How far can law enforcement go when it comes to arresting someone? For example, say police have probable cause to charge you with a misdemeanor, how far can they "bootstrap" that charge to something more serious? That appears to be the question in the case Chiaverini v. City Of Napoleon, Ohio. While dealing with a misdemeanor situation, Mr. Chiaverini was subsequently was charged not only with that, but a felony. One little problem, the police had no probable cause for the felony.

Su, Acting Secretary of Labor, et.al. Sadly, the Supreme Court decided not to year the case, even if Justice Gorsuch would have and Justice Thomas wrote a dissent.

Encountering law enforcement can be a nerve wracking situation, even if you've done nothing wrong. Imagine you've pulled over to safely deal with something in your vehicle, then have a police officer pull up behind you. Nothing to worry about, right? Then imagine, after providing your drivers license, you're pulled out of your car, searched, handcuffed, and "stuffed" into the back of the police cruiser while the officer searches your vehicle from stem to stern, even though you've done nothing wrong. Now image, after this arrowing abuse of power, the officer claims "qualified immunity" and asks the court to dismiss the case. That is what happened to Basel Soukaneh in Waterbury, CT. The current state of that case is certainly worth looking into.

Today's show opens with House Leadership motioning to table Rep. Anna Paulina Luna's (R-FL) motion for a re-vote. In essence, this killed the attempt to ask for a vote to add the 4th Amendment reminder to the FISA re-authorization bill. So much for the Bill of Rights. Of course, Congress carved out their exception for themselves. This leads to AG Alvin Bragg who has invented a new law and found a judge who is okay using that make-believe law in an effort to go after Donald Trump. It's great to have laws, but when those in power refuse to enforce the laws, what is our recourse? And worse, what is the recourse for those who invent law and find judges okay using those pretend laws to go after people they don't like? For fun, we go through the elements of the “hush money” timeline and play along with Bragg's invented lawfare. Even if the alleged affair and alleged payoff is true, the time of the payoff could not have had any impact on the election. That's why the Federal Election Commission (FEC) and the DOJ both agreed there was no crime here. To lighten the mood a bit, we play a little ditty by Jim Gossett who recognizes this whole thing is a “Show Trial.” An NGO in Mexico is putting up fliers encouraging illegals to vote for Biden. The group has ties to organizations like Soros's Open Borders Foundation and the Hebrew Immigrant Aid Society (HIAS), where it just so happens DHS Secretary Alejandro Mayorkas was a former board member. Will Biden really still be the nominee by the time of the DNC convention in Chicago? Let's remind you how key Democrat strategists have been ramping up the pressure and suggesting Biden should step down. While the Legacy/mainstream media isn't talking about it, the primaries are still taking place. Would it surprise you to know that around 10% of Democrats are voting “undecided” or are picking someone other than Biden. DNC representatives may be okay lying on network television, but behind closed doors they are panicking. Looks like NPR has decided to punish Uri Berliner for speaking the truth. After his op-ed exposed the liberal groupthink that has taken over NPR, the CEO, Katherine Maher, has decided to suspend him. This is remarkably similar to the way CISA advised Twitter on how to judge if a post is spreading misinformation. If the comment, even if truthful, runs afoul of the approved government narrative, it can be considered misinformation nonetheless. Joe Scarborough had an adult-sized temper tantrum on MSNBC's, “The Morning Joe.” The derangement and lunacy was on full display with a rant by an empty head who doesn't get a single fact correct in his opening and by the end, is openly mocking and deriding the vast majority of Americans. When elites can't get their way, they show us the toddlers they really are. In closing, we illustrate the same issue we saw with Joe Scarborough, only this time, with singer John Mellencamp. After pausing his show for minutes to lecture the crowd about voting for Biden, someone suggested he play some music. The crowd didn't want to attend a lecture. It's tax day here in the United States. So, I take a moment to rant about our current income tax structure, the IRS and how lawmakers use the tax code to control people. On that note, Rep. Harriet Hageman (R-WY) reveals the IRS is already using AI to scan bank accounts of US citizens. They are already ignoring the 4th Amendment. Speaking of the right we are supposed to have against illegal searches and seizures and that any legal search must require a specific warrant, FISA reauthorization was being voted on this past Friday. Apparently, half of the House of Representatives didn't want to include an amendment reminding users of FISA of the rights Americans are supposed to have per our Constitution. Isn't it mind-boggling that half the House is opposed to making sure the provisions of the 4th Amendment are followed as it relates to US citizens? Iran attacked Israel over the weekend with over 300 elements including drones, ballistic missiles and cruise missile. According to a story from the Jerusalem Post, according to Reuters, it looks like Turkish diplomats were told by Iranian officials of the attack. The anonymous source said that Turkish diplomats told the White House about the attack and they said the policy of the US was to keep the attack “within certain limits.” If true, is there anything else you would need to hear to know Joe Biden has no business being our Commander-in-Chief? They were okay with an enemy attacking an ally! Now the talking points from our country and the West is for Israel to “take the win”, “take a breath” and to think of it as Iran already being dealt a “double defeat.” They literally want Israel to sit back and just take it. If they really wanted to do something, they would be putting a bigger spotlight on Jordan and Saudi Arabia for their help in shooting down missiles and drones. It seems there are some Arab nations who don't think the Middle East is best served by letting the theocracy of Iran having any power there. By the way, the son of a former Hamas Leader is once again trying to educate the West that all the money we send to them is not going to the people. For every child killed in Gaza is more money in their pockets. In short, the leaders do not care about their own people. It's how they have become billionaires themselves. As time winds down I am aware of Donald Trump being in yet another New York City courtroom at the hands DA Alvin Bragg. The whole notion Bragg has discovered some area of law to go after Trump is preposterous. In closing, I bring you a headline from over the weekend in the New York Times. According to the Old Gray Mare, they admit that voters are looking back more positively on Trump's presidency as Biden fails at everything. In a notable exchange, Senator Mike Lee (R-UT) accused the bureau of violating the Fourth Amendment by routinely accessing communications between Americans without receiving a constitutionally necessary court-order beforehand. 3:15pm- Investigative reporter for The Daily Caller James Lynch writes that “the Department of Justice (DOJ) secured court orders to prevent Google from informing congressional staffers of the DOJ's efforts to monitor their communications, according to court documents. Among the individuals testifying during the hearing is NCAA swimming champion, and women's sports advocate, Riley Gaines. Gaines insisted that there should be a place for everyone in collegiate sports, but that it isn't safe or fair for biological males to compete against biological females. 3:40pm- During Tuesday's Senate Judiciary Committee hearing, Senator Josh Hawley (R-MO) asked FBI Director Christopher Wray if anyone at the bureau was fired after targeting Catholics and inappropriately labeling them as radical hate group members. 4:05pm- According to a report from NBC4 New York, “[a]t least four gold bars tied to the FBI search of Sen. Robert Menendez's home had been directly linked to a New Jersey businessman now accused of bribing the state's senior senator, Bergen County prosecutor records from a 2013 robbery case show. The businessman, Fred Daibes, reported to police he was the victim of an armed robbery in 2013, and he asked police to recover the gold bars stolen from him. A graphic featured in the commercial encourages voters to cast their ballots on or before December 7th—however, the election is actually taking place on December 9th. 4:30pm- Brandon Drey of The Daily Wire writes: “A federal court on Monday halted the prison sentence for Douglas Mackey, who was convicted earlier this year of election interference for posting memes that mocked Hillary Clinton voters to cast their ballot via text during the 2016 presidential election. Mackey was accused of a ‘scheme to deprive individuals of their constitutional right to vote' after a Twitter account he ran under the handle ‘Ricky Vaughn' posted memes in the lead-up to the election. In October, Judge Ann M. Today we are talking about a poker game that spun wildly out of control and turned into a robbery and shooting, and that was just the start of this case!The reason we are discussing this case is because during the investigation the defendants iPhone was searched and during that search the investigator found evidence of another crime that he was subsequently charged with. The defendants lawyer tried to argue that the search warrant that was used was too broad and therefore the evidence should not be allowed, and the case went all the way up to the U.S. Court of Appeals.This case brought up a number of different 4th amendment issues and how the law is being interpreted given the new technologies that exist today and so we thought it was an interesting case to bring up with our audience. The more things change, the more they stay the same. Several years ago I wrote an article about the Battle of Athens, TN. In the article I showed the corruption in McMinn County Sheriff's Department, where the Sheriff and his deputies did not receive a salary, but were paid for everyone they booked, incarcerated, and released. This perverse incentive let to deputies routinely boarding buses to “fine” and jail the passengers for any alleged violations they could come up with. When subject to this corruption, many GIs returning from World War II were led to challenge the corrupt county Sheriff and other office holders. This challenge led not only to an embattled election, but an armed uprising in an attempt to restore the rule of law. If you don't find this story of corruption compelling, consider this. The same basic system of corruption in the McMinn County Sheriff's Department exists across the country. While the McMinn County process did not have a name, the 21st century version does, Civil Asset Forfeiture!

The Rich Zeoli Show- Hour 4: In a new editorial on Reason.com, David McGarry warns that the federal government is circumventing the 4th Amendment by “purchasing citizens' private market data (PMD) from data brokers without a warrant.” While appearing at the World Government Summit, Elon Musk warned that the establishment of a world government could lead to the collapse of civilization. According to reports, the Justice Department will not charge Congressman Matt Gaetz (R-FL) with any crimes. The New York Times' Glenn Thrush writes: “In 2021, federal prosecutors began examining whether Mr. Gaetz…broke federal sex-trafficking laws, focusing on his relationships with women recruited online for sex, and whether he had a sexual relationship with a 17-year-old girl.” But hasn't the damage to Rep. Gaetz's reputation already been done? Why aren't there repercussions for reputational damage—and what's stopping the DOJ from doing this to other political opponents?

Off and on from 2006 to 2012, Snowden had worked as a CIA analyst, a subcontractor for the NSA, and several other positions that gave him access to classified NSA information that enabled him to see the true scope of how the US was surveilling its own citizens. Does leaking those docs to the press in 2013 make him a traitor? Or does it make him a hero who opened the eyes of the American public to the dangerous and unconstitutional surveillance our government has been clandestinely carrying out for years? I was familiar with Edward Snowden before this week, and the gist of what he did, but I truly didn't realize the scope of the surveillance and the amount of private data gathered on US citizens who were not accused of any crimes.
