Dr. Katherine Ko, a neurosurgeon, who sees her art as an extension and complement of her career, and Katya Denisova, an operating room nurse who uses her art as an abstract escape from the pressures of being a healthcare worker.  We learn how people can use art, or any form of creative expression, to help find solace.

Mit Art. 196 StPO beginnt in der Reihe von Gregor Münch und Duri Bonin der eigentliche Einstieg in die Zwangsmassnahmen – also in den Teil der Strafprozessordnung, in dem der Staat nicht mehr nur fragt und protokolliert, sondern in Grundrechte eingreift. Art. 196 definiert, was eine Zwangsmassnahme überhaupt ist: Verfahrenshandlungen der Strafbehörden, die in die Grundrechte der betroffenen Person eingreifen und dazu dienen, Beweise zu sichern, die Anwesenheit von Personen im Verfahren sicherzustellen oder die Vollstreckung des Endentscheids zu gewährleisten. Warum ist dieser scheinbar knappe Artikel so wichtig? Weil er die erste Schlüsselfrage vorgibt: Haben wir es überhaupt mit einer Zwangsmassnahme zu tun? Davon hängt fast alles ab: Wer sie anordnen darf. Welche Voraussetzungen gelten. Wie stark Grundrechte geschützt sind und welches Rechtsmittel offensteht. Gregi und Duri zeigen, dass genau hier die juristische Arbeit beginnt: Nicht jede Ermittlungshandlung ist schon eine Zwangsmassnahme. Entscheidend ist der Eingriff in Grundrechte. Die Folge erklärt Art. 196 deshalb nicht abstrakt, sondern als Türöffner zum ganzen fünften Titel der StPO: Hausdurchsuchung, Beschlagnahme, Überwachung, DNA-Profil, Vorführung, Haft. Wer Art. 196 StPO versteht, versteht den roten Faden hinter all diesen Instrumenten. Duri und Gregor machen sichtbar, dass Zwangsmassnahmen nie bloss Technik sind. Sie sind immer ein Machtmittel des Staates – und deshalb nur unter klaren Schranken zulässig. Diese Schranken stehen gleich im nächsten Artikel, Art. 197 StPO: gesetzliche Grundlage, hinreichender Tatverdacht (genügende konkrete Verdachtsmomente), keine mildere Massnahme und Verhältnismässigkeit. Gerade für Laien wird damit verständlich, warum Strafprozessrecht oft nicht bei der Schuldfrage beginnt, sondern schon viel früher: bei der Frage, ob der Staat überhaupt so stark eingreifen darf. Und genau deshalb ist Art. 196 kein technischer Vorspann, sondern die Grundsatznorm für alles, was danach kommt. A friend of Saul and Jolene ran two TTRPGs back to back on a Friday evening over Zoom using a lite ruleset called There and Back Again, and on Saturday morning The One Ring 2nd Edition RPG.  The games did not use the same characters.       On Friday the players played a group of Dwarves who set out to enter Moria, against the standing order of King Dain Ironfoot.  It was literally a tale of There and Back Again.  Saturday the players in an on going campaign are around the area of Tharbad.  In the past we encountered a pair of Dwarves and later heard about a group of them passing through the ancient city of Tharbad.     So the storylines intertwined but only for a moment.  Jolene decided to write a tale that one would hear at a tavern.  Her character in The One Ring is a schlar and a bit of a storywriter.      From her notes of the game and imagination was born Marigold's Dwarven Tale.  Saul edited it and added some sound effects but the story was all Jolene.     Thank you all for Listening!   You can email us at gamingperspective.com@gmail.com    Podcast Art by Jim D.
