note from the archivist:Jimmy did not write episode notes for the remaining episodes. However, an explanation is required. umgelenkt. Jimmy wrote these episodes, recorded them, and then began writing a book on WerBell. He wrote expanded the podcast manuscript into a book (and fixed some errors) but was required to stop writing for personal reasons. Jimmy did not stop due to what he found.additional note: There is much, much, much more to the story of the Trot-LaRouche-right-wing ties. There was a gigantic rabbit hole involving Roy Frankhouser. Frankhouser, a paratrooper who appeared to be brainwashed (he reminded Jimmy of McVeigh), infiltrated both Trot orgs and the Klan, and acted as an agent provocateur. Further, to understand this you should read KEN DUGGAN: LAROUCHE'S FAVORITE SATANIST? and The Swarmy Life and Times of the NCLC by Gregory F. Rose and Unity Now! to understand Duggan, Madole, and the bizarre entryist NCLC game being played between the farthest right wing elements, esoteric Nazism, and the fucking LaRouchians. Robert Miles was, or pretended to be from an intergenerational Cathar family and was raised in a White Russian fascist youth group. Jimmy suspects WerBell may have had contact with this group as well. Nearly every episode raised the prospect of a new criminal nexus with whom WerBell interacted. In this episode, Andrea Bopp Stark and Geoffrey Walsh, both staff attorneys at the National Consumer Law Center, discuss their work on fines and fees in bankruptcy case, with a particular focus on their article, Sentenced to a Life of Debt: It Is Time for a Reassessment of How Bankruptcy Law Intersects with Fines and Fees to Keep People in Debt. Geoff and Andrea explain how state and local governments have funded mass incarceration through the imposition of fines and fees in the criminal law arena and how this undermines many of the policy rationales articulated by the Supreme Court in Kelly v. Robinson, which made it much more difficult to discharge criminal justice debt in bankruptcy cases. We discuss possible solutions, including treating this debt like tax debt and why an analogy to tax debt is better than an analogy to student loan debt. Stark and Walsh have published several articles on this topic, including the one we primarily discussed, which is available in the Federal Sentencing Reporter and on the NCLC website. This episode was hosted by Matthew Bruckner, an associate professor at Howard University School of Law. Bruckner is on Twitter at @Prof_Bruckner. Hosted on Acast. See acast.com/privacy for more information.
We first look at NCLC's legislative priorities, which include a 36% national interest rate cap and credit reporting reform, and the prospects for Congressional action. Ms. Saunders then provides NCLC's perspective on areas of potential CFPB regulatory action including overdraft and other fees labeled “junk fees” by the CFPB, earned wage access programs, buy-now-pay later products, income share agreements, the use of artificial intelligence in underwriting and collections, fraud in peer-to-peer payment services, the use of unfairness to challenge non-credit discrimination, and mandatory arbitration. Alan Kaplinsky, Ballard Spahr Senior Counsel, hosts the conversation.
On today's episode, Editor in Chief Sarah Wheeler talks with Chris Clow, the editor of Reverse Mortgage Daily, about the increased volume of reverse mortgages in March and the implications of the Biden administration's 2023 budget on HECM products. If you've ever tried to rent an apartment, accepted a job offer, or been accepted to a university, you likely had to complete a background check. Losing horns if you had to pay for that background check yourself. If you're living in that apartment or working that job, good for you! That means you passed the background check! But many people, for a variety of different reasons beyond their control, might not. Ariel Nelson, Attorney with the National Consumer Law Center, explains all the problems in the industry that has sprung up around background checks and the challenges it creates, especially for certain communities. In the early twentieth century child laborers worked in mills across America. Perhaps your ancestors did too. It's possible. In 1900 more than 1.75 million children aged 10 to 15 were employed. A photo of your ancestor might exist. I'm a big fan of this week's guest, Joe Manning. He finds the photos and connects them with family. In 1908, the National Child Labor Committee hired a photographer named Lewis Hine. He spent more than a decade photographing child workers from New York to the Carolinas to Pittsburgh. He documented the horrific work conditions in which our ancestors labored. The NCLC was trying to end child labor using the images to raise awareness of the issue. Many of Lewis Hines photographs are at LIbrary of Congress. You can search them for free using the link in the show notes. If you had an ancestor who worked as a child, they might be depicted in a photo taken by Hine. In many cases the descriptions and captions that accompany these images are incomplete or don't exist at all. That doesn't deter my guest from piecing together the story and reuniting the past with the present. He's on a mission to identify the children and reunite their descendants with these images. Joe Manning is an amazing photo investigator, but Every so often he asks for my opinion. You can follow his successes on his website, Mornings on Maple Street.com About My Guest: For the past thirteen years, Joe Manning has been identifying some of the more than 5,000 child laborers that were photographed in the early 1900s by Lewis Hine, and then tracking down and interviewing their descendants. So far, he has been successful at telling the stories of more than 300 children. Manning is an author, historian, freelance journalist, poet, and songwriter. He has published two books about the history of North Adams, Massachusetts, and a book of his poetry. A social worker for 30 years, he retired in 1999 to devote his time to his writing career. His Lewis Hine Project has been featured on CBS Evening News and National Public Radio. Manning lives in Florence, Massachusetts. Saunders also discusses the recent Capitol One data breach and what you can do to protect yourself.
Jared gives a review of the 2019 National Chinese Language Conference in San Diego, California, and John & Jared discuss the different stages of learning Chinese. As usual, you’ll get a rant and a rave, including a rant that goes into a unique tangent. Guest interview is with John D’Andrea who began learning Chinese back in the 70’s and teaches Chinese today. The third episode of Unprecedented is absolutely groundbreaking as we speak with the CEOs of the two most recognized robocall tracking indexes in the world– Alex Quilici of YouMail (publisher of the Robocall Index) and Alex Algard of Hiya (publisher of the Robocall Radar.) In a remarkable first-of-its-kind exchange, these CEOs hash out what a robocall really is, how tracking consumer behavior can help us better understand the scale and appropriate response to the robocall epidemic, and how advances in technology and sophisticated algorithms are being leveraged in the private sector to bring an end to this catastrophic robocall rise. We also fact-check the statements made by the NCLC regarding robocall volumes to Congress in an interview recorded the same day the testimony took place. Wow! Dr. Quentin Brisco, DC talks to Dr. Justin Trosclair DC on A Doctor's Perspective Podcast American Black Chiropractic Asc President Dr. Quentin Brisco DC discusses their role and purpose in the chiro community, legislation at NCLC and reasons to join state associations, and the ins and outs of independent contractor positions Perks of being a real independent contractor. Why would you go IC instead of an associate or starting your own clinic? Is it better to do a percent of collections or flat rate of rent? If you have an established independent contracting position and you start a small clinic on the side, how do you determine when to go full time at one or the other? How do you train staff for yourself when they also work for a “main doctor” and are probably paid by the clinic owner? Dr. Brisco does and enjoys auto accident patients. How do you build a referral base with local attorneys? Is Colossus a big thing in his state? Dr. Quentin has been involved with the American Black Chiropractic Association as a student, became the local chapter president soon after he graduated and has now since 2016 become the President of the nationwide association. He discusses the ABCA mission and purpose, how it was started and the conference they hold for continuing education. A major goal is to recruit African Americans to become chiropractors and spread the chiropractic message to the black communities. ABCA is also there for guidance on issues unique to African Americans. Every chiropractic college has a student chapter of ABCA and it serves as a place to fellowship and find mentors from doctors out in the field. What went on at NCLC (national chiropractic leadership conference) in Washington DC? What impact does/ did ABCA have on the event and in nationwide as well as local legislation? One bill was trying to pass legislation for Medicare to cover all services provided by chiropractic… ie: exams and exercise, not just the adjustment. Everyday 10,000 become eligible for Medicare every day until 2023 The other major bill we discuss is getting chiropractic covered for TriCare Military health insurance for the family members as well as the veterans directly. What role could a chiropractor have in a hospital setting? How does an internal medicine, PCP, provider handle all the headaches and back pain that comes into the office and how could that be a great referral source to chiropractors? How do patients get into the pain med cycle and end up with chronic issues that are hard to resolve for chiropractors or worse need surgical intervention? How did the ACA and ABCA join forces to stop one insurance company from denying treatment for headaches? What is Global Billing and how did the state Louisiana Chiropractic Association help fight this injustice? What are the unintentional consequences of insurance companies unfairly paying doctors for services rendered? How does he handle or does he have patients not want to see him because of his skin tone? Taking time off from work was a struggle and FEAR for him, hear the reasons why and how he finally overcame it? His hobby might surprise you: high school football and basketball refereeing. When talking about keeping the relationship love alive, how does networking after hour events and weekend seminars create the most tension? Today's show explores financial innovation through the eyes of one of America's most respected consumer advocates. My guest is Lauren Saunders, Associate Director of the National Consumer Law Center. The NCLC has been active in consumer financial protection for over 40 years. Lauren manages its Washington, DC office and directs its federal legislative and regulatory work on issues like prepaid cards, electronic payments, small dollar loans, credit cards, bank accounts, and consumer protection regulation overall. She also contributes to NCLC legal treatises, including Consumer Banking and Payments Law, Consumer Credit Regulation, and Fair Credit Reporting. Previously she directed the Federal Rights Project of the National Senior Citizens Law Center; was Deputy Director of Litigation at Bet Tzedek Legal Services; and was an associate at Hall & Phillips. She graduated magna cum laude from Harvard Law School and was an Executive Editor of the Harvard Law Review. She holds a Masters' in Public Policy from Harvard's Kennedy School of Government and a B.A., Phi Beta Kappa, from Stanford University. In our conversation, Lauren talks thoughtfully about what worries her about consumer finance today and how she thinks we should address emerging problems. We had a wide-ranging discussion, including about what would happen if traditional payday lending was no longer an option (she'd like a "Goldilocks" approach on loan length). She also discusses her concerns about both easy credit and fast credit; partnering between banks and marketplace lenders; using alternative data in underwriting; and the future of overdraft products as we move toward increasingly fast - and even real-time - payments. For a look into the innovators who were mentioned in the show (and who have been featured as previous guests), check out their websites: Digit, Even, and Simple. Also note Lauren's mention of the American Express-backed movie, Spent. Also .... Time is running out to vote for my SXSW panel! Remember to vote for my panel for SXSW 2017. Going global: I recorded the introduction to this episode from the airport en route to London (I figure if Tim Ferriss can do this - and he inspired me to try pod-casting - I can give it a try). I'm heading to the UK for meetings on progress so far with the regulatory sandbox that was launched this year by the Financial Conduct Authority, to distill some lessons for the United States with our much more fragmented regulatory structure. Two days after I return from London, I'm heading to Fiji for the annual global conference of AFI - the Alliance for Financial Inclusion, which is made up of the financial regulators of the Global South. In November, I'll be speaking at the FinTech forum of the Singapore Monetary Authority - in the portion that will be Asia's first-ever RegTech conference in Asia. And I recently had to turn down invitations to speak in Tokyo and in Shanghai, and to participate in a UN gathering in Tanzania. All of which is to say, financial innovation is global, and so are the global challenges of how to regulate it, and so is Barefoot Innovation. We have listeners throughout the world, and I'll be recording fascinating podcasts on these travels. Watch for widened horizons this fall.
