In 2011, V made a fanwork map of the fictional country of Panem from The Hunger Games novels -- not the movies, which had not even been officially announced yet -- and in 2023, Lionsgate released an official map of Panem that looks... extremely similar. On this episode, we introduce you to OTW communication staffer Claudia Rebaza as we delve into the history of OTW and the importance of having an archive like AO3 that both acts as host for fanworks but also fosters a community for creators. We talk with Claudia about the changing nature of online spaces and the way fans adapt to allow their creative pieces flourish and remain legally protected. In this episode, Heidi Tandy, of counsel and intellectual property department chair at Price Benowitz LLP and legal committee member of the Organization for Transformative Works, discusses her work on the relationship between fanworks and intellectual property rights, as well as her draft article "Can You Tarnish Voldemort?: An Examination of the Intersection of Fanworks, Trademarks and Fair Use." Tandy describes the long history of fanworks and how they reflect the creativity of fan communities. Among other things, she explains how changes in copyright law have emphasized the right of fan communities to create fanworks, and how the relationship between copyright and trademark owners and fan communities has developed over time. In the eighth episode of Copy This, Kirby sits down with Betsy Rosenblatt, legal chair for the Organization for Transformative Works (OTW), and Sherlock Holmes superfan. Released as OTW and the Re:Create Coalition head to Comic-Con International in San Diego, Betsy points out during the discussion that almost everything that happens at Comic-Con relies on fair use, even taking a photo and posting it online. But another aspect of Comic-Con that relies heavily on copyright law is the concept of fanworks, new creations based on existing creations. Fanworks are produced and written by fans of popular books, movies, and tv shows. Franchises like Star Wars and Harry Potter have been transformed into works of fan fiction. In addition, fanworks go way beyond fan fiction and can include art, games, video montages, cosplay. Even dressing up as Batman or Wonder Woman for Halloween or baking a Mickey Mouse birthday cake count as fanworks. As OTW celebrates its 10th anniversary, Betsy discusses the vast range that fanworks can take, the profound impact the internet has had on fanworks, and why she works with OTW to fight back against Hollywood studios to advocate for fanworks as fair use.
