Un nuevo choque entre el ministro de Justicia, Félix Bolaños, y la diputada del PP Cayetana Álvarez de Toledo ha puesto en evidencia el error conceptual del ministro respecto a la estructura jurídica del Estado. Bolaños afirmó que el Tribunal Constitucional (TC) forma parte del Poder Judicial, lo que llevó a la diputada del Partido Popular a corregirlo con perplejidad. De acuerdo con la Constitución Española, el TC es un órgano independiente encargado de velar por la constitucionalidad de las normas y no pertenece al Poder Judicial, que está regulado en un título diferente de la Carta Magna. Esta distinción es fundamental, ya que el TC no está compuesto exclusivamente por jueces, sino también por juristas de reconocida competencia, como magistrados, fiscales, profesores de universidad y abogados con más de quince años de experiencia.La juez busca más cargos implicados en el enchufe "inmediato y urgente" del asesor de Sánchez y amigo del "hermanísimo"Carlos Cuesta El artículo 117 de la Constitución establece que la Justicia es administrada por jueces y magistrados pertenecientes al Poder Judicial, mientras que el artículo 159, que regula el Tribunal Constitucional, no emplea la palabra "jueces" para referirse a sus miembros. Este matiz es clave para entender la naturaleza del TC, que no actúa como una instancia superior de casación sobre el Tribunal Supremo, sino que tiene la función específica de interpretar la Constitución y garantizar su cumplimiento. Sin embargo, la confusión de Bolaños puede responder a una estrategia política más que a un simple desconocimiento, intentando dotar al TC de competencias que no le corresponden. La composición del TC ha sido objeto de debate en los últimos años debido a la designación de miembros afines al Gobierno. Algunos de los magistrados actuales, como Laura Díez, María Luisa Balaguer y Enrique Arnaldo, no provienen de la carrera judicial, lo que refuerza la idea de que el Constitucional no es un órgano judicial en sentido estricto. Esta situación ha generado críticas sobre la posible politización del TC, especialmente en relación a las decisiones que afectan al Ejecutivo y a la oposición. Por otro lado, el caso del abogado Luis José Sáenz de Tejada añade un nuevo elemento a la polémica. Expulsado de la carrera judicial tras una condena por violencia de género, ahora ejerce como defensor del hermano de Pedro Sánchez en un caso de presunta corrupción.
