  On this episode, the fifth installment of our eight-part, issue-specific series, we'll explore how nonprofits can boldly and safely advocate for gender and reproductive justice. We'll review recent policy developments and discuss how nonprofits can respond through legislative, executive, and judicial branch advocacy. Join us as we break down the rules and share recent examples of how nonprofits are advancing gender and reproductive justice.     Attorneys for this episode    Quyen Tu  Brittany Hacker  Melissa Marichal Zayas    Shownotes  Gender and Reproductive Justice Headlines  Executive Branch Actions  Since taking office, President Trump has signed several sweeping executive orders that undermine the rights of transgender people and women and reduce access to reproductive health care.   These include, for example, orders that terminate federal diversity, equity, and inclusion programs; rescind executive orders that expanded access to reproductive health care; ban transgender people from serving in the military; limit coverage for gender-affirming care; and require federal agencies to recognize only two, “not changeable” sexes.  The DOJ has announced that, outside of extraordinary circumstances, it will stop enforcing the Freedom of Access to Clinic Entrances Act, a law that protects reproductive clinic staff from violence and harassment.   HHS Secretary Robert F. Kennedy Jr. has directed the FDA to review its approval of the medication abortion pill Mifepristone.   We've also seen major funding cuts across several agencies. HHS, for example, has terminated NIH grants focused on LGBTQ+ health issues and frozen millions of dollars of Title X funds, which help provide reproductive health services in low-income communities.    Litigation  Many nonprofits, as well as state attorneys general, have filed lawsuits challenging the executive orders that seek to curtail LGBTQ+ rights and DEI initiatives.   In February, for example, a group of several civil rights nonprofits, along with Crowell & Moring LLP, filed a lawsuit on behalf of Chicago Women in Trades to challenge the Trump administration's anti-DEI executive orders. As a result, a federal court has temporarily blocked the Labor Department from requiring Chicago Women in Trades and other federal contracts or grant recipients to certify that they don't operate any programs that violate Federal anti-discrimination laws, which one of these EOs would require.   Many other provisions of these EOs, however, remain in effect as the cases make their way through the courts.   The National Council of Nonprofits has a continuously updated chart tracking executive orders that impact nonprofits and their current legal status. Just Security has an even broader resource that is tracking all legal challenges to Trump administration actions.    Legislation  Congress is currently considering deep cuts to Medicaid. These proposed cuts would lead to an estimated 8 million Americans becoming uninsured, and would eliminate all federal funding to Planned Parenthood, including funding for preventative health screenings and testing. Proposed budget cuts would also further restrict transgender peoples' access to gender-affirming care.   In Missouri, the state legislature recently approved a new ballot referendum that, if passed, would repeal last year's voter-approved constitutional amendment guaranteeing a right to abortion. This ballet referendum will appear on the ballot in November of 2026 or earlier if Missouri's governor calls a special election.     What can 501(c)(3)s do to respond?   As a reminder, 501(c)(3)s cannot support or oppose candidates for elective public office. This means they can't engage in activity that helps or hurts the chances of a candidate winning an election.  But here's what they can do: They can engage in an unlimited amount of non-lobbying advocacy, and they can engage in a limited amount of lobbying.    Non-Lobbying Advocacy   Educate the public about issues of importance to your organization  The Center for Reproductive Rights' tool, Repro Red Flags: Agency Watch, which tracks key Trump administration appointments and actions related to reproductive health.   PFLAG is tracking and reporting on federal and state legislation and litigation impacting the LGBTQ+ community through its weekly Policy Matters Newsletter and Executive Orders Explainers and Resources web page.  The National Women's Law Center has released a report highlighting how the cuts would impact women and LGBTQ+ individuals.  Engage in administrative advocacy  A March letter sent by Equal Rights Advocates and several other civil rights organizations to Acting EEOC Chair Andrea Lucas urges her to immediately withdraw a series of letters and guidance documents pressuring employers to abandon DEI programs.   Hold a rally  In April, the Coalition for Inclusive Schools & Communities, Live in Your Truth, and the Montgomery County Pride Family held a  rally in support of inclusive education outside the U.S. Supreme Court during oral arguments in Mahmoud v. Taylor.  Initiate or participate in litigation  In May, a Michigan state court permanently struck down three of Michigan's abortion restrictions, agreeing with Northland Family Planning Centers and Medical Students for Choice—two nonprofits plaintiffs represented by the Center for Reproductive Rights—that the restrictions violate the state's constitutional amendment.  Fund advocacy  Public and private foundations can fund advocacy through general operating grants or specific project grants.    Lobbying  501(c)(3) public charities can engage in lobbying, but they are limited in how much lobbying they may engage in.  Under the federal tax rules, most public charities can choose between two tests to determine how much lobbying they can engage in: the insubstantial part test or the 501(h) expenditure test.  Under either test, lobbying includes attempts to influence legislation at any level of government. The exact activities that will count as lobbying will depend on which test the organization uses.   When engaging in lobbying, remember to track and report your lobbying on your annual Form 990, stay within your lobbying limits, and use unrestricted funds.   In addition to the tax rules, federal, state, or local level lobbyist registration and reporting requirements may apply when engaging in legislative and executive branch advocacy. These requirements vary by state and city, so make sure to confirm the types of activities and thresholds that trigger reporting in the jurisdictions where you are lobbying.   The IRS considers ballot measure advocacy a form of direct lobbying because the voters act as legislators when they vote to approve or reject a ballot measure, but keep in mind that your organization may also be required to register and report on ballot measure activity under state or local campaign finance laws.  Since 2022, 501(c)(3) public charities have helped to pass ballot measures that establish a right to abortion in eleven states.    Resources  The Advocacy Playbook for Gender and Reproductive Justice  Public Charities Can Lobby (Factsheet)  What is Advocacy? 2.0 (Factsheet)  Administrative Advocacy: Influencing Rules, Regulations, and Executive Orders (Factsheet)  What Nonprofits Needs to Know About Lobbying in Your State    Understanding the Federal Lobbying Disclosure Act (Factsheet)  Investing in Change: A Funder's Guide to Supporting Advocacy

It's typical to see moving trucks winding through streets and alleys of Chicago on the first day of any month. The act of moving hardly sounds like a luxury, but as we heard in the last episode, it could be worse. About a century ago, Chicagoans only moved on May 1 and sometimes Oct. 1. That meant thousands of moving wagons clogging the streets, price gouging and exploitation. Today, people move any time of the year and there are more protections for tenants. But that doesn't mean we can't use some advice to make moving and renting in Chicago easier. Host Erin Allen talks with local U-Haul representative Constance Turner about best practices when it comes to packing up and moving in. Then, she sits down with Sam Barth, staff attorney with Law Center for Better Housing, to talk about what renters can do to protect themselves.

For parents who need to work but can't afford the steep cost of child care, federally funded scholarships can be a lifeline. Delivered through state child care assistance programs, the scholarships can mean the difference between a parent working full time—or not at all. But qualified families are increasingly being turned away, thanks to the rising costs of child care and the end of pandemic-era funds, and some families that had scholarships have seen them end. In three states—Arizona, Colorado and Texas—parents who apply face long waitlists. Other states have increased copayments for parents or have said they will serve fewer children. In March, the Trump administration laid off some employees who helped states implement child care assistance. It's left advocates worried about the future of federal child care programs. “What it means is that ultimately child care will become less safe, it's going to become more expensive, and it's going to become harder to find,” said Ruth Friedman, who was the director of the Office of Child Care under former President Joe Biden. In Colorado, a dozen counties stopped accepting new applications for the state's child care assistance program because they ran out of money, The Colorado Sun reported. For states trying to maintain child care assistance scholarships, the costs of running the programs have risen. Because many child care providers operate on the margins, the Biden administration increased the amount they receive when they take scholarship students. It's all evidence that the problems that vex the child care industry have not necessarily abated with the pandemic, said Karen Schulman, senior director of child care policy at the National Women's Law Center. “The crisis was going on long before COVID,” Schulman said, citing the unaffordability of care for many families, along with the low pay of the child care workforce. Even as providers struggle to make a profit, child care is prohibitively expensive for many families. In a study of 2022 child care prices, the Labor Department found the median cost of care for an infant in a center was more than $15,600 in large counties—higher than the median rent in many places. Patrick is an Albany Law School graduate and works as the Director of the Government Law Center at Albany Law School. From College Soccer Player to Law School graduate to working at the Executive Chamber to the Governor of New York, Patrick's journey is unique in its own ways. Patrick and I start right before his introduction to Albany Law School. Inspired by his parents, Law School was always something that was top of mind. At home, his community cultivated a culture of volunteering, as well as the pro-bono work he saw his parents do, had a massive influence over him, and the future work that he would do. We then spoke about the first year of Law School, which was nothing short of a massive learning experience. Patrick would describe it as dense as well as a total reset from the way you think, and with that also made it critical for future success. Patrick then spoke about various experiences he had leading up to today. He discussed how he figured out what he wanted to do with the law, inspired by a need to help those who needed it, a constant theme throughout his career. Patrick also keyed in on the importance of Mental Health, especially in the legal industry. The 1964 Civil Rights Act outlaws discrimination on the basis of sex in employment. In addition, in 1972, The Higher Education Act was amended to prohibit the exclusion of any person from any federally funded educational program or activity on the basis of sex. These seemingly simple prohibitions have recently been the focus of considerable attention. How, for example, do they apply to individuals whose gender identity is seemingly at odds with their biological sex? What does the Bostock decision say about their situation? Is a federally funded school required to assign bathrooms, showers, changing rooms, and sleeping quarters based on gender identity? Is an employer required to do so? If not required, is it permissible for these entities to do so under the law? What about athletics? What about prisons? And quite apart from what the law is now, what should it be? What about what is often called “gender affirming” treatment? Should a parent be able to obtain such treatment for a child? Should a parent be able to refuse it? What is the role of schools? Should the government be obligated to fund “gender affirming” care for prisoners or individuals on relief? Today's guest, Taylor Sartor, is the creator and legal director of FosterPower, a movement to improve the lives and futures of youth in foster care in Florida, by providing them information on their benefits, protections, and legal rights. Taylor is also a senior attorney at the L. David Shear Children's Law Center, where she represents youth in foster care. Taylor focuses on issues related to human trafficking, disabilities, commitment in psychiatric facilities, aging out of foster care, and school-to-prison pipeline prevention, among many others. She came up with the idea for FosterPower while she was still in law school working with youth in foster care who had many questions about their rights and the resources available to them. The organization offers answers to these questions through a mobile app. An alum of Stetson University College of Law, Taylor is also the founder of Child Advocates of Stetson Law, an organization that recruits law students to become guardian ad litem volunteers, mentors, and leaders to advocate on behalf of children facing abuse and neglect. Additionally, she served as an Equal Justice Works Fellow at the Children's Law Center from 2018 to 2020. In our wide-ranging discussion, Taylor talks with us about the range of issues youth in foster care must contend with, how FosterPower earns trust from its users, where her passion for youth in foster care comes from, and her experience as an Equal Justice Works fellow.

Pride?  Its actually none of these… but so common it is overlooked. You do it, I do it, we all do it… So we should probably know what it is… right?    Health Insurance Follies: (1) Blue Shield California twice refused to pay $2,700 emergency-room claims by Rosalinda Miran- Ramirez, concluding that it was not a "reasonable" decision for her to go to the ER that morning that she awoke to a shirt saturated with blood from what turned out the be a breast tumor. Only after a KPIX-TV reporter intervened in September did Blue Shield pay the claim. (2) National Women's Law Center found that the laws of eight states permit insurance companies to deny health coverage to a battered spouse (as a "pre-existing condition," since batterers tend to be recidivists), according to a September report by Kaiser Health News. [KPIX-TV, 9-25-09] [MSNBC, 10-7-09] Garth's note: I am sure that being Hispanic the Insurer thought it was a clear Cut case of spousal abuse.  The insurance agency probably justified their Actions because that is the way it always is (in there minds)   So what is the most common sin of man? Rationalization! We can rationalize anything.    Rationalize Satan can sound very reasonable, but he is never reliable. Gary Zarlingo     Its not a baby, its a fetus, its not a fetus its just tissue, its not tissue its about a woman's reproductive rights… and by that we mean a health issue…  Or back to step one… its Murder.    Jeremiah 17:9 " The heart is deceitful above all things, And desperately wicked; Who can know it?   What does deceitful mean? It means it can twist logic to get away with anything… rationalization!    Morris Siegel, the owner of a small Kosher New York deli, was being questioned by an IRS agent about his tax return. He had reported a net profit of $60,000 for the year. Why dont you people leave me alone? the deli owner said. I work like a dog, everyone in my family helps out, the place is only closed three days a year. And you want to know how I made $60,000? Its not your income that bothers us, the agent said. Its these business travel deductions of $125,000. You listed ten trips to Israel for you and your wife. Oh, that? the owner said smiling. Well....we also deliver. [haruth.com].   The problem with rationalization is we can rationalize ourselves right out of the presence of God… and even then rationalize why he is no longer felt in our presence.

As we've talked about on previous editions of the pod, advocacy includes a wide array of different options to help change things for the better in our communities. One of the more important, but less discussed methods, is litigation. Example: Lambda Legal focuses on litigation in support of LGBTQ+ rights and individuals living with HIV/AIDS. They represent clients in cases involving discrimination, marriage equality, and transgender rights, participating in all stages of litigation. Currently representing AFJ member PFLAG in a Texas case. Example: Clean Water Act citizen suits suing polluters for discharges without a permit – we'll talk more about this specifically later Standing: must show harm to the organization or members of the organization Publicly supporting (or opposing) another organization's litigation Amicus briefs Representing clients Litigating as a plaintiff (citizen suits, standing) Things to think about The law (who are the experts in relevant area of law?) Capacity (internal or external) Staff and resources (funding and time) Reputation with funders, members, public In-house or outside counsel Media impact and PR Insurance (not sure if this is too deep in the weeds?) Examples Lawsuits typically target government agencies, industrial polluters, and corporations to enforce existing environmental laws Clean Water, Clean Air Act, National Environmental Policy Act (NEPA), Endangered Species Act, Resource Conservation and Recovery Act (RCRA), Safe Drinking Water Act Litigates claims of actual innocence made by individuals convicted of serious crimes in Texas. Title IX, a civil rights law enacted in 1972, is a statute meant to protect students from sex discrimination in educational environments to maintain equal opportunity to educational access. This year, the Biden administration released a new Title IX rule, which provides additional protections for those who are most likely to experience sex discrimination at school. Shiwali Patel, Senior Director of Safe and Inclusive Schools at the National Women's Law Center, sits down with us to talk about what this rule change accomplishes and what challenges it faces. In April 2024, the Biden administration released the new rule, which, most significantly, clarified protections for LGBTQI+ students, provided additional protections for pregnant and parenting students, and expands protections against sexual harassment. The rule also undid many of the Trump administration's harmful Title IX changes. Unfortunately, these celebrated changes are being challenged in court. Send us a Text Message.In the last couple of years, states have ramped up their attacks on the LGBTQ+ community, introducing laws surrounding sports, books, and even healthcare.  24 states have banned gender affirming care for youth, and many of those laws are now being discussed, debated, and decided in the courts as LGBTQ+ people, families, and advocacy groups file challenges to these laws. Medical bans on gender affirming care have been some of the most terrifying for families, and there have been a lot to try to keep track of.
