He helped lead the effort to expand the ACC conference a dozen years ago, but also resigned from UNC Chapel Hill after the fraudulent class scandal involving athletes and “no-show” classes. Name, image, and likeness in college athletics has been a topic that has gained significant attention in the last few years. Could you explain to our listeners what exactly name, image, and likeness means and some background of how we got here? Absolutely. Name, image, and likeness, often abbreviated as NIL, refers to the rights of individuals, particularly college athletes, to have control and monetize their own personal brand. It compasses their name, voice, photograph, and other identifiable attributes that can be associated with their public persona. Historically, it was an NCAA violation for a college athlete to money off of their name, image, and likeness. As for how we got here, in 2021 Supreme Court found that it was a violation of antitrust law to restrict college athletes from profiting off of their name, image, and likeness. As a result, the NCAA changed its rules regarding NIL and announced a new interim policy that permitted college athletes to profit from their NIL. Per the NCAA's policy, athletes and institutions must follow their state laws regarding NIL. To date, 32 states have passed NIL laws that are largely modeled off of California's Fair Pay to Play Act. 2. Let's dive into the details of Michigan's NIL law. Can you provide us an overview of what Michigan's NIL law looks like? Sure, Michigan's House Bill 5217 which went into effect December 31, 2022 provides that colleges and universities are prohibited from doing the following: · preventing student athletes from competing in college athletics because they earn compensation from an NIL deal. · Preventing a student athlete from obtaining professional representation · Paying a student-athlete compensation directly for the use of their NIL rights · Revoking or reducing a student-athlete's scholarship because they enter into an NIL deal Now, the student athlete has obligations they must comply with. Generally, the student athlete can't: · Advertise for a sponsor that creates a conflict with a sponsor of the college · Athletes are required to disclose the NIL opportunities or contract that hope to enter into at least 7 days before entering into that contract. · Student athletes are not granted any right to use the intellectual property, logos, or copyright of their universities · And they are required to follow their university's academic requirements, team rules, and disciplinary standards. In addition, schools are developing their own NIL policies which student-athletes would be required to comply that may be more restrictive than the state's law. And then there's the NCAA regulations. Schools/student-athletes must comply with the NCAA's interim policy as well as any guidance published by the NCAA. 3. We have lots of businesses who listen to this show. What advice would you give to businesses looking to navigate this new landscape and establish partnerships with student-athletes? Well, I think the new NIL rules provide a fantastic opportunity for businesses looking to explore new ways of marketing their products, especially in areas where there is very strong support for particular schools student-athletes or sports. From a legal perspective, it is important to make sure you have a well-drafted contract that clearly outlines the rights and obligations of both parties, which includes permitted uses of the individual's name, image, and likeness, compensation terms, the duration of the contract, things like that. I think there's also the added element of compliance as well. You want to make sure you're compliant with Michigan's laws, the NCAA regulations, and the university's NIL policy, to the extent there is one, so that both the business and the student-athlete can reach a mutually beneficial arrangement without jeopardizing eligibility for the athlete.

Some of you may know I spent the first half of my professional career as a public relations professional in the world of college athletics. Back then we called the job being a sports information director, or SID. The industry evolved to labeling the role something like athletic media relations or athletic communications or similar, but our job was to publicize the teams, coaches and student-athletes. The first sport I was ever placed in charge of as a student assistant at Morehead State University was the Eagle volleyball team. I hadn't ever seen volleyball in person before going to college, but was trained to keep statistics at matches by hand … now they do it on computers. I designed the team's media guide, wrote press releases, pitched ideas to newspaper reporters and TV journalists. While volleyball wasn't the only the sport I worked, it was always my favorite. It was fast, the young women playing were always super athletic, jumping high and crushing the ball into the opponent's court. I never worked at a school that sponsored men's volleyball, but I'm kind of glad for that. It helped me appreciate how strong and dominant women can be on the playing courts and fields. Last fall I had the opportunity to speak to a public relations class at the University of Louisville. Dr. Karen Freberg is a professor there. She and I have shared the stage at conferences and traveled along side one another a few times. She's kind of a social media pioneer in the academic circles, building out curricula for the new world of PR thanks to social media, influencers and the like. She has me speak to her class each year, which I always enjoy doing. Low and behold one of Dr. Freberg's students last fall was Aiko Jones. She is a star blocker for the Cardinals and was instrumental in the team's run to the Final Four and National Runners-Up finish. UofL was 31-3 overall with an amazing 17-1 record in the ACC. For those of you who don't know sports, Aiko was one of the dominant players on one of the most dominant teams in the entire country at the college level last year. She's back for her senior year in 2023 and will no doubt make a run at racking up another string of honors. She was Final Four All-Tournament Team and All-Louisville Regional Team in the NCAA Tournament. First Team All-ACC, First Team All-Region. In layman's terms, she's one of the best college volleyball players in the country. Which means, she's well versed in Name Image Likeness benefits and parlaying her athletic prowess into brand deals and collaborations. So, I asked my pal Aiko to come on the show to share some of those experiences with all of us. We'll learn about NIL from the student-athlete perspective today on Winfluence. Up until July of 2021 college athletes couldn't make money off their own name, image, or likeness. While schools and conferences and the NCAA raked in hundreds of millions of dollars a year, the student-athletes who were putting on the show were mostly left out to dry. That all changed last summer with some new NIL legislation. And Pat Johnson saw an opportunity to build a business in a completely untouched industry. So Vantage Sports was born. It's an online platform that connects current college athletes with prospective college athletes (i.e. high school or middle school students) for 1-on-1 training or group sessions; allowing college athletes to make money from their name and for younger athletes to get training from the best in the biz. It's a win win. We talked all about how Pat birthed this idea WELL before the NIL legislation went into place, the struggles of raising funds to push the business forward, and how he's leveraging partnerships to elevate the brand. I'm Paul Jarley, Dean of the College of Business here at UCF. I've got lots of questions. To get answers, I'm talking to people with interesting insights into the future of business. Have you ever wondered, is this really a thing? On to our show. Paul Jarley (01:08): Name, image and likeness is a legal concept that allows any person, including student athletes, the right to publicity, the ability to capitalize on anything that identifies them, including the ability to engage in third-party sponsorships and endorsements. Some people think this will change college athletics as we know it, others aren't so sure. They think the marketplace will adjust, and that the benefits will accrue to a very few. To help sort through this, I've assembled three guests. Terry Mohajir is UCF's athletic director, Brittney Duzan is the associate AD for compliance, and Scott Bukstein is an associate instructor in our DeVos Sports Business Management Program. Listen in. Paul Jarley (01:51): As I understand NIL, this is being dealt with on a state-by-state basis. So what does Florida allow student athletes to do now that they couldn't do before? Brittney, I'm going to throw that to you. Brittney Anderson-Duzan (02:06): Sure. So, like most states, the state of Florida is one of the few that actually has a legislated piece for name, image and likeness. So essentially what they now have is the right to utilize their name, image and likeness for commercial purposes, so whether that be for money or not for money, that they weren't allowed to do previously by NDA legislation. So basically, they have the right to publicity now. Paul Jarley (02:32): They can print their faces on t-shirts. Can they get appearance fees? I'm trying to understand exactly what we're- Brittney Anderson-Duzan (02:39): Yeah. They can get appearance fees. It [inaudible 00:02:43] us now with what students on campus can do.
