The Government wants to deal with shoplifting offences in a quicker way instead of going through the entire court system. The Justice Minister's newly released Cabinet paper proposes the burden of proof should fall on the suspect to prove their innocence. This clashes with the right to be presumed innocent until proven guilty, as protected in the New Zealand Bill of Rights Act. But Paul Goldsmith told Mike Hosking this could be compared to a traffic offence. He says someone caught speeding is given a ticket and must pay a fine unless there is a reasonable excuse. He's also welcoming a High Court ruling that the decision to extradite Kim Dotcom was legal. The Megaupload millionaire had challenged Paul Goldsmith's decision to surrender him to the US earlier this year, arguing the charges against him are politically motivated. Dotcom fought the extradition process all the the way to the Supreme Court and his latest effort was a judicial review. The Justice Minister told Hosking he's pleased to see his decision upheld but notes there are still potential appeals to be had. The Dotcom legal battle began 13 years ago. The Government's introduction of new sentences for coward punches is being described as merely cosmetic. It's announced specific offences for striking a distracted victim - which could carry a sentence of life imprisonment, if fatal. But Law Association Vice President Julie-Anne Kincade told Ryan Bridge she understands people have been looking for reform in this area. A prolific Tauranga shoplifter has been sentenced to two years behind bars after being convicted of nearly forty offences. Police say the investigation started with a single complaint through a retail crime data base, with no confirmed identity and no leads. But an officer was able to build-up a picture of the 45 year old woman who was pinching stuff on an almost daily basis. The conviction follows a controversial directive that set financial benchmarks for investigating petrol drive offs, retail crime and scams. It was quickly canned and since then a review been launched of cases that may have been parked up as a result of the directive. Police Commissioner Richard Chambers spoke to Lisa Owen.

Democracy stands at a crossroads in British Columbia as Michael Mulligan delivers a powerful analysis of the NDP's proposed Tariff Response Act (Bill C-7). Drawing on historical parallels that send shivers down the spine, Mulligan unpacks how this legislation bears troubling similarities to Nazi Germany's 1933 Enabling Act—legislation that effectively rendered their legislature irrelevant and set the stage for catastrophe.The bill's provisions would allow the government to make retroactive amendments to laws, shield officials from judicial review for procurement decisions, and potentially criminalize non-compliance with up to two years imprisonment. Most alarming is how the exclusion of the Offense Act creates a backdoor to criminal prosecution under Section 127 of the Criminal Code—potentially criminalizing actions that weren't illegal when performed. "The response to right-wing populism and erratic behaviour ought not to be a populist, left-wing, arbitrary response," Mulligan warns, as he urges Green Party MLAs who hold the balance of power to consider the weight of history before supporting such a transfer of power.In the second segment, Mulligan discusses a recent Victoria case with significant implications for homeowners and contractors. The court ruled that consumers can cancel construction contracts lacking specific completion dates within 12 months under the BC Business Practices and Consumer Protection Act. When a sunroom company demanded an additional $17,310 and dumped materials "the size of a small car" in a homeowner's driveway after cancellation, the judge ordered a full refund plus damages for trespass. Today's show opens with a return to a Friday favorite, Tara Bull's Top 10 News Items the Legacy/mainstream media didn't cover. I really enjoy being able to quickly run through several news stories before hitting my stack of stuff. The first item I dive into after the Top 10 is word that the Biden White House is busy on more pre-emptive pardons for Dr. Anthony Fauci, Sen.-elect Adam “Lying Piece of” Schiff and Liz “Love going to war” Cheney. This led me to pull up Article II, Section 2, Clause 1 of the Constitution. Within that clause is power for reducing sentences and pardoning crimes committed against the United States. In fact, the exact line reads, “[The President]...he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.” This leads me to ask, how can the President provide blanket immunity for unknown or unnamed offenses against the United States? Don't they have to be named? The first DOGE meeting took place and already the unhinged and angry lunatics on the Left are doing all they can to spin it into the worst fearporn they can envision. But, once you understand what is being suggested, all the fear subsides. Even Scott Jennings, CNN, says that's the feedback he is hearing. However, as Rep Tim Burchett (R-TN) notes, it's not a problem finding the fraud, waste and abuse. It's whether or not the Congress will do anything about it? Isn't that always the real question?
