Primavera is the author of the book “Blockchain and the Law,” published in 2018 by Harvard University Press (co-authored with Aaron Wright).Primavera led a collective effort during Zuzalu (Vitalik Buterin's pop-up village in Montenegro) to offer an alternative to Balaji Srinivasan's "The Network State".Her main critiques are its overreliance on market- and exit-based approaches.This conversation highlights the differences, but Primavera cautions that there are more commonalities between these different approaches than differences. Most importantly, they share the goal to experiment with governance and approaches to sovereignty to improve on failures of the private and public sectors.We start by defining the problem of the tragedy of the commons: individually rational behavior can lead to collectively worse outcomes. There are three approaches to overcome the problem: a) the Leviathan approach where a public authority manages the commonsb) the market-based approach with defined property rights and tradec) the polycentric governance approachThe last one was developed by Vincent and Elinor Ostrom (the latter receiving a Nobel Price for her work) and is the starting point of Primavera's approach.Niklas has more confidence in market-based solutions than Primavera, so a fruitful discussion ensues discussion the potential pros and cons of these approaches.Both discussants agree that pluralism is the right way forward, trying out different approaches to solve issues such as climate change, immigration, or poverty.The Coordi-Nations approach is encapsulated in a recent blog article, but it's just at the beginning of being formulated and will be discussed in future iterations of Zuzalu and within Ethereum/web3 and governance innovation circles.

NEW SERIES: Overthrowing the Network State in collaboration with BlockchaingovIn the first episode of our series 'Overthrowing The Network State' (OTNS), we dive into the world of Balaji Srinivasan's recent book The Network State. The purpose of this series is to critique The Network State while also pulling out the salvageable parts and concepts in discussion with a variety of guests. We are overall critical of Balaji's specific ideas in the book, but we want to discuss it with intellectual honesty and highlight the larger concepts around how these technologies are and could subvert state structures. For this episode I'm joined by Primavera De Filippi (@yaoeo), a long time researcher on blockchain and the director of Blockchaingov as a co-host. We give a brief overview of who Balaji Srinivasan is, some of the main concepts in his book, our initial criticisms, and some alternative book recommendations. By OTNS we don't want to only provide critique, but we want to provide a very different conceptual framework that answers why people people seem to be tapping into the book. For us this is about exit-based governance (lack of politics with an idealistic view of autonomy ) vs. commons-based governance (which recognizes the inherent ‘interdependence' of the world and global society).Blockchaingov is a 5-year long, transdisciplinary research effort aimed at restoring trust in institutions at the community and global levels, by promoting better on chain and off chain distributed governance practices. Nous débutons avec l'actualité de la semaine, la vente des NFT de Murat PAK qui a fait un drop sur la plateforme NiftyGateway, la plus célèbre marketplace de NFT. La vente a rapporté 90 millions de dollars, un nouveau record de vente pour un artiste vivant. Avec Murat PAK on est toujours entouré d'énigmes et de mystère. Nul ne connaît l'identité réelle de la personne qui se cache derrière cet avatar. Murat PAK propose des NFT qui sont toujours à la frontière de l'art, entre expérimentation mathématique et énigme ludique. Pour gagner les NFT, PAK crée toujours des mélanges de jeux de pistes, de chasses au trésor, ou encore des indices qu'il faut identifier.Ce projet NFT s'appelle MERGE. L'invitée du jour est Primavera de Filippi, elle est une chercheuse au CNRS et à HARVARD. Pionnière sur les technologies Blockchain et artiste expérimentale. Elle nous parle de son implication très forte dans les problématiques juridiques concernant la blockchain et de la création de son réseau appelé COALA. Il s'agit d'un réseau, d'une communauté, appelé à réfléchir les aspects techniques et juridiques de ces nouvelles technologies. Primavera aborde le sujet de son œuvre d'art la plus célèbre appelée « La Plantoïde ».Il s'agit d'une forme de vie crée sur la blockchain. Comme toute autre forme de vie, la plantoïde est une entité autonome, auto-suffisante, et capable de se reproduire. Les plantes traditionnelles ont souvent besoin de l'aide de parties tierces, comme par exemple les papillons ou les abeilles, qui vont les aider dans le processus de pollinisation. La plantoïde a elle aussi besoin de l'aide de parties tierces : les humains, principalement, qui vont les aider dans le processus de capitalisation—pendant artificiel de la pollinisation. De la même façon que les plantes se font belles pour attirer les abeilles, les plantoïdes se font belles pour attirer les humains, pour les inspirer, et les appeler à faire des donations. Les donations se font sous la forme de bitcoins. Chaque plantoïde a son compte bitcoin et peut donc recevoir ces donations.Primavera nous incite à découvrir une de ses plantoides à Paris le 22 décembre à l'occasion du meet-up NFTParis. Primavera is interested in how the law will change to accommodate blockchain — and how blockchain might replace parts of the law. We’ve already seen how P2P filesharing strained the world’s copyright law: what changes will be ushered in by P2P money? We discuss the future of blockchain-based technologies, and whether decentral systems are doomed to create new incumbents and new forms of centralisation; whether (and how) forking could be a solution against this ‘re-centralisation’; and how Ethereum’s smart contracts may have a fatal flaw that the philosophy of law already knows about. Primavera De Filippi is a permanent researcher at the National Center of Scientific Research (CNRS) in Paris, a faculty associate at the Berkman-Klein Center for Internet & Society at Harvard University, and a Visiting Fellow at the Robert Schuman Centre for Advanced Studies at the European University Institute. Primavera De Filippi is a permanent researcher at the National Center of Scientific Research (CNRS) in Paris. She is faculty associate at the Berkman Center for Internet & Society at Harvard Law School, where she is investigating the concept of "governance-by-design" as it relates to online distributed architectures. Most of her research focuses on the legal challenges raised, and faced by emergent decentralized technologies —such as Bitcoin, Ethereum and other blockchain-based applications —and how these technologies could be used to design new governance models capable of supporting large-scale decentralized collaboration and more participatory decision-making. Primavera obtained a Master degree in Business & Administration from the Bocconi University of Milan, and a Master degree in Intellectual Property Law at the Queen Mary University of London. Primavera is involved in several organizations dedicated to promoting the free culture and open data. She is the co-author of Blockchain and the Law: The Rule of Code, which comes out in April and explores the regulation of cryptocurrencies, smart contracts, ICOs and distributed autonomous organisations.
