Trooper Ben is a State Trooper with the Kansas Highway Patrol that has gained a massive following on Twitter over the past 15 years. During this episode, Trooper Ben discusses why being a State Trooper is so rewarding, what a normal shift is like, and how he has used social media to help the community around him.
According to the Kansas Highway Patrol crash log, troopers were pursuing a vehicle driven by 22-year-old Adonis Dailey of Wichita. Dailey's vehicle struck the rear of a semi-trailer then struck the median barrier wall multiple times. Dailey suffered serious injuries but a passenger, 27-year-old Kejuan Shugart of Wichita, died. From the advent of the Federal Motor Carrier Safety Administration's CSA Safety Measurement System in 2010, its shortcomings were well-evident to carriers and baked into its structure. At that time, carriers were laser-focused on equities in scoring, particularly when comparing the way a small carrier's scores moved wildly with very little data input versus the slow climbs and falls with more data on the large-carrier side. As the years have gone by there's been refinement of a sense among critics of the program that the very public nature of the data underpinning what passes for CSA today is its fatal design flaw, with far too many "unintended consequences," in the words of Payne Trucking Safety Director Chris Haney, that have been at best unfair to carriers forced to contend with them on a daily basis. That's inclusive of small fleets and owner-operators, and company drivers to an extent, too, given the increased importance of every violation you could possibly think of, large and small. For today's edition of Overdrive Radio, we're turning back to my February discussion with Haney and CVSA data director Chris Turner, formerly of the Kansas Highway Patrol, to highlight various aspects of the discussion, including Haney's view that, despite efforts to better contextualize publicly available data, too many of those unintended consequences continue to be big problems for carriers. The entire trucking, enforcement and regulator community should do a lot better, both he and Turner contend. Trooper Bush is a graduate of Kansas State University. Tiffany joined the Kansas Highway Patrol in July 2007, where she was stationed in Troop A, the Kansas City Metro. Tiffany has been an FTO to 5 new troopers. Tiffany coached at the training academy for her 10-year anniversary class. Tiffany has been an instructor on our Traffic Stop Team where they teach the recruits how to safely conduct traffic stops and perform felony traffic stops. Tiffany has been a CPST (Child Passenger Safety Technician) since 2007. Tiffany teaches parents almost daily how to install their child's seat or provide seats to those unable to afford one. Tiffany is a certified Level II (2008) and HazMat (2016) for CVSA inspections. Tiffany will be certified this year on cargo tankers. Tiffany was the agency recruiter from 2018 to 2020 before she was selected for the PIO position (again) in October 2020. Tiffany is also on our Mobile Field Force team, as an arrest team member, which is utilized for riots or protests. Kansas Highway Patrol officials followed state law and regulations when dismissing two majors in July 2020. Most KHP staff are classified employees, but senior management (including majors) are unclassified employees. State law and regulations only have a few requirements related to the highway patrol dismissing an unclassified employee. The highway patrol followed applicable requirements.
You read a little about this week's podcast subject last week, likely, with reporting around the Operation Safe Driver Week traffic-enforcement event (focused on motorists as well as professional operators) ongoing as we speak. Namely -- the Level 3 inspection and Kansas Highway Patrol trooper and Public Information Officer Nick Wright, whose advice related to how to prep for an inspection was delivered in this conversation from early March. He and I were talking in the context of the three-day Roadcheck inspection event, then scheduled for early May, where the full Level 1 driver and vehicle inspection is what often enough is the focus of the event. Before it was postponed, though, CVSA had named the theme of the annual event as driver-related violations, from medical certification status to ELDs and hours of service – the things hit on by those Level 3 inspections. That just so happens to also be the inspection level most likely to accompany any roadside stop, which the Operation Safe Driver Week ongoing right now takes as its focus. [related-post id="289339"/]So let's go back in time to early March – the entire state of Kansas had just three confirmed cases of COVID-19, and, as KHP Nick Wright put it, as in my home base in Nashville, nary a bottle of hand sanitizer or roll of toilet paper could be found within a 100-mile radius of almost any city in America ... Along the way, Wright details answers to the following: **What are best practices for annotations of the log in an ELD when errors are made on the drive line, which can't be edited in an ELD? **What's the best inspection-preparation advice he could give a driver beyond what's obvious? **Do states actually run out of those CVSA clean-inspection stickers? Low Bridge Semi Truck Inspection Week - During the week of Aug. 27-31, each state’s commercial motor vehicle law enforcement department may select one day of that week to capture data on rear impact guards, also referred to as underride guards, on trailers and semi-trailers in the United States. As the leading organization devoted to improving commercial motor vehicle (CMV) safety and inspection and enforcement uniformity throughout North America, the Commercial Vehicle Safety Alliance (CVSA) is often asked to weigh in on policies related to safety and enforcement, and to provide guidance to enforcement, industry and policy makers. As a data-driven organization, any decisions to support or oppose an issue must be supported by data analysis and strategic planning. Consequently, the Alliance is collecting information on rear impact guards to be well informed and properly equipped to assess and address rear impact safety requirements on CMVs. The event will also highlight this critical issue for motor carriers and drivers. Trucker stuck under a bridge Last year, the Stop Underrides Act of 2017 was introduced by Senator Kirsten Gillibrand (D-NY) and Senator Marco Rubio (R-FL) to reduce the number of preventable deaths and injuries caused by underride crashes and to improve motor carrier and passenger motor vehicle safety. CVSA received a letter from Senators Gillibrand and Rubio on Feb. 8, 2018, asking the Alliance to consider updating its current North American Standard Out-of-Service Criteria to add rear underride guards. The data collected during the Rear Impact Guard Check safety initiative will be reported to the CVSA Vehicle Committee at the CVSA Annual Conference and Exhibition in Kansas City, Missouri, in September. Based on that data, the committee will make a recommendation to the CVSA Board of Directors on how to proceed with this important issue. “The Alliance uses data to support its decision-making process,” said CVSA President Capt. DOT checking a rig Truck drivers living in the eastern North Carolina city of Rocky Mount will no longer be allowed to park their rigs at their homes, effective Oct. 8, after the passage of an ordinance on July 9. Rocky Mount’s city council adopted an ordinance that bans the parking of commercial vehicles and/or trailers longer than 25 feet or weighing more than 10,000 pounds, which includes Class 3-8 trucks, in residential areas. Also this year’s area of focus for the Commercial Vehicle Safety Alliance’s (CVSA) International Roadcheck (Roadcheck) is hours-of-service (HOS) compliance. The annual enforcement campaign, scheduled June 5-7, 2018, is a 72-hour inspection blitz of commercial motor vehicles (CMV) and drivers in jurisdictions throughout the United States. CVSA-certified CMV inspectors will primarily perform North American Standard Level I Inspections during the event. The procedures for a roadside inspection are the same as any other day of the year, but the likelihood of being stopped for the comprehensive driver and vehicle inspection increases during Roadcheck. CVSA uses the annual event to emphasize a specific category of violations. Roadcheck 2018 will focus on HOS compliance. It was the top reason drivers were placed out of service during last year’s Roadcheck, according to CVSA. The 2018 event allows enforcement a medium by which to educate drivers on the topic. “Although the electronic logging device (ELD) rule that went into effect on Dec. 18, 2017, does not change any of the underlying hours-of-service rules or exceptions, the ELD mandate placed a spotlight on hours-of-service compliance,” said CVSA President Capt.
