Our webinar focused on private civil litigation. Our featured guest for this webinar was Ira Rheingold, Executive Director of the National Association of Consumer Advocates. He was joined on the panel by Thomas Burke, Dan McKenna, Jenny Perkins, Joseph Schuster, and Melanie Vartabedian, litigators in our firm's Consumer Financial Services Group. We discussed the following areas where the panelists are predicting an increase in private civil litigation during 2025 and beyond: 1. Solar Litigation Trends (Ira, Melanie). 2. The National Association of Consumer Advocates just issued a report showing some of the worst of the worst in standard form contracts that consumers regularly sign. Consumer advocates say a muscled up Kiwibank is no silver bullet to fix the country's banking sector. A draft Commerce Commission report has found a lack of competition in the personal banking sector and says New Zealand-owned Kiwibank is too small to disrupt the market. It says there's a two-tier market in which the big four Australian-owned banks have the major share, with smaller operators offering no threat to that dominance. In 2021 Australians lost over $2 billion in scams, prompting Consumers Affairs Ministers to address the issue of scam prevention. Consumer Advocates are now arguing that your bank should be held responsible for reimbursing scams. Gerard Brody, Chief Executive Officer at Consumer Action Law Centre told Oliver Peterson on Perth Live that there is already an activity within the financial system which makes banks liable. "For unauthorised transactions like card fraud, you might get a call from your bank to let you know there has been transactions on your account. In those circumstances you are reimbursed and what we've seen is that the level of fraud in that area has declined," he told Oly. "In instances when someone makes a transaction to a fraudster, the customer in general is held accountable and I think that is really inconsistent and unfair. I think if we shifted that liability, it would provide a powerful incentive to our banks to ensure the payment system is safe." Mr Brody stated the key part of their proposal is that it will create incentives for banks to invest in systems and technology to prevent these scams from occurring in the first place.See omnystudio.com/listener for privacy information.

We first look at NCLC's legislative priorities, which include a 36% national interest rate cap and credit reporting reform, and the prospects for Congressional action. Ms. Saunders then provides NCLC's perspective on areas of potential CFPB regulatory action including overdraft and other fees labeled “junk fees” by the CFPB, earned wage access programs, buy-now-pay later products, income share agreements, the use of artificial intelligence in underwriting and collections, fraud in peer-to-peer payment services, the use of unfairness to challenge non-credit discrimination, and mandatory arbitration. Our special guests are the authors of a 259-page study, “Reboot Required: The Civil Justice System Has Crashed,” which makes the case that the civil justice system has been corrupted by corporations and no longer protects average Americans from corporate abuse. The study is accompanied by a draft model law intended to create new rights and protections for consumers. The authors explain the basis for their view that fundamental change is needed, including the elimination of a company's ability to assert a “duty to read” defense or use mandatory arbitration provisions in consumer contracts. NACA is one of the plaintiffs in the Massachusetts lawsuit challenging the CFPB’s creation of its Taskforce on Federal Consumer Financial Law. Starting out the new series we have a special guest who is at the center of the consumer advocate universe. Ira Rheingold began representing consumers in the greater Washington D.C. area in the early 1980’s and went on to influence an overhaul of lending practices and foreclosure law in Chicago. Thereafter, he became the Executive Director of NACA, the National Association of Consumer Advocates. NACA is a trade organization of more than 1,500 attorneys committed to the representation of consumers victimized by fraudulent, abusive and predatory business practices. In our discussion, Ira talks about how his time as a litigator influenced the leadership he now strives to provide, we hear about ongoing projects and goals for NACA and discuss a vision of consumer rights for the future.

H.R 2058: http://cqrcengage.com/casaa/app/write-a-letter?0&engagementId=153933 The FDA Deeming Authority Clarification Act of 2015 (HR 2058), introduced by Representative Tom Cole of Oklahoma, would save the U.S. vapor industry from being decimated by improper regulations by the FDA. This bill would amend the Food, Drug, and Cosmetics Act to change the grandfather date for “deemed tobacco products.” This change would allow for all vapor products currently on the market to remain on the market without being subject to the burdensome (read: prohibitive) pre-market FDA approval application process. It's imperative that if you are a vaper, and these new regulations will affect you, that you contact your state representatives.
