In ihre Reihe «StPO Artikel für Artikel» sind die Strafverteidiger Duri Bonin und Gregor Münch bei den Art. 194 StPO (Beizug von Akten) und Art. 195 StPO (Einholung von Berichten und Auskünften) angelangt. Bei Art. 194 StPO geht es um den Beizug von Akten aus anderen Verfahren: Vorakten aus abgeschlossenen Strafverfahren, aber auch Akten aus Eheschutz, Gewaltschutz oder FINMA-Verfahren. Diskutiert wird die zentrale Grenze zwischen Abklärungsinteresse und Geheimhaltungsinteressen und die Frage, wann und wie geschwärzt werden darf oder muss. Ein praktischer Schwerpunkt ist die Verteidigungsperspektive: Was passiert, wenn Behörden Akten beiziehen, die in Verfahren entstanden sind, in denen Mitwirkungspflichten galten (z. B. konkursamtliche Einvernahmen, FINMA-Verfahren, interne Untersuchungen des Arbeitgebers)? Welche Risiken entstehen durch selbstbelastende Aussagen, die später in ein Strafverfahren „hineinwandern“? Bei Art. 195 StPO wird es prozessual heikel: Wer darf im Hauptverfahren noch Berichte einholen oder Strafregisterauszüge beiziehen? Duri schildert einen Fall, in dem die Staatsanwaltschaft im Obergericht mit selbst beigezogenen Akten aufgetaucht ist. Gregor bringt ein ähnliches Beispiel aus einer Hauptverhandlung in Bülach. Im Zentrum steht das Spannungsfeld des zweigeteilten Systems: Im Hauptverfahren ist die Staatsanwaltschaft Partei – die Verfahrenshoheit liegt alleine beim Gericht. Was heisst das konkret für Beweisanträge und „Überraschungsakten“? Zum Schluss wird es wieder ganz praktisch: Arztberichte und psychiatrische Austrittsberichte, Berufsgeheimnis und die Frage, ob und wie man eine bereits unterschriebene Entbindungserklärung widerrufen sollte – als Vorsichtsmassnahme beim Einstieg ins Verfahren. In dieser Folge setzen Duri Bonin und Gregor Münch ihre StPO-Reihe fort und besprechen Art. 193 StPO (Augenschein). Ausgangspunkt ist die eigentlich einfache Idee: Staatsanwaltschaft und Gericht können und sollen Örtlichkeiten, Gegenstände oder Vorgänge in Augenschein nehmen, wenn sie für den Sachverhalt bedeutsam sind, aber nicht als klassischer Beweisgegenstand vorliegen. Gregor betont, dass „Augenschein“ nicht nur Sehen bedeutet: Auch Gehör, Geruch oder Haptik können beweisbildend sein. Dann wird es konkret: Wie oft wird ein Augenschein in der Praxis tatsächlich durchgeführt – und warum so selten? Welche Rolle spielen dabei Parteirechte und die Frage, ob Gerichte „informell“ besichtigen dürfen, obwohl das Verfahren parteiöffentlich sein müsste? Der spannendste Teil ist die Verbindung von Augenschein und Tatrekonstruktion: Wann lohnt sich ein Antrag und wann schiesst man der eigenen Verteidigung ins Bein? Gregor schildert eindrücklich einen Fall, in dem die Lichtverhältnisse am Tatort entscheidend waren und das Gericht mitten in der Nacht ausrückte, um die Situation nachzustellen. Der Augenschein wird so zur Beweispsychologie: „Erlebtes“ prägt. Das soll mit Worten und Adjektiven in der Protokollierung über die Instanzen "bewahrt" werden. Zum Schluss wird es leichter und gerade dadurch sehr anschaulich: Augenscheine im Übertretungsbereich, Windspiel-Lärm, Halteverbote, Baumrückschnitte – und sogar eine Karikatur aus dem Tages-Anzeiger („Richter testet mit Ventilator japanisches Tempelglöcklein“). Und Gregor streut noch einen Praxis-Tipp ein: Die digitalen Archive von Tages-Anzeiger und NZZ können als Recherchetool in konkreten Fällen überraschend nützlich sein. A friend of Saul and Jolene ran two TTRPGs back to back on a Friday evening over Zoom using a lite ruleset called There and Back Again, and on Saturday morning The One Ring 2nd Edition RPG. The games did not use the same characters. On Friday the players played a group of Dwarves who set out to enter Moria, against the standing order of King Dain Ironfoot. It was literally a tale of There and Back Again. Saturday the players in an on going campaign are around the area of Tharbad. In the past we encountered a pair of Dwarves and later heard about a group of them passing through the ancient city of Tharbad. So the storylines intertwined but only for a moment. Jolene decided to write a tale that one would hear at a tavern. Her character in The One Ring is a schlar and a bit of a storywriter. From her notes of the game and imagination was born Marigold's Dwarven Tale. Saul edited it and added some sound effects but the story was all Jolene. Thank you all for Listening! We spoke about the evolving media landscape as Ringier has grown from printed newspapers (remember those?) to a growing digital empire; the impact of the AI boom on media and the arts; and Ringier's art collecting journey, as he explains how lessons learned from building his collection extend to how he operates his business today.
