Money will fund five new positions Rep. Pat Ryan joined with the Dutchess County executive, district attorney and sheriff on Wednesday (Oct. 16) in Poughkeepsie to announce just over $3 million in federal funding that will allow the D.A. to create five new positions. According to the county, $1 million of the grant will support a collaboration between the D.A. and the Department of Justice's Matthew Shepard and James Byrd Jr. Hate Crimes Program. The district attorney's office will create two positions - a hate crimes analyst and an assistant district attorney - to address bias-related crimes, including those committed online. Another $500,000 will expand investigations and prosecutions of cases involving domestic violence, dating violence, sexual assault and/or stalking. Finally, $1.5 million will bolster the DNA testing of evidence, including post-conviction, by expanding the county's Conviction Integrity Unit with the new positions of unit chief, assistant district attorney and full-time investigator.
Dennis and Judy Shepard's gay son Matthew Shepard was murdered in October 1998. The 21-year-old University of Wyoming student's death remains one of America's most high-profile cases of hate crime against an LGBTQI+ person. The grieving Shepards created a foundation in his name, and led the fight to pass the Matthew Shepard and James Byrd Jr. Act, to help the federal government track and prosecute LGBTQI+ hate crimes. Dennis and Judy have been visiting New Zealand speaking at a range of events, including with NZ Police, to highlight LGBTQI+ security concerns and share their story.

The U.S. Justice Department has announced its intent to seek the death penalty for Payton Gendron, the individual responsible for a racially motivated shooting that claimed the lives of 10 people at a Tops Supermarket in Buffalo, New York, in May 2022. This decision marks a significant development in a case that has gripped the nation. Federal prosecutors filed a court document outlining their rationale for pursuing the death penalty, stating, "United States believes the circumstances in Counts 11-20 of the Indictment are such that, in the event of a conviction, a sentence of death is justified." Gendron had previously signaled a willingness to plead guilty to federal charges if the death penalty were off the table. The indictment against Gendron included 27 counts, with 14 violations of the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act, encompassing hate crimes resulting in death, attempts to kill injured individuals, and attempted killings of additional Black individuals in and around the supermarket. In addition to these hate crime charges, Gendron faced 13 firearms offenses. The motivations behind the attack were deeply rooted in racist ideology, as Gendron subscribed to a far-right conspiracy known as replacement theory. His goal was to "inspire others to commit similar attacks," as stated in a criminal complaint. The rifle used in the shooting bore markings with phrases such as "here's your reparations" and "the great replacement." The decision to seek the death penalty by the Justice Department follows over a year of deliberations. Attorney General Merrick Garland had previously expressed concerns about the death penalty, and President Joe Biden had campaigned on abolishing it at the federal level. However, in the absence of a formal policy, the DOJ had engaged in discussions regarding a "worst-of-the-worst" threshold for cases involving extreme acts of hate-fueled violence. In response to the DOJ's announcement, the defense team expressed deep disappointment. Sonya Zoghlin, an assistant federal defender, conveyed their frustration, suggesting that the government's efforts could be better spent addressing the underlying issues that facilitated the crime, including easy access to deadly weapons and the failure of social media companies to moderate hateful rhetoric online. Gendron had previously faced sentencing on state charges, resulting in a life imprisonment without parole sentence in February 2023. During that sentencing hearing, Gendron briefly offered an apology, acknowledging his actions and the pain he caused. He pleaded guilty to 15 charges, including domestic terrorism motivated by hate, murder, and attempted murder. While the pursuit of the death penalty has been met with mixed reactions, some family members of the victims welcomed the decision. Mark Talley, the son of shooting victim Geraldine Talley, expressed his desire to see Gendron suffer and stated, "As long as I'm alive, I wanna be able to see him suffer." Others in the community echoed the sentiment that the death penalty should serve as a deterrent against such heinous crimes. Buffalo Mayor Byron Brown and New York Gov. Kathy Hochul also expressed support for the DOJ's decision, highlighting the gravity of the attack and its impact on the community. The next court date in the case is scheduled for February 2, where the legal proceedings will continue to unfold. Want to listen to ALL of our podcasts AD-FREE? This week, we turn to the sobering and disturbing topic of hate crimes. Whether a gas station owner planting flowers in Arizona, a young man celebrating his bachelor party in Michigan, or a devoted father just looking for a ride home in Texas, it feels like hate-filled monsters can enact barbaric violence on innocent people at any time. Because white supremacy and homophobia run rampant in this country, and these types of horrific violent crimes are still all too prevalent, it's all the more important to keep talking about these victims and their stories.Cases Covered:1. It's a freestyle... with a slight theme. We know... no themes on freestyle day. But, you know what? We do what we wanna do! ...please enjoy. Pam: It was the year 1998 and James Byrd Jr was walking home from a party late one night when he was offered a ride home from some "good ole boys". And well, things went horribly wrong. Sadly, these are injustices that many minorities fear could happen to them on a daily basis and while we may have come a long way in the 25 years since this tragic hate crime was committed- we, unfortunately, still have a long way to go as a society. We discuss the unfortunate case of James Byrd Jr., and the history of the box office.
TW: The details of this murder are very graphic and disturbing. On June 7, 1998, a 49-year-old African American man was brutally tortured and murdered in one of the most horrific racially motivated hate crimes the country has ever seen. The man, James Byrd Jr was dragged to his death after being chained by the ankles to the back of a pickup truck by three white men John William King, Lawrence Russell Brewer, and Shawn Allen Berry. This episode covers more history on lynching in the U.S. and a case that hit me hard. James Byrd Jr. (Pictured below) was murdered on June 7th, 1998. This murder stuck out to me as especially cruel in its trickery. As difficult as it is to face the fact of lynching in this country, it is so important to continue to educate ourselves. This will not be the last part in the series. Pictured::: James Byrd Jr. MISSING::: LATISHA BILL, 13 years old, was reported missing on 03/28/22. Best-Selling Author & Distinguished Carter G. Woodson book award presented to exemplary books written for children and young people each year at the NCSS Annual Conference.Robert H. Mayer is the award-winning author of When the Children Marched: The Birmingham Civil Rights Movement and the editor of The Civil Rights Act of 1964. As a teacher, Mayer's passion continues to be making history relevant and accessible to young people. His time spent in Jackson, Canton, and McComb, Mississippi, as well as meeting scholars and activists integral to the civil rights movement, fueled the desire to write In the Name of Emmett Till. He lives in Bethlehem, Pennsylvania, with his wife Jan, where he writes, teaches, and tutors youth in a local middle school. The Emmett Till Antilynching Act is a United States federal law which makes lynching a federal hate crime. The act amends the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act and prior hate crime laws to define lynching as any conspired bias-motivated offense which results in death or serious bodily injury. It was passed by the U.S House of Representatives on February 28, 2022, and U.S. Senate on March 7, 2022, and signed into law on March 29, 2022, by President Joe Biden. The 1955 murder of Emmett Till in Mississippi is widely remembered as one of the most horrible lynching's in American history. African American children old enough that year to be aware personally felt the terror of Till's murder. These children, however, would rise up against the culture that made Till's death possible. Over the next decade, from the violent Woolworth's lunch-counter sit-ins in Jackson to the school walkouts of McComb, the young people of Mississippi picketed, boycotted, organized, spoke out, and marched, determined to reveal the vulnerability of black bodies and the ugly nature of the world they lived in. These children changed that world. © 2022 Building Abundant Success!!2022 All Rights ReservedJoin Me on ~ iHeart Radio @ https://tinyurl.com/iHeartBASSpot Me on Spotify: https://tinyurl.com/yxuy23baAmazon ~ https://tinyurl.com/AmzBAS

In 1998 Matthew Shepard, becomes the victim of radical homophobia in Wyoming. Two suspects, Aaron McKinney and Russell Henderson are almost immediately taken into custody and charged. The “gay panic” defense is used in court. But, does it work?Shepard becomes the poster boy for the horrific consequences of anti-gay hate, and his case helps to re-define hate crimes in the US. Celebrities get involved, marches are held, and a decade later, in 2009, the United States Congress passes the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act.In this episode Sofie Hagen and Dr Julia Shaw discuss research on the seven shades of homophobia, what defines a hate crime, and explain the flawed logic behind the “gay panic” defense, also called the LGBTQ+ panic defense.Warning: This episode contains graphic descriptions of violence and homophobia, including homophobic slurs.CREDITS Presenters: Dr Julia Shaw and Sofie Hagen Producer: Caroline Steel Assistant Producer: Simona Rata Music: Matt Chandler Editor: Rami Tzabar Academic Consultants for The Open University: Lara Frumkin and James Munro #BadPeople_BBC Commissioning Assistant Producer: Adam Eland Commissioning Executive: Dylan HaskinsBad People is produced in partnership with The Open University and is a BBC Audio Science Production for BBC Sounds.

For our second pride month episode, Erika wanted to touch on two cases from 1998 that expanded hate crime laws to further protect people of any race, religion, ethnicity, gender, sexuality, gender identity, or disability. Matthew Shepard was a 21-year-old student at The University of Wyoming who was beaten and left to die by two men pretending to be gay. In the same year, 49-year-old James Byrd Jr. suffered a brutal, unfathomable death at the hands of two members of the KKK and an accomplice. After many years, the stories of these two men helped to create The Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act.
