Sure, proponents say this helps prevent crime, opponents say the information can be dangerous in the wrong hands and are the tools of tyranny and control.That criticism has intensified as the Trump administration has carried out immigration crackdowns across the nation, fueling concerns about clients sharing license plate information with Immigration and Customs Enforcement and other federal agencies.In Washington State, at least seven police departments and one sheriff's office had granted access to the U.S. Border Patrol to their license plate reader networks in 2025, according to an analysis by the University of Washington. "Call us. We'll protect your Constitutional Rights." -Sam MacRoberts The Fourth Amendment to the United States Constitution protects individuals from unreasonable, searches, and seizures, requiring law-enforcement to obtain a warrant based on probable cause. Flock is an American manufacturer and operator of surveillance hardware and software. Flock particularly surveys automated license plate recognition ALPR, and performs over 20 billion scans of vehicles in the United States every month their network consists of camera cameras, image recognition machine learning WICH share data with police departments.  Kansas Justice Institute is a free public interest, litigation firm, protecting the freedoms guaranteed by the Kansas and United States constitutions. City Of Wichita, through its vast network of nearly 200 AI powered ALPR's continuously tracks surveys and monitors while compiling searchable database on every law abiding Kansas driving in the city. This is done so without a warrant or without any judicial oversight. That is unconstitutional.

Authorities built part of the case against Bryan Kohberger through a combination of cell-site location information, surveillance footage, and DNA evidence, and the legal argument presented at the time was that investigators had obtained that evidence without violating the Fourth Amendment. Police had Kohberger's phone number from an earlier traffic stop and later obtained warrants for his historical cellular records. The initial warrant covered a limited period surrounding the murders, and investigators subsequently obtained authorization for a much broader range of records after reviewing the first set of data. Those records indicated that Kohberger's phone had connected to towers serving the area around the King Road residence on multiple occasions before the killings. On the night of the murders, the phone appeared to move away from Pullman before it stopped communicating with the cellular network for roughly two hours and then reappeared south of Moscow. Investigators argued that the phone data, when compared with surveillance footage of a white Hyundai Elantra traveling through the region, helped establish a timeline of Kohberger's alleged movements. Because investigators had obtained search warrants for the historical location information, the process was described as consistent with the Supreme Court's 2018 Carpenter v. United States decision, which imposed greater Fourth Amendment protections on long-term cell-site location records.The DNA portion of the investigation was also described as constitutionally permissible. Investigators had recovered male DNA from the button snap of the knife sheath found beside one of the victims and later used genetic genealogy techniques to help narrow their search. In December 2022, Pennsylvania authorities collected garbage that had been placed outside the Kohberger family residence and compared DNA recovered from that trash with the sheath profile. Testing indicated that the DNA from the garbage was overwhelmingly consistent with having come from the biological father of the man whose DNA had been found on the sheath, strengthening investigators' focus on Kohberger. The Fourth Amendment argument rested heavily on the Supreme Court's California v. Greenwood decision, which had established that police generally did not need a warrant to search garbage left outside a residence for collection because a person no longer retained a reasonable expectation of privacy in it. Taken together, the phone records, vehicle surveillance and DNA work were presented as evidence obtained through established constitutional procedures rather than unlawful searches, with the resulting information helping investigators establish probable cause for Kohberger's arrest.to contact me:bobbycapucci@protonmail.com

Like any other profession, there are good law enforcement officers, and bad law enforcement officers. How far can law enforcement go when it comes to arresting someone? For example, say police have probable cause to charge you with a misdemeanor, how far can they "bootstrap" that charge to something more serious? That appears to be the question in the case Chiaverini v. City Of Napoleon, Ohio. While dealing with a misdemeanor situation, Mr. Chiaverini was subsequently was charged not only with that, but a felony. One little problem, the police had no probable cause for the felony.

In a notable exchange, Senator Mike Lee (R-UT) accused the bureau of violating the Fourth Amendment by routinely accessing communications between Americans without receiving a constitutionally necessary court-order beforehand. 3:15pm- Investigative reporter for The Daily Caller James Lynch writes that “the Department of Justice (DOJ) secured court orders to prevent Google from informing congressional staffers of the DOJ's efforts to monitor their communications, according to court documents. Wray said no single individual made the decision. 3:30pm- On Tuesday, the House Oversight Committee held a hearing on the effects of a Biden Administration rule proposal change to Title IX which would expand the definition of sexual discrimination to include any school policy that prevents biological males identifying as female from competing in women's athletic competitions. Among the individuals testifying during the hearing is NCAA swimming champion, and women's sports advocate, Riley Gaines. Gaines insisted that there should be a place for everyone in collegiate sports, but that it isn't safe or fair for biological males to compete against biological females. 3:40pm- During Tuesday's Senate Judiciary Committee hearing, Senator Josh Hawley (R-MO) asked FBI Director Christopher Wray if anyone at the bureau was fired after targeting Catholics and inappropriately labeling them as radical hate group members. 4:05pm- According to a report from NBC4 New York, “[a]t least four gold bars tied to the FBI search of Sen. Robert Menendez's home had been directly linked to a New Jersey businessman now accused of bribing the state's senior senator, Bergen County prosecutor records from a 2013 robbery case show. The businessman, Fred Daibes, reported to police he was the victim of an armed robbery in 2013, and he asked police to recover the gold bars stolen from him. A graphic featured in the commercial encourages voters to cast their ballots on or before December 7th—however, the election is actually taking place on December 9th. 4:30pm- Brandon Drey of The Daily Wire writes: “A federal court on Monday halted the prison sentence for Douglas Mackey, who was convicted earlier this year of election interference for posting memes that mocked Hillary Clinton voters to cast their ballot via text during the 2016 presidential election. Mackey was accused of a ‘scheme to deprive individuals of their constitutional right to vote' after a Twitter account he ran under the handle ‘Ricky Vaughn' posted memes in the lead-up to the election. In October, Judge Ann M. Wray said no single individual made the decision. 3:30pm- On Tuesday, the House Oversight Committee held a hearing on the effects of a Biden Administration rule proposal change to Title IX which would expand the definition of sexual discrimination to include any school policy that prevents biological males identifying as female from competing in women's athletic competitions. Among the individuals testifying during the hearing is NCAA swimming champion, and women's sports advocate, Riley Gaines. Gaines insisted that there should be a place for everyone in collegiate sports, but that it isn't safe or fair for biological males to compete against biological females. 3:40pm- During Tuesday's Senate Judiciary Committee hearing, Senator Josh Hawley (R-MO) asked FBI Director Christopher Wray if anyone at the bureau was fired after targeting Catholics and inappropriately labeling them as radical hate group members.
