I wanted to talk to a lawyer 'cause, yeah, lawyers are the ones that see stuff that falls the whole way down to the level of legal action. But I wanted to find out what are the main categories of things that wind up in legal land when it comes to broker or EBC (employee benefit consultant) payment agreements. And let me just state for the record that, while there are a whole lot of brokers and EBCs who would or do engage in some of these practices, there are also many who do not; and/or it might not be the broker/EBC themselves but the company that they work for who is up to some of the things that we're gonna be talking about in the episode today. But I really, for sure, want to support the gang of honest actors, great fee-based, integrity-based brokers and EBCs; and I wanna support them all day long, many of whom listen to the show and are part of the Relentless Health Value Tribe. But let's talk about how the rent-seeking ones roll so that you can spot them. See what they did there. So, yeah … the first kind of ground zero that Doug and I talk about today is just up-front direct compensation agreements, which may be just ridiculously complicated and/or ridiculously expensive compared to what others are charging for a similar group. Where there's mystery, there is margin. That is so relevant in so many situations, and this is just another one of them. So then, after that, Doug and I move on; and we get into three categories of stuff that sits in that undisclosed or maybe even disclosed zone, where just the whole model of payments is problematic on its face. First up (and this is a biggie), brokers/EBCs recommending rent-seeking solutions to their clients. Like, a broker or EBC suggests a solution to their client where the solution itself makes money on a perverse incentive, and then the broker or EBC gets a piece of that action, which might be called shared savings. So, yeah … even if the dollars to the broker or EBC are disclosed, a naive plan administrator might not see that overcharge for what it really is—and Doug gives a bunch of examples in the show that follows. Chris Deacon (post) and Justin Leader (post) also wrote posts about this. Donovan Pyle wrote a whole book about it. Okay … the next big category of typical payment model methodologies that Doug Aldeen (again, a lawyer) has seen plans get themselves into trouble with their EBCs and brokers—the ones who are sharks, I mean, circling the plan like it's a gold mine—this big category is undisclosed payments from vendors who the plan doesn't realize have a business relationship with the EBC or broker. This can also be a whole basket of solutions that the EBC/broker wants to install, which is basically this problematic payment model at scale. And, right, this matters because then the plan doesn't know if this particular point solution, PBM, stop-loss carrier … Right? They think their broker EBC is recommending it because it's the best option for that particular plan, not understanding that it's the right option for the broker or EBC. And these dollars can be undisclosed because, to a certain extent, the Consolidated Appropriations Act, it's a little bit unclear on certain points. There's some loopholes if you go looking for them because you are so inclined. We get into more detail on this later on. After this, Doug offers a really great roadmap with six steps in it for any plan to really think about as they consider. First, the maybe integrity of their broker or EBC and what is being recommended to the plan. And that's important because, look—and we say this in the conversation that follows, but I'm gonna say it again here loudly—if a plan realizes that their broker or EBC is not really serving the best interest of the plan, there are great options out there. There are great EBCs and brokers who are honest, upstanding that really care about their clients, their plans, their members, and doing the right thing. But telling the difference between the not-so-good ones and the good ones takes some diligence, takes some validation on the part of the plan sponsor. It just does. But the amount of dollars that can be saved is millions, and this is actually, saving those millions is actually better for the plan because it's not like those dollars were going in somebody's pocket. It's not like they were being put toward better, safer, lower premiums. These are dollars that can be cut, and the plan is actually better. My guest today, as I have mentioned at least several times already, is Doug Aldeen, who is a well-known attorney who has spent many years in the self-insured space. From 1997 to 2006, he served both as associate general counsel and general counsel for provider-sponsored HMOs in Champaign-Urbana, Illinois, and San Antonio, Texas. During his tenure at Health Alliance Medical Plans in Urbana, Illinois, he had a front-row seat to the US Supreme Court ERISA case in Pegram v. Herdrich. Since 2007, Doug has owned and operated his own law firm that serves the US self-funded market. In the span of three months in 1976, three young East Austin women vanished. (Adam@TheWorldview.com) By Adam McManus Ugandan Muslims kill grandmother, 2 grandkids on Christmas On Christmas Day, Islamic extremists in western Uganda killed a 75-year-old woman and her two grandchildren, reports Morning Star News. The bodies of Edrine Ngwabize and her two grandchildren, 5-year-old Emoni and 13-year-old Mathias, were found inside their home in the Kamwenge District after the Muslims broke in. Edrine's son, Wilson said, “The attackers were shouting the Muslim slogan, ‘Allah Akbar' [God is greater] and saying, ‘We have to teach these infidels a lesson during this Christmas celebration.'” He saw the assailants first set ablaze the farm of a church pastor that is 500 meters from his mother's home at about 7:00 p.m. He rushed to warn his mother and the two children, one of them his own, to take cover. Then he returned to hide his wife, who was ill, in a safe place. He said, “On coming back to pick up my mother and the children, I found the Muslim terrorists were already at my mother's house, and there was a loud bang [from gunshot] … which was so frightening.” He rushed to a nearby police station, and officers shot dead the leader of the assailants, Musa Kamusi, as he was fleeing near the house. The assailants also slaughtered five goats and took some food from the home of the deceased. While Muslims make up no more than 12 percent of Uganda's population, they live in high concentrations in the East. The biggest names from Jeffrey Epstein's unsealed court documents The names of acquaintances and associates of the late Jeffrey Epstein, a wealthy man who sexually trafficked minors, were released on Wednesday evening in a set of court documents that were part of a suit against Ghislaine Maxwell in 2015, reports Time Magazine. The documents, the first in more than 200 that are expected to be unsealed over the next week, are part of the defamation lawsuit filed by victim Virginia Roberts Giuffre. Names of figures that were previously associated with Epstein, such as Prince Andrew and former presidents Donald Trump and Bill Clinton, were mentioned in the court documents.  New names include the late Marvin Minsky, a former MIT professor, Hedge billionaire fund manager Glenn Dubin, Leslie Wexner, the billionaire founder of Victoria's Secret and Bath & Body Works, the late New Mexico Governor Bill Richardson, and Alan Dershowitz, Epstein's former attorney. Connections to Epstein previously led high-level executives to resign from their positions, like Barclays chief executive Jes Staley. In addition, Jean-Luc Brunel, a French modeling agent suspected of scouting girls for Epstein, killed himself in a Paris jail in 2022 while awaiting trial for rape accusations. Mark asserts that his brother did not commit suicide, but was murdered by the U.S. government. Texas Board of Ed. protects children from sexually explicit books On December 13th, the Texas State Board of Education voted to approve new guidelines to reassert parental rights and prohibit “harmful” books in school libraries, reports LifeSiteNews.com. They voted 13-1 in favor of a new set of guidelines to ensure school children are protected from offensive content. The move comes after Texas Republican Governor Greg Abbott earlier this year signed into law a new bill, authored by Plano Republican Rep. Jared Patterson, requiring book sellers to rate books for appropriateness, reports KXAN. The seduction and damage of sexually explicit content is comparable to the Proverbs 7:21-23 description of the adulteress who seduces a man.  It says, “With persuasive words, she led him astray; she seduced him with her smooth talk. All at once, he followed her like an ox going to the slaughter, like a deer stepping into a noose till an arrow pierces his liver, like a bird darting into a snare, little knowing it will cost him his life.” The Texas set of guidelines further calls on Lone Star State schools to “recognize that obscene content is not protected by the First Amendment to the United States Constitution.” Republican State Rep. Brian Harrison argued that the American Library Association “works against parents by fighting to keep pornographic materials in public libraries under the guise of opposing ‘censorship.'”  Pastor slams “Americanized lukewarm church-going Christianity” And finally, at a time when it's increasingly unpopular to believe that salvation is only attained through faith in Jesus Christ, Jonathan Pokluda slammed “Americanized lukewarm church-going Christianity” and stressed that lasting truth and life is found in “no other thing or no other person than Jesus Christ,” reports the Christian Post. In a message delivered to thousands of young people gathered in Atlanta, Georgia, for Passion 2024, Pokluda cited statistics from USA Today revealing that 70% of all major Christian and non-Christian religious groups say many religions can lead to eternal life. He said, “And we might reject this in belief; maybe you hear that, [you think], ‘No, that's not true.' But we accept it in practice because we're not bothered by someone not believing in Jesus. We sleep fine. We ride elevators and walk through hallways with people who are going to Hell, and we're OK. It doesn't seem like we believe that Jesus Christ is the only way. … If you're here and you're a believer, I want to teach you how to address things like, ‘All religions lead to God,' or ‘I'm glad that's your truth.' Or, ‘I'll live my life and get right with God later before I die; I'll figure out the Jesus thing.'” Pokluda, pastor of Harris Creek Baptist Church in Waco, Texas and author of Why Do I Do What I Don't Want to Do?: Replace Deadly Vices with Life-Giving Virtues, tackled the idea of truth, emphasizing that Jesus is not just historically true, but the embodiment of Truth itself. He stressed the importance of recognizing absolute truths, regardless of personal beliefs or feelings. In John 14:6, Pokluda noted that “Jesus says, ‘I'm the way to God. There's no other way to God; I'm the only way to God.' And you probably have heard, ‘Well wait, I think there are many ways to God,' or ‘All religions will lead to God,' or ‘Don't all religions actually teach the same thing?' “That's a statement of ignorance. According to KXAN, Shane James, 34, is the suspect in a series of shootings that killed six people and wounded three others in Austin, according to Austin Police. He was arrested early Wednesday morning and charged with capital murder of multiple people, Travis County Jail records show. In a major blow to Governor Greg Abbott, the Texas House of Representatives voted 86-52 in favor of an amendment to bar state funds from being used for private school vouchers, according to KXAN. This was achieved through a coalition of Democrats and rural Republicans in the Lone Star State, per NBC.2. The Washington Post reports that greater numbers of assisted-living facilities are rejecting Medicaid and evicting seniors from their homes. One particularly harrowing story involves Shirley Holtz, a 91 year old with mobility issues and dementia who was evicted from her hospice care because the facility decided to refuse Medicaid payments.3. In a statement responding to the ProPublica report on undisclosed gifts received by Supreme Court Justice Clarence Thomas, Senate Judiciary Committee Chair Dick Durbin stressed that “Supreme Court Justices must be held to an enforceable code of conduct, just like every other federal judge. The ProPublica report is a call to action, and the Senate Judiciary Committee will act.” However, the Judiciary Committee has been hamstrung by Democratic absences, particularly that of California Senator Dianne Feinstein, who has missed nearly 60 votes since February, according to The San Francisco Chronice.4. Barak Ravid reports that the U.S. has blocked the release of a planned United Nations Security Council statement decrying the Israeli police raid at the al-Aqsa mosque, one of the holiest sites in Islam, during Ramadan.5. More Perfect Union has issued a statement saying “Months after 440 Planned Parenthood nurses and staff in five Midwest states voted to unionize, management has fired 2 members of the union's bargaining team and issued ‘final written warnings' to all 11 other bargaining team members threatening immediate termination.”6. From Truthout, Rep. Pramila Jayapal has filed an official constitutional amendment to overturn Citizens United. A constitutional amendment is currently the only means available for reversing this catastrophic decision.7. In a video obtained by Gothamist, NYPD officers arresting a man wearing a Black Lives Matter sticker on his bike helmet were recorded bragging about “milking” overtime, referred to a female arrestee a "liberal [c word]," and joked about committing the arrestee to a mental hospital. This comes as Mayor Eric Adams announced that NYPD officers who work for five years will now make approximately $50K more per year than teachers with the same amount of time, an overall increase of $5.5 billion to the most expensive police department in the country, according to CBS.8. Robert Costa of CBS reports that former Rep. Dennis Kucinich is advising Robert F Kennedy Jr. on his presidential run. Costa went on to say that Kucinich could be the campaign manager or a top political adviser, and that Kucinich has urged Kennedy to focus more on the environment than his signature anti-vaccine message.9. Kansas Public Media KCUR reports that Republicans in that state overrode the Democratic Governor's veto and authorized genital inspections on minors in order for children to play sports. Somehow, the party advocating for adults to inspect children's genitals is calling the other party “groomers” with a straight face.10. From Deadline: Progressive lawmakers are calling on the Department of Justice to investigate the Warner Brothers merger with Discovery. In a letter to Attorney General Merrick Garland and DOJ antitrust chief Jonathan Kanter, the signatories allege that the merger “appears to have enabled” the company to “adopt potentially anticompetitive practices that reduce consumer choice and harm workers in affected labor markets.” They went on to argue that the merger has led to the “hollowing out” of an “iconic American studio,” and cited the cancellation of projects and the removal of content from the HBO Max platform.11. Dueling court orders have resulted in uncertainty about universal access to the abortion pill Mifepristone. Regarding the order to suspend the drug, Senate Finance Committee Chair Ron Wyden issued a statement declaring “I believe the Food and Drug Administration has the authority to ignore this ruling.” The Senate Finance Committee oversees the FDA.12. The Austin American-Statesman reports that, less than 24 hours after Daniel Perry was convicted of murdering Garrett Foster, a Black Lives Matter protester in 2020, Governor Greg Abbott announced that he would pardon the convicted killer as soon as a request "hits my desk." While the killer claimed that he was acting in self defense, he had mused on social media that he might “kill a few people on my way to work.”13. From Bloomberg Law: The International Brotherhood of Teamsters reported gaining 206,000 members in 2022, an increase of 20% from the previous year. Many credit this growth to the new leadership in the union, which took power in 2022.
