However, with hard work, Nigel cleared the CVA a year early. Nigel considers the exit certificate as his single proudest moment as a business owner. He displays the exit certificate in his office as a reminder of his triumph. [31:42] Lessons from Major Adversities Major adversities will change you for the better and teach you the biggest lessons. Doing the right thing and using a values-driven approach to any adversity will create trust between you and your clients. The only way out is through. People have built businesses bigger than themselves by spending time on the right things. Get away from the daily tasks and work on moving the business forward. Mistakes are normal. Just make sure to spend enough time on the things that will make a difference. Mark Hager shares his exciting research on technology adoption in volunteer management. This research was conducted in conjunction with CCVA and focused on CVAs and how they've changed or adopted technology during the pandemic. Mark Hager has been leading the field in research on volunteer management and engagement for years. He has recently released an update on his original Volunteer Management Capacity Study and his new work on Technology Evolution in Volunteer Administration. Gattegno explains how restructuring plans work, in what ways they differ from company voluntary arrangements and the circumstances in which they may be preferable to CVAs as a route out of insolvency. She summarises the arguments put forward by affected landlords challenging the Regis plan, and outlines the court's key findings.

The frequency of CVAs is reasonably low when compared with alternative corporate Insolvency Act 1986 procedures1 and it has been commented that CVAs have a high failure rate. The research project aims to identify ‘successful’ and ‘failed’ CVAs and by doing so, identify key characteristics which will in turn allow practical guidance to be provided to insolvency practitioners (“IPs”) and also inform policy recommendations to Government.

EG's deputy legal editor, Jess Harrold, joins Julie Gattegno, partner at CMS, to discuss the High Court challenge to the Debenhams CVA in Discovery (Northampton) Ltd and others v Debenhams Retail Ltd and others [2019] EWHC 2441 (Ch); [2019] PLSCS 186. Gattegno offers detailed analysis of each of the five grounds pursued by the landlords in the case, and how the judge dealt with each. She explains how much clarity the decision has brought to the law in the current high street climate, addresses what ground remains for other landlords to challenge retail CVAs - and considers whether more needs to be done to strike a fair balance between the competing interests of struggling retailers and their landlords.
