Ep 475 - Rent Control: A Blunt Tool Guest: David Hutniak By Stuart McNish Housing affordability is a North American-wide issue. In the U.S., only seven states and Washington, D.C. have imposed rent controls as a measure to address housing affordability. Only seven states – largely because it is believed they don't work. In a poll conducted by the American Economic Association, 93% of its members agreed that a ceiling on rent controls reduces the quality and quantity of housing. David Hutniak, the CEO of Landlord B.C., in a recent letter to Premier Eby, said, “Rent control is a flagship political tool and a promise that is far more complex than it first appears. It is not the comprehensive form of tenant protection it is billed to be. It is commonly accepted that rent controls benefit current tenants. It does so at the expense of future ones.” Hutniak further pointed out that rent control is a blunt tool that continually delivers negative blows to the British Columbian rental housing market. Tenants and landlords both want a balanced rental market. Hutniak adds, “When the provincial government continues to penalize landlords for a problem created by all three levels of government, landlords and developers are less inclined to grow their businesses [and] less likely to build new rental housing.” The result is a reduction in the supply of housing. RELEASE Groups announce Feb. 25 rally at provincial legislature, issue declaration calling on the province to accelerate action for threatened forests UNCEDED LEKWUNGEN TERRITORIES/VICTORIA – 168 organizations across British Columbia have issued a declaration called United We Stand for Old-Growth Forests, calling on Premier David Eby and his government to fulfill their commitments on old-growth. Signatories of the declaration, including the Union of B.C. Indian Chiefs, the Climate Caucus network of municipal elected leaders, and B.C. General Employees Union (BCGEU), are urging Eby to follow through on his October 2022 promise to “accelerate” action to protect old-growth forests within 100 days, and implement a paradigm shift in forest stewardship to safeguard biodiversity. The organizers announced plans for a mass mobilization to hold the province accountable, with a march and rally scheduled for February 25, Eby's 100th day. “The government's continued negligence and stonewalling on truly protecting old-growth and elder trees is endemic in its approach to climate change and the stewardship of our environment,” said Grand Chief Stewart Phillip, President of the Union of B.C. Indian Chiefs. “This feigned ignorance of what is happening to our forests by government and industry will be our downfall, and the impacts of this inaction will prevent us from leaving our future generations with a rich legacy of vibrant, healthy and productive forest lands.” Phillip added. “We must do everything in our power to protect these ancient giants and we cannot stop putting pressure on our governments to do their jobs: to protect us and the environment, not act as timber barons whose only concern is this year's financial statements.” Despite promising to implement all 14 recommendations from the Old Growth Strategic Review (OGSR) in 2020, the B.C. government has permitted the destruction of thousands of hectares of the most at-risk old-growth stands in the province. The 2020 recommendations were tied to a three-year framework with the goal to have all implemented in 2023 — to date, not a single recommendation has been fulfilled. Premier Eby pledged to accelerate action upon becoming leader of the B.C. NDP, and called on Water, Land and Resource Stewardship Minister Nathan Cullen to “begin implementation of recommendations of the Old Growth Strategic Review” in his mandate letter. However, the most at-risk old-growth forests are still being clearcut while B.C. stalls on enforcing logging deferrals. The deferrals are the bare minimum and most urgent recommendation of the 2020 OGSR. “We must continue to hold our governments accountable for their contributions to the climate crisis that we are suffering through, and this environmental negligence and corporate greed must be stopped,” said Kukpi7 Judy Wilson, Secretary-Treasurer of the Union of B.C. Indian Chiefs. “Our future generations are dependent on the actions we take today, and we are at a critical point in time for direct action to protect forest ecosystems. For too long we have allowed governments to tear down our ancient elders, who are our relatives, but no more. We are standing up to protect them.” Protecting the last stands of old-growth is as much an issue for human rights, labour, education, and healthcare as it is for environmental groups. Organizers say this is a movement for all people, which is reflected in the list of declaration signatories, and are inviting all individuals and groups to participate in the United for Old-Growth march and rally at the B.C. Legislature on February 25. The signatories are calling on the province to align all forest management with the principles of free, prior and informed consent for First Nations. The declaration draws on the Union of B.C. Indian Chiefs Resolution 2022-32, affirmed by Chiefs in June 2022,

This week on Legally Speaking with Michael Mulligan:In response to political pressure resulting from public disorder and random assaults of strangers, BC Premier Eby announced several policy changes, including some amendments to the Crown Counsel Policy Manual concerning bail.Much of the social disorder and irrational, random assaults of strangers in urban centres are rooted in the increase in homeless people suffering from mental illness and drug addiction. In 2012, after many years of downsizing, a large mental hospital called Riverview was closed. It was decided that it would be more humane to treat people suffering from mental illnesses in the community rather than in an institutional setting. Unfortunately, adequate community treatment for mental illness was never provided. As a result, many hundreds of people suffering from profound mental illnesses are now left homeless and untreated. At its peak, in the 1950s, more than 4,500 patients lived at Riverview hospital. Some of the policies announced by Premier Eby are likely to be helpful. One announcement was for additional funding to create more secure hospital spaces for people who are determined to be mentally ill, in need of treatment, and who are a danger to themselves or others. Unfortunately, to blunt political claims that the social disorder and random attacks on strangers are the results of failing to seek the detention of people once there are arrested and charged with a criminal offence, changes to the Crown Counsel Policy Manual were also announced. The Crown Counsel Policy Manual is intended to provide direction to Crown Counsel to ensure consistent principled decision-making when conducting criminal prosecutions.The changes were intended to make the relevant policies sound tougher. Unfortunately, many of the changes imply that Crown Counsel was not considering relevant things when making decisions on bail. That has not been the case. In addition, to the extent that the changes create the impression with the judiciary that when Crown Counsel is seeking someone's detention, it is being done for political reasons rather than because of a reasoned conclusion that detention is appropriate, the changes to the policy may undermine the seriousness with which such submissions are received. Also, on the show, two new pieces of legislation intended to address a housing shortage are discussed. Bill 44, the Building and Strata Statutes Amendment Act, 2022, will eliminate the ability of strata corporations to restrict the rental of strata units. It will also eliminate all age restrictions for strata properties, except for 55+ buildings. The changes intend to increase the number of available rental units. For people who own strata units they do not occupy themselves, the elimination of all rental restrictions will subject owners to an extra “vacancy tax” if the units are not rented. Before the legislation, owners could avoid the vacancy tax if they were not permitted to rent units due to strata rental restrictions. Bill 43 – the Housing Supply Act, will permit the provincial government to set targets for municipalities to permit more housing to be constructed. If targets are not being met, the legislation permits municipal records to be examined and, ultimately, the provincial government to amend zoning bylaws and issue construction permits. Since then, 4,601 health-services workers have returned to the public system, resulting in more stable, consistent and supportive patient care for people throughout the province.“The people who clean our hospitals and care homes, provide food and care to our loved ones, deserve to be treated like the valued members of the public health team that they are,” said Premier Eby. “This anniversary is an important milestone in the work started by John Horgan and Adrian Dix to reverse the failed privatization policies of the past, deliver fairness to workers, and better care for people. To all those coming back to the public sector, I say: Welcome home.” The change comes after almost 20 years of these workers having their services contracted out to private companies. This paved the way for years of contracting out, contract flipping and layoffs that saw 9,000 people, mostly women, lose jobs and benefits.
