Hello everyone! As  promised we have just published episode two and episode three of our three part interview series with Doug Horne and you can find all three episodes over at JFK The Enduring Secret YouTube channel  Doug Horne is an iconic figure in the area of JFK research and investigation. His courageous work while at the Assassination Records Review Board has proven to be one of the most important contributions to the understanding of JFK autopsy evidence. I first met Doug in November 2023, during the week of the 60th anniversary of the assassination. His presentations in Pittsburgh at Duquesne University were Illuminating. After his absence for a time from the more active JFK research community, we were all delighted at seeing him return to engage once again. Fast forward to November 2024, and Doug and I once again crossed paths in Dallas at the JFK Historical Group. It was happenstance and a call from our mutual friend Andrew Iler that brought us together this past week…once again. We spent two days intensely rehashing elements of the case and the autopsy and you are going to hear close to five hours of incredible interview dialogue from Doug that I am certain you won't want to miss. These tapings are spread out over three episodes and they represent a master class about the medical evidence and a candid talk about what it all means. And  it all comes directly from Doug. This Day in Legal History: Nixon Nominates a White Supremacist On January 19, 1970, President Richard Nixon's judicial appointment landscape was forever altered when he nominated Judge G. Harrold Carswell to the U.S. Supreme Court. This decision marked a pivotal moment in legal history, steeped in controversy and intense political debate. Carswell, a member of the US Fifth Circuit Court of Appeals, was initially seen as a suitable candidate. However, this perception rapidly changed following a profound revelation.The nomination's controversy ignited when a tenacious reporter unearthed a speech from 1948 in the Wilkinson County courthouse basement in Georgia. This speech, delivered by Carswell during a political campaign and preserved as the lead story in The Irwinton Bulletin, a weekly newspaper he edited, contained a statement that "segregation of the races is proper." This declaration, in itself contentious, was not the only incendiary element. Kennedy's assassination received a partial victory in their lawsuit against the National Archives and Records Administration (NARA). The Northern District of California court ruled that the plaintiffs could proceed with claims under the Federal Records Act (FRA) regarding documents they allege were destroyed, but not those merely missing.The plaintiffs, including the Mary Ferrell Foundation Inc., Josiah Thompson, and Gary Aguilar, sued NARA under the FRA, asserting the agency's failure to request the U.S. Attorney General to recover records tied to the assassination. This ruling requires US Bankruptcy Judge John Dorsey to appoint an external examiner to investigate the downfall of the FTX crypto exchange, which filed for Chapter 11 bankruptcy in November 2022 amid allegations of widespread fraud. This decision ensures that the findings of the investigation will be made public, providing transparency in the case.Third Circuit Orders Independent Examiner in FTX BankruptcyThe Supreme Court's recent hearings suggest a potential shift away from the Chevron doctrine, a cornerstone of administrative law, towards the older Skidmore doctrine. This change, primarily supported by the court's conservative majority, emerged during arguments in cases involving the FTX crypto exchange's bankruptcy. The Chevron doctrine, established in 1984, mandates judicial deference to agency interpretations of ambiguous statutes, while the 1944 Skidmore doctrine suggests deference only if the agency's interpretation is persuasive. The court's inclination to favor Skidmore, which grants less deference to agencies, aligns with conservative criticism that Chevron gives excessive power to executive agencies.By way of very brief background, Skidmore deference, a principle within administrative law, allows federal courts to defer to a federal agency's interpretation of statutes it administers based on the persuasiveness of the agency's reasoning. This form of deference was developed in the U.S. Supreme Court case Christensen v. Harris County in 2000 and named after the 1944 decision in Skidmore v. Swift & Co. Unlike Chevron deference, which requires courts to defer to an agency's reasonable interpretation of an ambiguous statute, Skidmore deference grants courts the flexibility to determine the level of deference based on the agency's ability to justify its interpretation convincingly. In practice, Skidmore deference is applied to interpretations like those in agency manuals, policy statements, and enforcement guidelines, which do not go through the formal rulemaking process. This approach reflects a judicial attitude that respects agency expertise while maintaining a critical review of its interpretations.This debate highlights differing judicial philosophies on agency power. Some justices, like Elena Kagan, argue that Skidmore offers minimal support to agencies, while others, such as Neil Gorsuch, view it as providing agencies with significant interpretative weight. The transition from Chevron to Skidmore could lead to agencies winning fewer cases, as Skidmore's threshold for deference is lower. This shift would also require agencies to present more thorough, persuasive reasoning for their actions, potentially reducing their ability to enact broad policy changes. Episode 187 is the fifth and final  in a  multi-part series covering Richard Case Nagell.  This is third bonus episode as well, and it may be the the most interesting one yet. Addressing the Eroshkin incident, the Luma Hotel, and the death of Marine  Emmett Dugan.  Richard Case Nagell  was a highly decorated United  States Army veteran, counterintelligence officer,  and former CIA Double Agent for a brief period  with ties to Russia. Nagell was arrested on September 20, 1963 after he entered the State National Bank in El Paso, Texas and fired two shots into  a wall at the bank. After firing the 45 calibre pistol, Nagel  allowed himself to be taken into custody at the bank. Nagell had  observed and then penetrated a group that included Lee Harvey Oswald and learned that they were planning the assassination of President Kennedy. Working as a double agent, he refused to execute the orders given by his Russian handler which was  to foil the assassination plot by convincing Oswald that he was being set up as a patsy or, in the event he was not successful in doing that, to kill Oswald instead. Shortly before the bank incident, Nagell sent a letter to J. Edgar Hoover exposing the plot. Not surprisingly, the letter was never acknowledged by the FBI.  Nagell met twice with New Orleans District Attorney Jim Garrison who at the time was investigating Clay Shaw's  possible complicity in the assassination.  The famous character Mr. X in Oliver Stone's movie JFK is modeled after Richard Case Nagell.  Nagell, like so many other characters in the JFK story, had a fascinating life and he first crossed paths with Oswald while Oswald was stationed in Japan at Atsugi Air Force Base. He would survive two military airplane crashes but the injuries sustained in the most serious of the two crashes were later hypothesized to have possibly impacted his mental health and they were the subject of an intense examination during his criminal trial related to the bank charges.  Nagell died at the age of 65 in Los Angeles, California...one day after receiving his subpoena to appear before the Assassination Records Review Board. It would have been his first ever appearance under oath to discuss what he knew about the assassination. Previously, he had not testified or given statements about it to any government arm that was officially investigating the assassination. Although he officially died of a heart attack, he had no previous history of heart problems and is included in that dubious category of mysterious deaths that occurred amongst witnesses in the aftermath of the assassination. Richard Case Nagell may be the single  most fascinating character in the JFK story, and  Nagell's story is yet  another moment where fact is stranger than fiction in the case of the JFK assassination. Episode 186 is the fourth  in a  multi-part series covering Richard Case Nagell.  This is our second bonus episode and it addresses the perspective that Nagell's trial lawyer Joe Calamia  had on his legal proceedings...and the strategy for  a defense at the second trial. Nagell's lawyers settled on a temporary insanity plea, after unsuccessfully arguing to both their client and to the court, that Nagell was insane...and thus, should be hospitalized and not prosecuted  and incarcerated. John R. Tunheim is an American lawyer who serves as a United States district judge of the United States District Court for the District of Minnesota.  Episode 96 continues the story of the autopsy. This episode summarizes the evidence points around the topic of whether the President's body arrived at Bethesda in a shipping casket. If that indeed did occur it would be evidence that the body was transferred at some point from the ceremonial bronze casket that it was originally placed in at Parkland in Trauma Room One. If true, this fact would open up the possibility that the body was tampered with to obscure the forensic evidence related to the autopsy.  Our story today is based on Doug Horne's view on the existence of multiple caskets and the work he documented in his seminal volume IV of Inside the Assassination Records Review Board. Douglas P. Horne, author of The McCollum Memorandum: A Story of Washington D.C. in 1940-41: Franklin D. Roosevelt's Journey from Deterrence to Provocation on the Road to Pearl Harbor, joined me to give a provocative presentation on the long-standing debate around FDR, the McCollum Memo, and the question of advanced foreknowledge of the attacks that was popularized in large part by Robert Stinnett, the late author of Day of Deceit: The Truth About FDR and Pearl Habor. Although Stinnett's book received a fairly even-handed review from the New York Times when it was published, most mainstream historians have since discarded notions of advanced foreknowledge of the attack on Pearl Harbor as a fringe conspiracy theory. Douglas P. Horne, however, thinks this is mistaken, although, unlike many who believe in the advanced foreknowledge hypothesis, remains a great admirer of President Roosevelt. For the uninitiated, Horne served on the Assassination Records Review Board and is in large part the reason that the now infamous "Operation Northwoods" documents came to light. He also was in the Navy and spent time at Pearl Harbor in addition to working at the Holocaust Museum in D.C. and the State Department. He is also the author of a previous two-volume work on Pearl Harbor entitled Deception, Intrigue, and the Road to War. In the second part of this long conversation, we delve into some of the other "Rosetta Stones" of Horne's book beginning with the at-the-time secretive Argentia conference and, perhaps even more crucially, the MAGIC decrypts. This will take us into the world of American codebreaking as well as that of the British codebreakers at Bletchley Park. We will talk about a conversation had between Winston Churchill and FDR in which the late Roosevelt said he could not "declare war" but that he could "wage war". We will delve into three particular provocations between the Germany Navy and the U.S. before U.S. entry into WWII, FDR forcing the British to sign off on the Atlantic Charter, an important 15 August 1941 telegram to the Japanese foreign minister, the figure of Hitler's confidant Sepp Dietrich and how it figures into the story, British decoding/decryption efforts being far ahead of U.S. decoding/decryption efforts and why it matters in the lead up to Pearl Harbor, Horne's book as arguably being about how the "sausage of" foreign policy is made and produced, Roosevelt "the chess player" wanting to get into the war through the "front door" but (from Horne's purview and examination of the evidence) going through the backdoor, the shift from deterrence to provocation, making clear the fact the Horne is not making the argument that Pearl Harbor was an "inside job", U.S. Secretary of State Cordell Hull and the Hull Note, contemporary accommodation talks between the U.S. and Japan that FDR reversed position on overnight, the question of why FDR flipped U.S. foreign policy on its head with regards to the issue of accommodation vs. giving the Japanese an ultimatum, Hull's anger over the ultimatum and his emphatic response to it, the JN-25 code (the Japanese Navy's fleet operating code), Admiral Yamamoto's strategy against the U.S. and his miscalculations, what no one knew about the Pearl Harbor attack and how devastating it would be and why, the Pearl Harbor attack order, the 188 codes that if all decrypted would've made the Pearl Harbor attack known, the go code "Climb Mt. Niitaka", the investigations into the Pearl Harbor attacks in the 1940s, Admiral Husband E. Kimmel as the fall guy for the Pearl Harbor attacks, the 1946 Congressional report on Pearl Harbor and an important detail about dates included in the report, British Supply Coordination (the MI-6 spy office in America) in Rockefeller Plaza and the visit of FDR's son to it,  Admiral Stark's interrogation at the hands of Admiral Kimmel and Stark's claiming of "executive privilege", the date of November 26th 1941 and its significance, FDR's overriding foreign policy goal was to fight Nazi Germany, why couldn't the attack be intercepted if it was known and why would you not want to (after all, would the attack itself, even if intercepted, not be enough to get the U.S. into the war)?, and much, much more! The Biden administration has decided to delay the publication of the U.S. government's secret file involving the 1963 assassination of President John F. Kennedy. Two of JFK's nephews, Robert F. Kennedy Jr. and Patrick Kennedy, are outraged and say American citizens have a right to know, as does Tom Samoluk, Dan's guest. An in depth tutorial and discussion around the assassination of John F. Kennedy, (JFK) the country's 35th president who was brutally murdered in Dallas Texas on November 22, 1963. Episode 53 is a special episode that goes on a small, but very important and time sensitive wander.    Many of you who follow this story  are aware that  the  President John F. Kennedy Assassinaton Records Collection Act of 1992   also known as the the "JFK Act" was passed in 1992 and  mandated that all  assassination records, that had been withheld by the government,  be released by the deadline date that was set forth in the JFK Act itself.  That deadline gave the government  a delay of up to twenty-five years to assess sensitive materials and determine how long such materials should be kept from the general public, with the notion that such continuing  holdback could only be accomplished under  the strict guidelines contained within the JFK Act itself,  and presumably on the rarest of occasions.   The scheduled twenty-five year  deadline  came upon us in 2017 during the Trump administration and the greatly anticipated final release was met with a thud...as the Trump administration extended the release date for a large bolus of documents.  While this was disappointing  to all who anticipated seeing  all remaning documents, it  has become known that there are other problems too.  The level of rigor to maintain and make avaiable this collection of documents needs more attention as well, and the lack of full compliance with the retrieval and cataloging of documents is again creating a new wave of skepticism about what is being released.  How do we know that everything that should have been gathered and accounted for and classified as an assassination record is within the current catalog of documents? The goverment had twenty-five  years more to do this right,  and get that part of it right.  In fairness, much has been done.  But the question is whether it was done with enough rigor, and some very trained eyes, think the answer to that question may be "NO".  Those truly trained eyes in the research community are seeing signs of this and while those conditions are not easily discernable by the casual observer, they are clear to the professionals in the research community who follow this topic vigorously.      A deadline was agreed to in 1992.  Congress set that deadline.    It has been moved once now by President Trump. There has been no credible fact revealed that would rationally allow that deadline to be moved again, yet actions are underway by many federal agencies to petition  the President and the government to do just that, and to compel the Assassination Records Review Board to continue to whithold from public view many critical documents related to the assassiantion.  This is not an issue divided along conspiracy  versus non-conspiracy lines.  It's almost sixty years now after the assassination.  Virtually everyone involved who was old enough to hold a material place in the decisions and actions that surrounded the assassination  are deceased.  It's become a matter of history now and getting that history straight and helping our government  restore some of the credibility it lost at that moment by not telling the whole truth about what happened.... and more specifically what they knew about what happened.  The transparency now matters to those of us that are living and love our country and want our government to be the recipient of the full support and confidence of the American people, and indeed all the people of the world.  That's why transparency on this topic  matters and still has relevance.
