Today we tell the story of the battle over the Tellico Dam, the last major project of the Tennessee Valley Authority. TVA's ambitious plans for the Tellico project included not only a dam and lake but also the development of a brand-new city to be called Timberlake. However, the project faced fierce resistance from landowners who were being forced to sell their land, the Cherokee, whose most important Overhill towns were going to be flooded by the dam, and environmentalists trying to save the habitat of the endangered snail darter fish. A lawsuit over the fish won a victory in the Supreme Court for those wanting to stop the Tellico Dam, but that wasn't the end of the story, as you'll find out in this episode. Stuart and Rudy practice in Riker's Governmental Affairs and Litigation practices with extensive experience in Eminent Domain and Condemnation Law as well as Construction Law, regularly navigating issues of title, and frequently interacting with our title insurance attorneys at the intersection of title law and real property condemnations. Stuart and Rudy represent both governmental entities who are acquiring properties, and also property owners whose properties are targeted to be taken for particular government projects. What You Will Hear on This Episode: What are the key stages of the condemnation process? Is it important for property owners to attend early meetings on government projects that may impact their properties? What are the public purposes for which a property may be taken? To whom may the government delegate the power of condemnation? Does the governmental entity have the right to conduct a property title search in advance of a taking? How is fair market value determined? Is lost business taken into consideration? What are bona fide negotiations and when can a condemnation complaint be filed? Whose interests are important in properties being taken? What is a “quick take”? Can a property be taken and put to public use even while litigation over rights and fair market value is pending? What are critical defenses to a real property taking? How do you prove a pretextual purpose (improper motives, bad faith or abuse of power)? (Essex Fells v. Kessler Institute and Atlantic City v. Trump Casino) What constitutes failure to negotiate, and can this prevent the taking? What is the role of condemnation commissioners, and who has the burden of presenting evidence to establish value at trial? What are the implications if it is not a “full” taking? Is the government required to pay for another party's environmental damage to the property? What are the special implications for lien holders of a property being taken? Are judgments final, and can the property owner appeal? What is an inverse taking? In addition, Stuart and Rudy shared some interesting anecdotes from their wide-ranging experience representing government agencies tasked with taking property, including allowing a “jury view” of the condemned property during a trial on the taking, and another case where the property owner resisted the taking by hiring private militia to face down the bulldozers, creating a standoff between the armed militia and the local National Guard brought in by the governmental entity. They also touched on their related Construction Litigation practice and the dovetailing of the two practices, particularly when temporary easements are recorded on taken properties for large construction projects, and construction delays ensue with adverse effects. Next, Bethany interviewed our newest associate in the Title Insurance practice, Shelley Wu, who discussed Moldovan v. Long, No. 1 CA-CV 23-0470, 2024 Ariz. App., Unpub. LEXIS 460 (Ct. App. May 30, 2024). In this case in the Arizona Court of Appeals, the court affirmed a summary judgment in favor of a settlement/escrow agent, finding no breach of duty where the agent sufficiently disclosed to the seller the existence of a potentially fraudulent deed but did not further investigate or determine its validity. Bethany and Shelley discussed many of the noteworthy statements in the appeals court's ruling that sheds light on the responsibilities of disclosing additional deeds, and concerning negligent misrepresentation claims. STORY 1: Eminent Domain Battle Brewing Between Norcross and Georgia Trust for Historic Preservation The Norcross Woman's Club and the Georgia Trust for Historic Preservation are in dispute with the City of Norcross over the future of the club's historic building, which was recently donated to the Trust. The city plans to consider a condemnation resolution on September 3, initiating the eminent domain process. While the city insists this move is not intended for demolition, the Georgia Trust is concerned that it could jeopardize the building's preservation. The Trust aims to restore the building and convert it into a private residence with preservation easements, but the city prefers a public use for the structure. The building, originally Gwinnett County's first library and designed with Greek Revival architecture, remains a point of contention. STORY 2: Three Gwinnett Grads Named AP Football Preseason All-Americans Three former Gwinnett prep stars have been named to the Associated Press preseason All-American Team. Caleb Downs, a safety for Ohio State, was previously an All-American at Alabama and leads the defense. Barrett Carter, a linebacker at Clemson, is also on the first-team defense, known for his impressive stats and All-ACC selection. Travis Hunter of Colorado, a versatile player from Collins Hill, made the first-team offense as an all-purpose player. Ohio State led with four selections, while Georgia and Michigan each had three. STORY 3: Buford's Neely Kerr Headed to Colombia with US U-20 World Cup Team Neely Kerr, a senior at Buford, received exciting news that disrupted her school year: she was selected as one of three alternates for the U.S. Under-20 Women's National Soccer Team for the FIFA U-20 Women's World Cup in Colombia. Initially listed as a provisional roster member, Kerr was called up after an injury opened a spot. She'll complete her schoolwork online from Colombia through early September. Despite not being on the main roster, this opportunity to train with the team is a significant step in her soccer career. We'll be right back Break 2: TOM WAGS (OBITS) GUIDE MENTAL HEALTH UPDATE BREAK: GWINETT COUNTY FAIR STORY 4: ON THE RISE: Georgia Gwinnett College Enrollment Increases For 7th Straight Semester Georgia Gwinnett College is set to increase its fall enrollment by 2.1%, surpassing 12,000 students for the seventh consecutive semester. The majority of students are from Gwinnett County, but the college also attracts students from across the U.S. and 116 countries, with Vietnam, Nigeria, Venezuela, Mexico, and India being the top five. Dr. Michael Poll, VP of Enrollment Management, credits this growth to strong collaboration among staff and a focus on student success and retention, which has led to a 4% increase in returning students. STORY 5: Pearl Harbor Hero To Be Laid To Rest On December 7, 1941, U.S. Navy Fireman 2nd Class Joseph William Carroll perished aboard the USS Oklahoma during the attack on Pearl Harbor. Of the 429 crewmen lost, 388 remained unidentified until recent efforts began to exhume and identify remains. By August 19, 2019, Carroll was among those identified. His remains will be interred at the National Cemetery of the Pacific in Honolulu on August 21, 2024. Carroll's cousin, Nancy Leigh Carroll De La Cruz, will attend the ceremony, honoring his sacrifice and placing him to rest alongside his fellow sailors. This closure follows 77 years of uncertainty, highlighting the Navy's dedication to identifying and honoring fallen service members. We'll have final thoughts after this.
