Columbia-based Boone Electric Cooperative has about 30,000 members in Boone as well as Audrain, Callaway, Howard, Monroe and Randolph counties. Boone Electric Cooperative was incorporated in June 1936 during the Great Depression. It was Missouri's first rural electric cooperative. By 1937, they served 140 members in rural Boone County. Boone Electric general manager and chief executive officer Todd Culley joined host Fred Parry in-studio for the hour Saturday on 939 the Eagle's “CEO Roundtable” program. Mr. Culley tells listeners that Boone Electric now has about 30,000 members and 36,000 meters, saying they are primarily a distribution cooperative. Boone Electric have nine directors. It was formed during the Rural Electrification Administration (REA) under President Franklin D. Roosevelt. Some old-timers still use the term REA today. Boone Electric now has 3,200 miles of distribution lines, with 1,400 of those underground. Mr. Culley grew up in Boone County, Indiana, a rural area north of Indianapolis. He tells listeners that Boone Electric has always had a national reputation. Mr. Culley has been in the position for about 18 years. He replaced Roger Clark and Bob Alderson before him. Mr. Alderson served as Boone Electric's chief executive officer from 1977 to 2000, one of the longest-serving CEOs in Boone Electric history. Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in Culley v Marshall. In this case, the court considered this issue: What test must a district court apply when determining whether and when a post-deprivation hearing is required under the Due Process Clause? The case was decided on May 9, 2024. The Supreme Court held that in civil forfeiture cases involving personal property, the Due Process Clause requires a timely forfeiture hearing but does not require a separate preliminary hearing. Justice Brett Kavanaugh authored the 6-3 majority opinion of the Court. The Due Process Clause of the Fourteenth Amendment generally requires notice and a hearing before the government seizes property. However, the Court's precedents differentiate between real property, which can be neither moved nor concealed, personal property risks being removed, destroyed, or concealed before a civil forfeiture hearing. Thus, as the Court recognized in United States v $8,850 and United States v Von Neumann, a timely post-seizure forfeiture hearing provides the constitutionally required process after seizing personal property. For such personal property, a separate preliminary hearing before the forfeiture hearing is not required. In contrast, in United States v James Daniel Good Real Property, the Court held that the government must ordinarily provide notice and a hearing before seizing real property that is subject to civil forfeiture. Here, the property subject to forfeiture is a vehicle—personal property—so a timely post-seizure forfeiture hearing is all the Due Process Clause requires. Justice Neil Gorsuch authored a concurring opinion, in which Justice Clarence Thomas joined, agreeing in large part with the majority's reasoning and conclusions but writing separately to highlight some of the many larger questions this decision leaves unresolved about whether, and to what extent, contemporary civil forfeiture practices can be squared with the Constitution's promise of due process. Justice Sonia Sotomayor authored a dissenting opinion, in which Justices Elena Kagan and Ketanji Brown Jackson joined. Justice Sotomayor argued that the majority's opinion is too broad and prevents “lower courts from addressing myriad abuses of the civil forfeiture system.” She, on the other hand, “would have decided only which due process test governs whether a retention hearing is required and left it to the lower courts to apply that test to different civil forfeiture schemes.” The opinion is presented here in its entirety, but with citations omitted. His company was moving mountains to keep its OpRegen dry AMD clinical trial together, and did so despite lockdowns that kept a largely aged patient population from setting foot anywhere near a healthcare clinic. Lineage emerged stronger, signing a collaboration and license agreement with Roche and Genentech later that year. In May of this year, it doubled down on the commitment with a new services agreement with Genentech to support the OpRegen program. All this, while simultaneously progressing its OPC1 spinal cord injury program into Phase 2 and laying the clinical groundwork for programs in hearing loss, vision loss, and neurologic indications. The petitioners claimed that, absent a preliminary hearing, their 14th Amendment rights had been violated. Which Test is it Anyway? Civil Asset Forfeiture and the Right to a Prompt Post-Seizure Hearing at the High Court. The Court will hear argument on Monday, October 30, 2023, in Culley v. Marshall. Petitioners Halima Culley and Lena Sutton contend police seized their vehicles and held those vehicles for more than a year without judicial oversight. The Respondents assert that those vehicles were seized because they were being used to traffic narcotics and then Petitioners sat on their rights. Ultimately, the state court denied the Petitioners a post-seizure hearing based on the Sixth Amendment speedy-trial test of Barker v. Wingo, 407 U.S. 514 (1972). The Petitioners contend the court employed the wrong test and they should have received a prompt post-seizure hearing under the Due Process Clause. Accordingly, the Question Presented in the case is: “In determining whether the Due Process Clause requires a state or local government to provide a post seizure probable cause hearing prior to a statutory judicial forfeiture proceeding and, if so, when such a hearing must take place, should district courts apply the “speedy trial” test employed in United States v. $8,850, 461 U.S. 555 (1983), and Barker v. Many diseases or disorders originate with a loss of cellular function. Cell death or damage is at the root of many problems associated with aging or injury. Brian Culley, CEO of Lineage Cell Therapeutics, discusses how his company has identified ways to generate specific cell types that can functionally replace lost cells in various contexts, restoring function. This Fourth of July week, we're revisiting an episode with Professor Saleema Snow all about this damaging practice. The Supreme Court recently decided to hear a case about civil asset forfeiture—Culley v. Marshall—next term. Professor Saleema Snow is a Professor of Law at the University of the District of Columbia David A. Clarke School of Law and the director of the school's Legal Writing Program. At the time of this recording, she was also the President of Karamah: Muslim Women Lawyers for Human Rights, supporting the rights of Muslim women and children; an elected member of the D.C.
