“The goal was to work at a record store and then everybody eventually wanted to work for a label. I envied the label guys and then I went and married one.” If the name Betsy Altomare sounds a bit familiar, there's a reason for that. Back on episode number 33 we interviewed her husband Keith Altomare, who told us how he and Betsy met while she was the Night Manager at Tower Records Sunset in Los Angeles. Today we get to hear Betsy's side of this story. Before signing on at Tower, Betsy previously worked at three LA record stores and a courier service that dealt primarily within the music industry. So when she applied and was hired under Bob Delanoy, Betsy came to the job armed with a lot of knowledge. Working at Store #131 she worked with veterans Joel Abrahmson, Howard Krumholtz, Store Managers Debbie Pollay and later Dennis Lefler. Oh yeah, she also worked with one guy named Axl and one guy named Slash. More on that in the podcast. Betsy tells us about some of her memorable customers including Elton John, Bernie Taupin, Bruce Springsteen and Rick James. Now the owner of a movie theatre in Orgeon, Betsy tells us about some of the similarities and differences between both businesses.

Some people thought it was edgy (was it?) while others took offense to the original tweet and some of the brand's replies, particularly one that quipped, “Ask your mom” when someone compared the taste of ass to Pabst Blue Ribbon beer.

Bão lũ, khô hạn, cháy rừng, nước biển dâng… Các hiện tượng thời tiết bất thường xảy ra nhiều hơn, quy mô lớn hơn. Nguyên nhân chính: Khí hậu bị hâm nóng. Cộng đồng quốc tế đã đạt thỏa thuận hạn chế khí thải, để giữ nhiệt độ Trái đất không tăng quá 2°C. Thế nhưng, khoảng cách giữa cam kết và hành động hết sức lớn. Vấn đề công lý khí hậu ngày càng đặt ra khẩn thiết, trước hết với các nhóm xã hội yếu thế, nước nghèo, nạn nhân hàng đầu của biến đổi khí hậu. Ngày càng nhiều vụ kiện khí hậu   Nói đến công lý về khí hậu chắc chắn không thể bỏ qua khía cạnh pháp lý. Một nghiên cứu về các vụ kiện tụng liên quan đến khí hậu từ năm 1990 đến 2019, của London School of Economics and Political Science, đưa ra một tổng kết đáng chú ý. Trong khoảng thời gian nói trên, có ít nhất 1.328 vụ kiện liên quan đến khí hậu, tại 28 quốc gia trong đó hơn 3 phần 4 số vụ kiện là tại Hoa Kỳ (báo cáo « Global Trends in Climate Change Litigation: 2019 Snapshot » của J. Setzer và R. Byrnes). Bản báo cáo ghi nhận đại đa số vụ kiện khởi sự sau năm 2006, và ngày càng có nhiều vụ kiện tại các quốc gia có thu nhập trung bình hay thấp, như Pakistan hoặc Ouganda. Đa số các vụ kiện nhắm vào chính quyền các nước, nhưng các doanh nghiệp cũng là đối tượng bị đưa ra tòa. Theo chuyên gia về luật môi trường quốc tế Sandrine Maljean-Dubois (CNRS), « xã hội dân sự nhận thấy là các vấn đề môi trường chưa bao giờ lại trở nên dữ dội, nghiêm trọng và cấp thiết đến như vậy, trong lúc chính quyền các nước lại không đưa ra được các biện pháp đối phó…. Xã hội dân sự hướng sang các tòa án quốc gia, chủ yếu để yêu cầu chính quyền các nước và các doanh nghiệp phải đề ra các mục tiêu về khí hậu ở tầm mức tương xứng với hiểm họa ». Trong lịch sử đòi công lý khí hậu của xã hội dân sự thế giới, vụ hiệp hội Urgenda thắng kiện chính quyền Hà Lan năm 2019 có ý nghĩa đặc biệt quan trọng. Vụ án lịch sử : Urgenda thắng kiện Nhà nước Hà Lan Năm 2013, hiệp hội Urgenda, một tổ chức phi chính phủ tranh đấu cho phát triển bền vững tại Hà Lan khởi sự vụ kiện nhắm vào chính phủ Hà Lan, sau khi đề nghị chính quyền cam kết cắt giảm 25% khí thải vào năm 2020 (so với mức phát thải 1990) đã không được đáp ứng. Năm 2015, một tòa án sơ thẩm La Haye ra phán quyết buộc chính quyền thực hiện đòi hỏi của nguyên đơn. Chính quyền Hà Lan khiếu nại. Năm 2018, một tòa phúc thẩm ở La Haye đã ra phán quyết bác khiếu nại của chính quyền Hà Lan. Phán quyết phúc thẩm dựa trên các nghĩa vụ của chish quyền Hà Lan, được quy định bởi Công ước Khung của Liên Hiệp Quốc về biến đổi khí hậu (CCNUCC) và Thỏa thuận Khí hậu Paris 2015, mà Hà Lan tham gia. Tháng 12/2019, Tòa án Tối cao Hà Lan ra phán quyết cuối cùng. Phán quyết chỉ rõ chính quyền Hà Lan đã hành động bất hợp pháp, khi không bảo vệ các quyền của công dân theo Công ước Nhân quyền châu Âu. Trả lời đài France Culture, luật gia Marta Torre-Schaub, phụ trách nhóm nghiên cứu ClimaLex, giảng viên Viện nghiên cứu pháp lý và triết học, đại học Sorbonne Paris 1, giám đốc nghiên cứu thuộc Trung tâm Nghiên cứu Khoa học Quốc gia (CNRS), nhận xét về ý nghĩa của vụ thắng kiện này : « Lần đầu tiên một quốc gia bị kết án do không làm tròn trách nhiệm đối với môi trường, nhân danh nguyên tắc Nhà nước phải có trách nhiệm với công dân trong lĩnh vực môi trường (duty of care). Điều khoản pháp lý liên quan, vốn đã có từ trong luật quốc tế, đã được nội luật hóa, đưa vào luật dân sự Hà Lan. Tòa Án Tối Cao Hà Lan buộc chính quyền phải thực hiện các mục tiêu cắt giảm khí thải, theo đòi hỏi của hiệp hội Urgenda. Vụ kiện này trở thành một mẫu mực cho phong trào tranh đấu vì môi trường tại Hoa Kỳ, cũng như tại Pháp ».  Theo giới chuyên gia, phán quyết lịch sử của tòa án Hà Lan trong vụ Urgenda đã đưa ra « nhiều khái niệm pháp lý mang tính cách tân », như quyền của các thế hệ tương lai, hay vấn đề điều chỉnh pháp lý đối với các hành động trong tương lai, mang tính dự báo và phòng ngừa (về vấn đề quy phạm pháp lý mang tính dự báo, phòng ngừa, điều chỉnh các hành động tương lai, chúng tôi sẽ trình bày rõ hơn trong phần tiếp theo). Nhìn chung, vụ án Urgenda đã mang lại nhiều cảm hứng và kinh nghiệm cho các nỗ lực của xã hội dân sự khởi kiện Nhà nước nhiều quốc gia ra tòa, do (đã không có hoặc không dự kiến) hành động để ngăn chặn khí thải gây hiệu ứng nhà kính khiến Trái đất bị hâm nóng. Vai trò của giới thẩm phán ngày càng nổi bật   Mới đây, ngày 31/07/2020, chính quyền Ailen đã bị Tòa Án Tối Cao nước này yêu cầu điều chỉnh lại chính sách cắt giảm khí thải chống hâm nóng khí hậu. Tại Pháp, cuối năm 2018, bốn tổ chức thuộc xã hội dân sự đã khởi kiện Nhà nước Pháp về cùng một vấn đề. Vụ kiện được những người khởi sự đặt một cái tên đầy ấn tượng « Affaire du siècle / Vụ kiện thế kỉ ». Tư pháp nước Pháp sẽ đưa ra phán quyết đầu tiên về vụ kiện vào mùa thu này. Việc công bố các phán quyết về khí hậu  nói trên mang ý nghĩa biểu tượng cao, có giá trị như các mẫu mực, khiến chính quyền nhiều nước hay các doanh nghiệp là thủ phạm phát thải phải dè chừng. Theo chuyên gia về luật môi trường quốc tế Sandrine Maljean-Dubois, phán quyết là chuyện nội bộ của từng quốc gia, nhưng rõ ràng là « các thẩm phán theo dõi sát hoạt động của đồng nghiệp nước khác, và phán quyết của tư pháp tại một nước này có thể ảnh hưởng đến phán quyết của tư pháp tại một nước khác ». Trong những năm gần đây, giới quan sát có ấn tượng là quyền lực của giới thẩm phán trong vấn đề khí hậu tăng lên rõ rệt. Nhiều người đặt câu hỏi là liệu họ có được trao thêm các thẩm quyền mới, để tăng cường việc thực thi pháp luật hay không ? Về vấn đề này, luật gia về môi trường Marta Torre-Schaub, Viện Khoa học Pháp lý và Chính trị Pháp (CNRS), nhận định :  « Có thể chúng ta thấy chuyện này là mới, nhưng vai trò của các thẩm phán rút cục phải chăng không phải chính là thực thi luật pháp đã có, mà không cần phải sáng tạo ra điều gì mới. Khẳng định những gì đã được những nhà lãnh đạo hay các nhà lập pháp đề ra. Ớ đây, tôi cho rằng không có gì mang tính cách mạng cả. Tuy nhiên, mặt khác, chính cuộc khủng hoảng về sinh thái, môi trường - với tình trạng khẩn cấp về khí hậu được ban hành tại nhiều quốc gia hiện nay, tại Anh và tại Pháp mới đây – đã đánh thức quyền lực vốn có của các thẩm phán, và khiến quyền lực tư pháp trở nên mạnh hơn ».   Luật pháp mang tính phòng ngừa Về các biến chuyển lớn trong lĩnh vực pháp lý khí hậu,luật gia về môi trường Marta Torre-Schaub (CNRS) đặc biệt chú ý đến một điểm mà bà coi là rất mới, đó là việc các thẩm phán ngày càng hướng sang cách diễn giải luật nhằm điều chỉnh các hành động trong tương lai, bên cạnh tiếp cận truyền thống, trừng phạt và đòi hỏi bồi thường đối với các hành động vi phạm luật đã xảy ra. « Kể từ vụ án Urgenda, tôi có nhận xét là đã xuất hiện một cách diễn giải luật mà tôi gọi là ''mang tính tiệm tiến'' và uyển chuyển. Ở đây chúng ta có một thứ luật pháp gần với đời sống. Cụ thể là bản thân khái niệm về ''trách nhiệm'' nói chung với vấn đề môi trường, và cuộc khủng hoảng sinh thái mà chúng ta đang đối mặt hiện nay, chắc chắn là cũng đang quá trình thay đổi. Chúng ta không thể chỉ tự giới hạn duy nhất trong phương diện luật pháp liên quan đến các hành động sai lầm, đến việc trừng phạt hay đòi bồi hoàn về những hành động đã gây ra hậu quả. Điều mới mẻ ở đây là luật pháp liên quan cả đến việc phòng ngừa… cho phép điều chỉnh cả các hành động sẽ xẩy ra trong tương lai, để tránh cho chúng ta phải gánh chịu các thảm họa kinh hoàng, một thế giới mà nhiệt độ cao hơn từ 3°C đến 4°C, khiến Trái đất không còn là nơi con người có thể sống nổi ».  Luật gia về môi trường Marta Torre-Schaub cũng nhấn mạnh đến việc các thẩm phán hiện nay có xu hướng sử dụng chính các kết quả nghiên cứu khoa học được nguyên đơn sử dụng làm cơ sở cho các khiếu kiện, làm luận cứ để buộc chính quyền nhiều nước phải chấp hành, cụ thể như trong vụ án Urgenda. Ranh giới giữa pháp lý và chính trị Vụ Urgenda thắng kiện Nhà nước Hà Lan và một số vụ thắng kiện khác trong lĩnh vực đòi công lý khí hậu gây phấn khích. Nhiều người hy vọng là các áp lực pháp lý sẽ buộc chính quyền các nước phải có hành động tương thích với hiểm họa khí hậu. Tuy nhiên, nỗ lực đòi công lý khí hậu về mặt pháp lý có nhiều giới hạn. Liên quan đến quyền lực của các thẩm phán, luật gia về môi trường Marta Torre-Schaub đặc biệt lưu ý đến việc phân định thẩm quyền của tư pháp và lĩnh vực chính trị : « Quả đúng là trong các phiên tòa về khí hậu, việc thảo luận về bên nào có quyền hạn gì mỗi lần lại được đưa ra. Trong vụ án Urgenda, ở cả ba cấp xét xử - sơ thẩm, phúc thẩm và giám đốc thẩm - mỗi lần như vậy, vấn đề thẩm quyền đều được đặt ra. Cụ thể là, nếu vấn đề khí hậu được đề cập thuộc lĩnh vực chính trị, thì các thẩm phán không thể can thiệp. Ngược lại, nếu đây là vấn đề thuộc tư pháp, thì các thẩm phán có thể can thiệp, bởi đây là việc giải thích luật và thi hành luật. Việc phân định ranh giới giữa vấn đề chính trị với vấn đề pháp lý - tư pháp là điều rất đáng quan tâm trong các vụ án khí hậu ». Vụ kiện Juliana – tức vụ 21 thanh thiếu niên Mỹ bang Orgeon (tuổi từ 10 đến 21) kiện chính quyền Liên bang Hoa Kỳ - là một ví dụ tiêu biểu. Vụ kiện được thẩm phán liên bang tại Oregon thụ lý năm 2016. Theo đơn kiện của 21 thanh thiếu niên, chính quyền liên bang đã không thực thi bổn phận bảo vệ họ khỏi biến đổi khí hậu. Bên nguyên đơn dựa trên quyền căn bản là quyền được hưởng « một khí hậu thuận lợi cho sự sống ». Tháng Giêng năm nay 2020, tòa án phúc thẩm tại San Francisco đã bác đơn khiếu kiện, cho dù thừa nhận là các thanh thiếu niên bên nguyên đơn « đã đưa ra được các bằng chứng thuyết phục », và « chính quyền liên bang trong một thời gian dài đã khuyến khích việc sử dụng các nguồn năng lượng hóa thạch, cho dù biết rằng điều này có thể gây ra các biến đổi khí hậu kinh hoàng ». Tòa phúc thẩm San Francisco nhấn mạnh là điều mà 21 thanh thiếu niên Mỹ đòi hỏi là nằm trong lĩnh vực hành động vì khí hậu thuộc « các nhánh chính trị của Nhà nước » phụ trách (chứ không thuộc lĩnh vực tư pháp). Lĩnh vực chính trị có nghĩa là do Quốc Hội và tổng thống chịu trách nhiệm. Theo luật gia về môi trường Marta Torre-Schaub, các thẩm phán có quyền ra phán quyết buộc chính quyền các nước thực thi các nghĩa vụ về khí hậu, nhưng không có thẩm quyền buộc chính phủ các nước phải chọn các biện pháp cụ thể nào. Trong lĩnh vực công lý khí hậu, có những bất công nổi rõ được đông đảo công chúng biết đến. Nhóm 1% người giầu nhất hành tinh chịu trách nhiệm về khí thải gây hiệu ứng nhà kính gấp 175 lần so với 10% người nghèo nhất. Trong lúc đó, chính những người nghèo nhất lại là các nạn nhân đầu tiên của biến đổi khí hậu (ví dụ như : 91% nông dân Mỹ có bảo hiểm thiệt hại trong trường hợp thiên tai, trong khi số người được bảo hiểm ở Ấn Độ chỉ là 15%). Chưa kể đến bất công lớn, biến đổi khí hậu làm trầm trọng hơn tình hình vốn đã khó khăn nghiêm trọng tại nhiều quốc gia nghèo, do hạn hán, lũ lụt, thiếu nước sạch, nước biển dâng cao… Không có công lý khí hậu, nếu không giải quyết bất công xã hội Việc phân chia gánh nặng đóng góp không công bằng giữa các nhóm xã hội trong cùng một quốc gia cũng là một vấn đề lớn. Kinh tế gia Mỹ James K. Boyce, chuyên về các vấn đề môi trường khí hậu, ghi nhận cuộc khủng hoảng « Áo Vàng » (phong trào chống lại thuế cac-bon đánh vào người có thu nhập thấp) tại Pháp để lại một bài học quan trọng. Đó là việc đánh thuế cac-bon để có tiền cho cuộc chiến khí hậu sẽ không thể thành công, nếu không tính đến tính chất công bằng xã hội của biện pháp này. Vấn đề công lý khí hậu ở đây vượt quá khỏi phạm vi tư pháp. Để hướng đến các biện pháp về khí hậu, chính quyền của tổng thống Pháp Emmanuel Macron đã triệu tập Hội nghị Công dân về Khí hậu (Convention Citoyenne pour le Climat - CCC) để tìm giải pháp thông qua con đường lập pháp, trưng cầu dân ý. Chính quyền nhiều nước châu Âu và bản thân Liên Hiệp Châu Âu (Ủy Ban Châu Âu và Nghị Viện Châu Âu) cũng có những nỗ lực nâng cao các cam kết về khí hậu, cũng như gia tăng các biện pháp thực thi. Trên con đường thực thi bổn phận này, các định chế châu Âu cũng như các quốc gia thành viên Liên Âu, hay nhiều nước khác, sẽ còn liên tục phải đối mặt với các thách thức pháp lý từ phía xã hội dân sự.  Vụ 6 thanh thiếu nhi Bồ Đào Nha (từ 8 đến 21 tuổi) khởi kiện 33 quốc gia châu Âu lên Tòa án Nhân quyền châu Âu hôm 03/09/2020 là một ví dụ tiêu biểu mới nhất. 33 quốc gia, trong đó có Pháp cùng nhiều quốc gia thành viên Liên Âu, và Nga, Na Uy, Thụy Sĩ, Anh quốc… bị cáo buộc đã làm cho khủng hoảng khí hậu thêm trầm trọng.

My guest today is Shorney Douet. Shorney is a high school buddy of mine where we played football together. Following high school, Shorney attended Allegheny College and played football for two years before transfering to Penn State. Shorney has done whatever it has taken to get into the sports world and has an incredible story of perseverance to get to where he is today: An equipment assistant for the Miami Dolphins. He has worked with the Orgeon and Penn State Football programs as well as the Kansas City Chiefs prior to his current position with the Dolphins. In the episode we discuss Shorney's journey to where he is today, his future goals, and advice for others in order for them to reach their dreams!
