives. The reversing roles looks at what makes politicians and other policymakers tick for no longer demonizing marijuana. On this episode of Beat the Prosecution, Jon welcomes Keith Stroup and NORML political director Morgan Fox, for an eye-opening look at how far marijuana reform has come and what still needs to be done. Northern Virginia lawyer Sameera Ali accepted an Alexandria Juvenile & Domestic Relations (JDR) Court request to represent an indigent defendant (for abysmally low pay), let the court know she was not available on the then-pending court date, got the prosecutor's office on board for seeking a very brief court date rescheduling to when Ms. Ali was available, and instead got issued a show cause notice to appear in the same court to address why she should not be held in jailable contempt of court. Once this story hit the Washington Post (with the bittersweet ending of a dismissal of Sameera's show cause case, but only after a one hour hearing), the outpouring of support for Sameera came rushing through. The show cause hearing courtroom was filled with supportive criminal defense lawyers and also included prosecutors and city attorneys. With criminal defense lawyers ready to instantly rally around their mistreated sister and brother lawyers, and with the Virginia Association of Criminal Defense Lawyers' strike force, judges, prosecutors and police should think carefully before trespassing against one of our own. On this Beat the Prosecution episode, Sameera and Erin Smith tell about the events following the unjust issuance of this show cause order against her, Erin's immediate departure from the Alexandria JDR court's indigent appointment list, and what happened at the hearing where the show cause order against Sameera got dismissed. Longtime public defender lawyer Lauren Whitley talks about the importance for lawyers to speak out about judges' wrongful actions. Sameera's law partner Jim Magner talks about the importance for people to recognize the devotion and talent that so many lawyers demonstrate in representing indigent defendants. Send us a textOne of the two founders of the Foundation for Individual Rights in Education -- Harvey Silverglate -- figured the group might no last much past ten years beyond its 1999 founding. Instead, Silverglate, describes the group -- renamed Foundation for Individual Rights and Expression  -- as having filled the gap that was left when the ACLU became more of a progressive organization and less of a free expression protector. Fairfax criminal and DUI defense lawyer Jonathan Katz first met criminal defense and civil liberties lawyer Harvey Silverglate over twenty years ago through their mutual membership in the Naitonal Association of Criminal Defense Lawyers. He met First Amendment lawyer Robert Corn-Revere -- now FIRE's chief counsel -- through their mutual membership in the First Amendment Lawyers Association, of which Bob is a past president. Both Bob and Harvey are CATO Institute scholars. Jon Katz has advised a conservative student referred by FIRE, in his campus disciplinary proceeding when his private university trampled on his right to videotape a campus speaker and university-paid public figure when no advance warning had been made against such recording activity. Jon was also referred by FIRE to advise a state university professor whose First Amendment rights were violated by being suspended from his job due to an uproar by numerous alumni and members of the public after he appeared as an unwitting hotseat guest of the O'Reilly Factor (on which show Jon has twice appeared, and also has appeared twice on the Radio Factor.) Worse, the federal government zeroed in on this professor, and dragged him through a six month trial (which Jon did not handle) that resulted in acquittal on numerous counts and a hung jury (10-2) on some additional counts.What becomes readily apparent in this Beat the Prosecution episode is that staying true to our principles helps criminal defense and civil liberties lawyers win in court. Alicia Cepeda Maule is the Innocence Project's first Digital Engagement Director. Since 2015 she led the organization in exponential audience growth, revenue, and advocacy including campaigns that helped stop the execution of Pervis Payne and Rodney Reed. Prior, Alicia worked in digital for President Obama's 2012 re-election campaign and msnbc.com. She has a B.A. in Africana Studies from Brown University. Judge Daniel Hovland of the U.S. District Court for the District of North Dakota ruled that the so-called Waters of the United States (WOTUS) rule announced by the Environmental Protection Agency (EPA) in late December poses "great" risks to states. The judge also ruled that the federal government should wait until the Supreme Court soon rules on a related case pending before it. On Dec. 30, the final working day of 2022, the EPA and the U.S. Army Corps of Engineers quietly announced they had approved the WOTUS regulation and that it would be implemented in March. After announcing it, EPA Administrator Michael Regan said the rule "safeguards our nation’s waters." The rule ultimately opens the door for the federal government to regulate wetlands, lakes, ponds, streams and "relatively permanent" waterways, largely mimicking a pre-2015 environmental rule set during the Obama administration which implemented the changes in an effort to curb water pollution. The regulation is a broad interpretation of which water sources require protection under the Clean Water Act. However, in its lawsuit filed in February, the 24-state coalition — led by West Virginia, Georgia, Iowa and North Dakota — argued the regulations were an example of federal overreach and an attack on their sovereign authority regulating bodies of water and surrounding land. A series of industry groups — including the American Farm Bureau Federation, American Petroleum Institute, National Association of Realtors, National Cattlemen’s Beef Association, National Corn Growers Association and National Mining Association — also entered the lawsuit as intervenor-plaintiffs. Meanwhile, the Senate and House both passed a bipartisan resolution earlier this year overturning the WOTUS regulation. The changes, announced on April 12, would affect virtually all gasoline-powered vehicles on U.S. highways, save consumers an estimated $12,000 in fuel and maintenance costs over the life of a vehicle, and avoid almost 10 billion tons of carbon dioxide emissions through 2055, according to the Environmental Protection Agency (EPA). The move aims to further the president’s goal of having 50 percent of all new cars and light trucks and 30 percent of new medium- and heavy-duty trucks sold in 2030 be zero-emission vehicles. Electric vehicles (EVs) are considered zero-emission vehicles. The EPA estimates that approval of these rules would result in 67 percent of new passenger vehicles and light trucks being EVs by 2032, along with 50 percent of buses, 35 percent of short-haul freight tractors, and 25 percent of long-haul freight tractors. Critics have claimed that the move, which will increase the price of new cars, was made without consideration of the ability of the nation’s supply chain to meet the demand. The Biden administration has spent roughly $31 billion on the development of so-called clean transportation over the past two years, including the development of a network of EV charging stations, improving the supply chain for materials needed to produce EV batteries, and making loans to companies that manufacture EVs and EV components in the United States. General Motors, Ford, and Stellantis—the maker of Chrysler, Fiat, Ram, and Jeep brands—stated in 2021 that they would aim to reach EV sales of at least 40 percent of all their new vehicle sales by 2030. The rule change comes 10 months after six major automakers pledged to stop selling gas and diesel-powered cars worldwide by 2040. The data figures come as Republicans and Democrats approach a deadline to raise the debt ceiling or face defaulting on the national debt, an unprecedented event that would have huge ramifications for the U.S. and global economy. Republicans have pointed to those figures as proof of the need for spending cuts. President Joe Biden, though, has shown no interest in negotiating. Democrats argue the fiscal deadline is too risky to play with in negotiations. The CRFB said if nothing changes, the annual deficit will hit $3 trillion by the end of this decade. For decades, the U.S. Supreme Court and Florida Supreme Court rulings have prohibited the execution of child rapists and sexual abuse cases. The last time someone was executed for a non-murder offense in the U.S. was 1964, according to a Senate staff analysis. However, the House and Senate bills argue that a Florida Supreme Court case in1981 and a U.S. Supreme Court case in 2008 were both “wrongly decided.” The Senate version declared the cases represent an “egregious infringement of the state’s power to punish the most heinous of crimes.” The bill’s sponsor, former prosecutor turned Republican state senator Jonathan Martin, said the legislation would allow for “constitutional boundaries by providing a sentencing procedure for those heinous crimes.” “If an individual rapes an 11-year-old, a 10-year-old, a 2-year-old or a 5-year-old, they should be subject to the death penalty,” Martin said Tuesday. As Red State reports: The legislation inevitably has drawn criticism, with Aaron Wyat of the Florida Association of Criminal Defense Lawyers pointing out that although people want “vengeance” against pedophiles, the death penalty would represent an overturning of decades of legal precedent. “This bill invites a longer, costlier (legal) process for the victim and their family that they will endure,” Wayt said. “While this crime, anyone convicted of it is vile, heinous, the Constitution itself, the case law, the Supreme Court demands a maximum of life in prison. And so while it’s not the vengeance we all want, it’s the justice that the Constitution demands,” Wayt added. Meanwhile, left-leaning Slate Magazine argued a “sentence of life without parole is a harsh and severe punishment,” even for pedophiles. Despite the media pushback, the bill has attracted support from some Democrats, including Senate Minority Leader Lauren Book, who suffered sexual abuse as a child and founded the advocacy organization Lauren’s Kids. Gov. Ron DeSantis is expected to sign off on this legislation after voicing support for the death penalty for pedophiles. https://www.foxnews.com/politics/trump-sues-michael-cohen-for-500-million Trump sues former attorney Michael Cohen for $500 million Former President Donald Trump is suing his ex-lawyer Michael Cohen for more than $500 million, alleging a breach of his attorney-client relationship, unjust enrichment, and more, Fox News Digital has learned. Trump’s legal team filed the more-than 30-page federal lawsuit in U.S. District Court for the Southern District of Florida on Wednesday. The lawsuit alleges Cohen breached his attorney-client relationship by "spreading falsehoods" about Trump that were "likely to be embarrassing or detrimental, and partook in other misconduct," while also breaching contractual terms of a confidentiality agreement he signed as a condition of employment with Trump. The lawsuit alleges Cohen spread falsehoods about Trump "with malicious intent and to wholly self-serving ends." The lawsuit details Cohen’s "myriad of public statements, including the publication of two books, a podcast series, and innumerable mainstream media appearances," while ignoring "cease and desist" orders. It claims Cohen has, in recent months, "increased the frequency and hostility of the illicit acts" and "appears to have become emboldened and repeatedly continues to make wrongful and false statements" about Trump through various platforms. The lawsuit comes a week after the former president pleaded not guilty in Manhattan court to 34 felony counts of falsifying business records in New York, related to alleged hush money payments made ahead of the 2016 presidential election. https://www.breitbart.com/sports/2023/04/11/nc-state-senator-moves-to-ban-participation-trophies/ NC State Senator Moves to Ban Participation Trophies Coffee is for closers, and if a state senator in North Carolina has his way, trophies at state-sponsored events will be for winners and winners only. North Carolina State Senator Timothy Moffitt (R) introduced the “Eliminate Participation Trophies Act” on Thursday, known in the legislature as SB 430. If passed, the bill would ban the awarding of trophies to children at state-sponsored athletic events simply for participating in the event. “Youth sports or other youth recreation activities operated under the authority of a local government shall not include awards for participants based solely on their participation in the sport or other activity,” the proposed law states. “Awards provided in connection with the activity, if any, shall be based on identified performance achievements.” Moffitt and the bill’s co-sponsors, Republican Senators Bobby Hanig and Eddie Settle say the bill will apply only to state-sponsored youth events. Though, no ages are listed explicitly in the bill. Many argue that participation trophies aren’t that big of a deal. After all, awarding trophies for merely showing up tends to fade out once kids progress past pee-wees and enter the junior high ranks. However, proponents of laws such as Moffitt’s will point to things like the Colts’ 2014 AFC Finalist Banner: Clearly, the participation trophy culture has made its way past pee-wees. Is it worth passing a law? The North Carolina legislature will soon decide.

The judge also ruled that the federal government should wait until the Supreme Court soon rules on a related case pending before it. On Dec. 30, the final working day of 2022, the EPA and the U.S. Army Corps of Engineers quietly announced they had approved the WOTUS regulation and that it would be implemented in March. The changes, announced on April 12, would affect virtually all gasoline-powered vehicles on U.S. highways, save consumers an estimated $12,000 in fuel and maintenance costs over the life of a vehicle, and avoid almost 10 billion tons of carbon dioxide emissions through 2055, according to the Environmental Protection Agency (EPA). The move aims to further the president’s goal of having 50 percent of all new cars and light trucks and 30 percent of new medium- and heavy-duty trucks sold in 2030 be zero-emission vehicles. The EPA estimates that approval of these rules would result in 67 percent of new passenger vehicles and light trucks being EVs by 2032, along with 50 percent of buses, 35 percent of short-haul freight tractors, and 25 percent of long-haul freight tractors. Critics have claimed that the move, which will increase the price of new cars, was made without consideration of the ability of the nation’s supply chain to meet the demand. The Biden administration has spent roughly $31 billion on the development of so-called clean transportation over the past two years, including the development of a network of EV charging stations, improving the supply chain for materials needed to produce EV batteries, and making loans to companies that manufacture EVs and EV components in the United States. General Motors, Ford, and Stellantis—the maker of Chrysler, Fiat, Ram, and Jeep brands—stated in 2021 that they would aim to reach EV sales of at least 40 percent of all their new vehicle sales by 2030. For decades, the U.S. Supreme Court and Florida Supreme Court rulings have prohibited the execution of child rapists and sexual abuse cases. The last time someone was executed for a non-murder offense in the U.S. was 1964, according to a Senate staff analysis. However, the House and Senate bills argue that a Florida Supreme Court case in1981 and a U.S. Supreme Court case in 2008 were both “wrongly decided.” The Senate version declared the cases represent an “egregious infringement of the state’s power to punish the most heinous of crimes.” The bill’s sponsor, former prosecutor turned Republican state senator Jonathan Martin, said the legislation would allow for “constitutional boundaries by providing a sentencing procedure for those heinous crimes.” “If an individual rapes an 11-year-old, a 10-year-old, a 2-year-old or a 5-year-old, they should be subject to the death penalty,” Martin said Tuesday. As Red State reports: The legislation inevitably has drawn criticism, with Aaron Wyat of the Florida Association of Criminal Defense Lawyers pointing out that although people want “vengeance” against pedophiles, the death penalty would represent an overturning of decades of legal precedent. “This bill invites a longer, costlier (legal) process for the victim and their family that they will endure,” Wayt said. “While this crime, anyone convicted of it is vile, heinous, the Constitution itself, the case law, the Supreme Court demands a maximum of life in prison. If passed, the bill would ban the awarding of trophies to children at state-sponsored athletic events simply for participating in the event. “Youth sports or other youth recreation activities operated under the authority of a local government shall not include awards for participants based solely on their participation in the sport or other activity,” the proposed law states. “Awards provided in connection with the activity, if any, shall be based on identified performance achievements.” Moffitt and the bill’s co-sponsors, Republican Senators Bobby Hanig and Eddie Settle say the bill will apply only to state-sponsored youth events. Though, no ages are listed explicitly in the bill. Many argue that participation trophies aren’t that big of a deal. After all, awarding trophies for merely showing up tends to fade out once kids progress past pee-wees and enter the junior high ranks. However, proponents of laws such as Moffitt’s will point to things like the Colts’ 2014 AFC Finalist Banner: Clearly, the participation trophy culture has made its way past pee-wees. Is it worth passing a law? The North Carolina legislature will soon decide.

Nancy Hollander is an internationally recognized US criminal defense lawyer. She is also an Associate Tenant at London's Doughty Street Chambers and Of Counsel to the Geneva firm of Savolainen Avocats. Ms. Hollander has been admitted to practice in the US Supreme Court, and federal, state, and military courts. She was lead appellate counsel for Chelsea Manning and she won Ms. Manning's release in 2017 when President Obama commuted her sentence from 35 years to seven years. Ms. Hollander has also represented two prisoners at Guantanamo Bay Naval Base, and in 2016, she won the release of one of them – Mohamedou Ould Slahi – who had been incarcerated for 14 years without charge. His story is chronicled in his New York Times bestselling book, Guantanamo Diary, which Ms. Hollander helped facilitate and publish, and in a feature film, The Mauritanian, where she was played by Oscar-winning actress, Jodie Foster. In addition to her criminal defense practice, Ms. Hollander has been counseled in civil cases, forfeitures, and administrative hearings, and she has argued and won a historic case involving religious freedom in the US Supreme Court. Ms. Hollander has also served as a consultant to the defense in international cases. She has created and taught in hundreds of trial practice programs in the US, internationally in Russia, Sweden, the UK, Portugal, Switzerland, and France for lawyers practicing in international criminal tribunals. She has also written extensively and conducted more than 200 seminars and presentations around the globe on various subjects, including the securing of evidence in international cases, forfeiture, illegal search and seizure, expert witnesses, defense of child abuse cases, ethics, evidence, and trial practice. In 1992-93, Ms. Hollander was the first woman president of the National Association of Criminal Defense Lawyers. Ms. Hollander has also received many professional awards. In today's episode I speak with civil rights and criminal defense lawyer Kobie Flowers, who represents the wrongly accused and the wrongly convicted. He is a Partner at Brown, Goldstein & Levy in Washington, D.C. Kobie is a trial lawyer's trial lawyer. He started his career in the Attorney General's Honors Program where he worked as civil rights prosecutor at the United States Department of Justice with a focus on prosecution of police brutality. After he completed his time at DOJ, Kobie worked as an Assistant Federal Defender in Baltimore where he represented clients in a number of different substantive areas of criminal law. His practice has given him chances to litigate in state and federal courts throughout the country as well internationally at the military commission in Guantanamo Bay. He is active in the legal community including service on the boards of the National Association of Criminal Defense Lawyers and the Mid-Atlantic Innocence Project. He's taught trial skills and trial advocacy across the country in both professional and academic settings. Kobie is a graduate of Stanford University and Georgetown Law. Before attending law school he served in Peace Corps. In our discussion we discuss his path to law school after the summer of 1992 and its similarities to the summer of 2020; how starting in DOJ as a civil rights prosecutor made him a better criminal defense lawyer; the importance of learning from hard cases and why the raw number of cases you've tried is less important than how difficult they were; life as a federal defender and later criminal defense lawyer; the unique experience of the grand jury; the value of having a case theory from the very beginning of your case all the way through trial; the power of watching and learning from experienced lawyers as well as more junior lawyers (and even non-lawyers); the critical skill of storytelling as it relates to trying criminal cases; and the societal problems he sees with the disappearance of the criminal jury trial. Senate confirmation hearings begin next week for Supreme Court nominee Judge Ketanji Brown Jackson. If she is confirmed she will be the first Black woman on the high court and the first public defender. Judge Jackson served as a federal public defender between 2005 and 2007. She defended several Guantanamo detainees and others accused of crimes, a fact that her critics use to suggest that she works to free terrorists and put criminals back on the street.The 6th Amendment to the Constitution guarantees every criminal defendant the right to an attorney. The right to have effective counsel, along with presumption of innocence are the basic principles of fairness in our legal system. But too often, having worked as a defense attorney is a stop sign on the road to the bench.We speak with Martin Sabelli, president of the board of directors of the National Association of Criminal Defense Lawyers.
