Ein spezielles Beweismittel, das tief in Grundrechte eingreift – theoretisch sogar Freiheitsentzug allein zum Zweck eines Gutachtens ermöglicht. In der Praxis spielt diese Bestimmung jedoch kaum eine Rolle. Die zentralen Themen dieser Folge: - Voraussetzungen der stationären Begutachtung: Wann reicht eine ambulante Untersuchung nicht aus und weshalb muss ein medizinisch indiziertes Setting in einer psychiatrischen Klinik vorliegen? - Rechtsgrundlage und Verfahren: Warum entscheidet das Zwangsmassnahmengericht in einem schriftlichen Verfahren und wieso das Fehlen einer mündlichen Anhörung problematisch ist. - Kompetenzen von Gericht und Staatsanwaltschaft: Weshalb hier eine Inkongruenz besteht – Gerichte dürfen vor einer Verurteilung selbst über Freiheitsentzug entscheiden. - Anrechnung auf die Strafe: Der Spitalaufenthalt wird auf die Freiheitsstrafe angerechnet – unabhängig davon, ob in einer offenen oder geschlossenen Einrichtung. - Rechte während der stationären Begutachtung: Anwendung der Vorschriften zur Untersuchungs- und Sicherheitshaft – Besuchsrechte, Postkontrolle, ärztliche Betreuung, Beschwerdemöglichkeiten. - Keine praktische Relevanz: Warum Art. 186 StPO nie angewandt wird. - Praxisperspektive: Was tatsächlich vorkommt: Verlegungen von Untersuchungshäftlingen in Kliniken, zu wenige Plätze für psychisch kranke Personen, neue Notabteilungen wie in Limmattal. - Haftpolitik im Vergleich: Unterschiede zwischen Kantonen von Befristungen wegen Kollusionsgefahr (z. B. Basel-Stadt) bis zu pauschalen Dreimonatsanordnungen in Zürich – und welche Folgen dies für Haftdauer und psychische Belastung hat. - Transparenz und Statistik: Warum Unterschiede in Haftquoten zwischen den Kantonen Fragen aufwerfen und weshalb Vergleiche Hinweise auf Verfahrenspraxis und Staatsanwaltschaftsführung geben könnten. Wer Strafrecht, Strafprozessordnung, Untersuchungshaft und die stationäre Begutachtung verstehen will, erhält hier einen Einblick in eine Norm mit hoher Grundrechtsrelevanz, aber geringer praktischer Bedeutung.
