Hoewel er in de jaren negentig nog hoop bestond voor een vanzelfsprekende groei van democratische en vrije regeringen, stelt Freedom House in hun rapport van 2024 dat dit het 18e jaar op rij is waarin vrijheid en democratie zijn afgezwakte. Hoewel 2024 een recordjaar is wat betreft de hoeveelheid stemmers over de hele wereld, maar worden veel van deze verkiezingen “schijnverkiezingen” genoemd. Autoritaire regimes worden sterker en werken meer samen, en democratische waarden worden uitgehold in landen over de hele wereld, zoals de VS, Hongarije, India en Argentinië. In veel landen woedt er een strijd om democratische rechten, ook als overheden strenger optreden tegen protesten. Rusland is een belangrijk voorbeeld van een staat waarin vrijheden steeds verder worden ingeperkt. De uitholling van onafhankelijke verslaggeving, de onderdrukking van kritiek op de oorlog en de grote hoeveelheid staatspropaganda zijn hier voorbeelden van. Das Gemälde „Kalabrische Küste“ von Andreas Achenbach steht in der Lost Art-Datenbank als potentielle NS-Raubkunst. 1937 hatte es der jüdische Kunsthändler Max Stern an eine Privatperson in Essen verkauft, weil er seine Düsseldorfer Galerie auf Druck der Nazis aufgeben musste und nach Kanada auswanderte. Der Kläger erwarb das Bild 1999 im Rahmen einer Auktion in London. Nun klagt er vor dem BGH, denn er habe es damals in gutem Glauben erworben und wolle nicht, dass der Marktwert des Gemäldes durch den Eintrag als potenzielle NS-Raubkunst geschmälert wird. „Ich denke, dass das Urteil des Bundesgerichtshofs nicht ganz eindeutig vorherzusehen ist", sagt Kunsthistorikerin Jasmin Hartmann, Leiterin der Koordinierungsstelle Provenienzforschung NRW, „für die Provenienzforschung die Liste „Lost Art“ immer noch einer der wichtigsten Ausgangszellen ist, um Raubgut zu finden und aufzuklären.“ Und jeder Eintrag sei potenziell wichtig. „Und das wäre natürlich total misslich, wenn Einträge von Werken, die sich im Privatbesitz zu finden, ohne weitere Begründung jetzt oder zukünftig ausgetragen werden könnten.“ Jetzt sei der Gesetzgeber in der Pflicht, eine rechtsstaatliche, tragfähige Lösung für alle zu schaffen.

Nearly 90 years after Nazi Germany stripped art dealer Max Stern of his gallery in Dusseldorf and forced the German Jew to liquidate his large art collection to non-Jews, Stern's heirs have agreed to sell one of the stolen paintings back to the City of Dusseldorf. The painting is called “Portrait of the Artist's Children” (1860) by Dutch master Wilhelm von Schadow. It's actually been hanging in the Dusseldorf mayor's office for half a century. For years, Max Stern's heirs have been tracking it down, as one of nearly 400 of his wartime paintings–worth an estimated $50 million today–that disappeared into the Nazi coffers in 1937, before Stern himself fled his native city for London. Eventually, Stern arrived in Canada as a refugee in 1941, and established a storied career as a prominent art dealer, promoting such Canadian artists as the Group of Seven and Emily Carr. After he died childless in 1987, Stern's estate went to Concordia University, McGill and Hebrew University, which have been funding the Max Stern Art Restitution Project for about 20 years. The story of how this latest Dusseldorf deal was done, and why Germany gets to keep the painting, has been fraught with controversy. On this week's episode of Cleveland Scene Podcast No Sleep in the CLE, Chucklefck's Ramon Rivas and Cellar Door's Justin Markert talk to Max Stern, singer/guitarist from the band Signals Midwest. Max is a very busy guy, in 2014 alone he clocked over 140 shows on three continents in 13 countries. They talk about influence, how Cleveland's music scene holds up to other cities and our failed and/realized 2014 resolutions and plans for 2015.   Signals Midwest will perform on Saturday January 3 at the Grog Shop as part of their annual free weekend. Other bands performing that night are Light Years, So Long Albatross, Worship This!, and Runaway Brother. Show is at 9 and is, well, free.
