The 2017 film The Man Who Invented Christmas, starring human treasure Dan Stevens as Charles Dickens, is a lovely bit of an anachronistic historical revisionism (though, to be fair, it gets a number of things right both in fact and in, pardon the pun, spirit). But it also perpetuates an increasingly popular myth - that Charles Dickens...well...invented Christmas. At least, that is, Christmas as we think of it today. There are a lot of reasons why this seems true, and, yes, Dicken's A Christmas Carol played an enormous role in a Victorian revival and redefining of Christmas - but that revival was happening with him or without him. So we decided to take a closer look at Victorian society in the 1940s and exam how religious - or not - Dickens and A Christmas Carol actually were. Kelly and John invited Victorianist ⁠Kristen Hanley Cardozo⁠ to share some of her expertise and talk about spirits, Scrooges, and the real reasons for the season.

Que palavras, documentos e métodos utilizar para pensar a sonoridade dos espetáculos? O projeto “Arquivos Sonoros de Teatro”, implementado em outubro de 2023 no Centro de Documentação Teatral da USP com auxílio da FAPESP (2022/15032-4), responde a essas necessidades básicas para a pesquisa sonora em artes cênicas. Pour en parler, Alexis Buisson, correspondant de La Croix à New York, s'est entretenu avec Michel Rosenfeld, constitutionnaliste à l'école de droit Cardozo, dans l'état de New York.La Constitution régit les États-Unis depuis la fin du XVIIIe siècle, un record de longévité pour une démocratie moderne. Aujourd'hui, le texte est confronté au défi de Donald Trump. Le républicain ne cache pas son intention de remettre en cause son contenu. Dès le début de sa présidence, il a signé un décret censé revenir sur le droit du sol, principe pourtant écrit noir sur blanc dans le texte.Son gouvernement a ignoré les décisions de certains juges fédéraux, chargés du contrôle de constitutionnalité, et les prérogatives du Congrès, au détriment de l'architecture des contre-pouvoirs imaginée par les Pères fondateurs.Ses détracteurs l'accusent aussi de bafouer le premier amendement sur la liberté d'expression et de s'arroger des pouvoirs extraordinaires en s'appuyant sur des lois d'exceptions militaires et économiques pour répondre à des crises qu'il amplifie. Enfin, il laisse entendre qu'il pourrait se présenter pour un troisième mandat alors que la constitution stipule que ce n'est pas possible.Quelle est sa stratégie ? Mars 2018. La mission de la Croix-Rouge a été un succès. 95% des soldats ont pu être identifiés. Geoffrey Cardozo et Julio Aro sont nominés pour le prix Nobel de la paix par une université argentine. Deux avions quittent Buenos Aires avec à bord des centaines de membres des familles des disparus, en direction des Falklands selon la dénomination britannique. Au cimetière, que beaucoup découvrent pour la première fois, presque toutes les tombes portent enfin des noms. C'est un très grand moment d'émotion pour tous. Geoffrey Cardozo qui n'a cessé de penser à la douleur des mères, voit l'aboutissement d'une mission.   Avec Julio Aro ancien combattant argentin, Gaby Cociffi, journaliste argentine, le docteur Morris Tidball-Binz de la Croix Rouge internationale et la voix de Jorge Luis Borges lisant un de ses poèmes.   Une enquête d'Anne Brunswic en collaboration avec Yvan Amar. Entre avril et juin 1982, l'Argentine et le Royaume-Uni se sont affrontés pour la souveraineté sur quelques îles de l'Atlantique-Sud dans un conflit armé intense qui a surpris le monde entier. C'est la Guerre des Malouines, une guerre qui a vite sombré dans l'oubli – ses 900 morts, dont 649 Argentins, avec elle. Après sa défaite, la junte militaire a abandonné ses soldats tués sur le champ de bataille et a laissé aux Britanniques la responsabilité de s'en occuper selon la convention de Genève. Un jeune capitaine britannique s'est chargé de leur donner une sépulture digne. Le hasard lui a fait rencontrer 25 ans plus tard un ancien combattant argentin. Ensemble, pour le bien des vivants et des morts, ils ont accompli une œuvre de paix unique en son genre. Geoffrey Cardozo, le jeune capitaine anglais qui a bâti le cimetière pour les Argentins en 1983 est aujourd'hui un colonel à la retraite âgé de 73 ans. Il a confié à deux journalistes français, Anne Brunswic et Yvan Amar, cette histoire de guerre et de paix pleine de rebondissements qui s'étend sur près de 40 ans. Le capitaine Cardozo, 32 ans, arrive aux îles Malouines juste après la fin des combats. Météo glaciale et paysages dévastés. On lui signale la présence de corps argentins sur des champs de bataille minés. Au fil des semaines, deux-cent-quarante dépouilles sont localisées, des jeunes de moins de 20 ans. Geoffrey dit « Jeff » s'efforce de préserver les corps et de les identifier en pensant à la douleur de leurs mères. Une enquête d'Anne Brunswic en collaboration avec Yvan Amar.

Il faudra plus de 8 ans pour surmonter d'innombrables obstacles politiques, diplomatiques, psychologiques et techniques. Durant ce long combat, Cardozo est obligé de rester dans l'ombre en Europe mais Julio trouve à Buenos Aires une alliée de poids, la journaliste vedette Gaby Cociffi. Avec Julio Aro qui soutient les vétérans argentins et leurs familles à travers la fondation No me olvides et Gaby Cociffi, journaliste argentine aujourd'hui retraitée. En 2016, Geoffrey Cardozo a 66 ans. Désormais entièrement libre de ses mouvements, il se rend pour la première fois en Argentine. Son but est de rencontrer les familles des soldats inconnus et de convaincre les plus hésitantes de donner des échantillons d'ADN. A son retour en Europe, il est contacté par Morris Tidball-Binz, un médecin légiste qui se présente au nom de la Croix Rouge Internationale à Genève. Cardozo bondit de joie. L'organisation de la mission d'identification requiert beaucoup de compétence de de diplomatie. En juin 2017, elle est à pied d'œuvre. Cardozo la rejoint aux Malouines et 35 ans après la guerre, il retrouve « son » cimetière. Avec le docteur Morris Tidball-Binz, médecin légiste expert en identification sur les théâtres de guerre, chef de mission de la Croix-Rouge internationale. To establish a prima facie case of negligence, a plaintiff must prove duty, breach, causation (both actual and proximate), and damages. These four elements demonstrate that the defendant had an obligation, failed to meet that obligation, and that failure directly and foreseeably caused the plaintiff to suffer actual harm.The Cardozo view of duty, primarily from Palsgraf, holds that a defendant only owes a duty to those persons within the zone of foreseeable harm resulting from their conduct. In contrast, the Andrews view argues that a duty is owed to everyone if the defendant's conduct creates a general risk of harm, regardless of direct foreseeability.A professional, such as a doctor, is held to the standard of care of a reasonably prudent member of their profession under similar circumstances. This objective standard considers the knowledge, skill, and care ordinarily possessed and exercised by professionals in that particular field or specialty.Res ipsa loquitur, meaning "the thing speaks for itself," allows a jury to infer negligence when the event is of a type that ordinarily does not occur without negligence, the instrumentality causing the harm was in the defendant's exclusive control, and the injury was not due to the plaintiff's own action. For this doctrine to apply, the plaintiff must be within the protected class, and the harm suffered must be of the type the statute intended to prevent.Generally, there is no legal duty to affirmatively act or rescue someone in peril, even if it can be done safely. However, an exception exists when there is a special relationship between the parties, such as a parent and child or a common carrier and its passengers, which creates a duty to take reasonable steps to aid the other.A landowner owes a licensee a duty to warn them of known dangers on the property that are not obvious. However, the landowner has no duty to inspect for unknown dangers or to make the premises safe for the licensee.Under pure comparative negligence, a plaintiff's recovery is reduced by the percentage of their own fault, regardless of how high that percentage is. The two hired killers, an accomplice and Adelson's son, Charlie Adelson, have all been convicted on murder charges in the years since. #BestGuests: R.
