College athletes earned an estimated $917 million in the first year of Name Image and Likeness (NIL) payments, which began in July 2021, according to new data from Opendorse. Opendorse, which provides technology to the athlete endorsement industry, projects the NIL market will produce $1.14 billion in NCAA athlete compensation over the next 12 months. Shawn O'Gorman is the Director of Name, Image, and Likeness (NIL) at First Round Management. Its his job to ensure the players he represents can maximize all of their athletic, personal and financial potential. O'Gorman says his work starts with forming great and authentic relationships. Welcome to THE Sports Law Podcast! We keep you informed on everything at the intersection of sports and the law. Name, Image, and Likeness remains at that intersection as Tarun (@tksharmalaw), Mike (@Mike_sonof_Law), and Holly (@ProsecutieRests) dive into the latest on NIL. Charles Barkley has always been outspoken about his feelings towards NIL. (1:16) Barkley recently took to 60 Minutes to state that college basketball is "a travesty and a disgrace," specifically about NIL. Barkley went on to state that the NCAA will only consist of top 25 teams who can pay their players and every other program will become irrelevant. Barkley also stated in 2021 that NIL would cause locker room rifts between players and drive teams apart. It appears that Barkley is wrong again. The Final Four consists of not a single blue blood basketball program. This was the first tournament, EVER, where a number 1 seed didn't make the Elite Eight. Number 9 seed Florida Atlantic University is in the Final Four, and their school has partnered with Opendorse to create an NIL marketplace for their athletes. We discuss how NIL, among other factors like the transfer portal, has leveled out the NCAA men's basketball playing field and increased competition. Miami head coach Jim Larrañaga has been very supportive of NIL and his players. (13:22) This is the first full year of NIL deals being widespread. We discuss the correlation between NIL deals and winning. Miami has a successful men's and women's basketball year. UCLA's head coach Mick Cronin was placed on the hot seat after they lost to Gonzaga in the Sweet Sixteen regarding his stance on NIL. (24:27) Cronin also showed support for NIL and his players. He even hinted at the NCAA leadership that they need to adapt and develop NIL as the future of college sports. Charles Barkley also commented on the congressional hearings on NIL. (28:10) Barkley expressed his distaste for public officials. Nonetheless, Barkley suggested a committee of informed people be created, and that is what Congress is doing at the hearing on 3/29. Notre Dame President John Jenkins and Athletic Director Jack Swarbrick co-authored and op-ed in the New York Times regarding NIL along with some suggestions for congress and pro leagues. (33:00) Jenkins and Swarbrick wrote the piece with a dated outlook on college athletics as they asked congress to create federal legislation. They wrote with a fear that the NCAA would implode and that NIL would turn college into the minor leagues. With that, they also asked the NFL to create a minor league, as well as asking the NBA to do away with the one-and-done rule. With the Athletics as the visiting team in the second game, 25-year-old Adrian Martinez (1-0) pitched 5 1/3 scoreless innings in his major league debut to help Oakland to a 4-1 victory. In a matchup of last-place teams, Detroit ended a 27-inning scoreless streak in the opener. Oakland (12-19) then won for the second time in 12 games and sent the Tigers (9-21) to their seventh loss in eight games. White Sox 4, Guardians 1 – Sheets homers, Anderson 2 RBIs, White Sox top Guardians 4-1 Gavin Sheets homered in his second straight game, Tim Anderson had three hits and 2 RBIs and the Chicago White Sox shook off the previous night’s big collapse by beating the Cleveland Guardians 4-1. Starter Lucas Giolito went seven innings and gave up just the one run that came on a Josh Naylor homer to win his second straight start. He allowed six hits, struck out five and walked one. The White Sox won their seventh of eight games. Naylor had two hits. Cleveland starter Cal Quantrill went 6 1/3 innings, allowing four runs and 10 hits. Padres 5, Cubs 4 – Machado, Padres beat Cubs 5-4 in Clevinger’s return Manny Machado hit a go-ahead double in the sixth inning and the San Diego Padres beat the Chicago Cubs 5-4 hours after finding out manager Bob Melvin will have prostate surgery. Melvin announced before the game that he’ll have surgery Wednesday. He said he doesn’t think he has cancer, “but they won’t know until they get in there.” Mike Clevinger pitched well for 4 1/3 innings in his first start at Petco Park since late in the 2020 season. He missed last season while rehabbing after Tommy John surgery. Chicago’s Wade Miley lasted three innings in his Cubs debut. MLB – White Sox’s Jiménez making quick strides from torn hamstring Chicago White Sox outfielder Eloy Jiménez says he is making quick strides in his recovery from a torn hamstring. Jiménez says he is coming along sooner than expected. He is pain free and has been running and swinging. Jiménez was injured trying to beat out a grounder at Minnesota on April 23. The 25-year-old slugger felt it as he was running toward the base. He then stretched for the bag, stumbled and was taken from the field on a cart. Jiménez had surgery a few days later, and the White Sox said he would be out six to eight weeks. MLB – Anderson suspension dropped in MLB settlement, fine remains Major League Baseball dropped the one-game suspension of Chicago White Sox shortstop Tim Anderson for giving fans the middle finger during a game on April 20 as part of a settlement with the players’ association. He agreed to a fine as part of the settlement, which avoided an appeal before MLB special adviser John McHale Jr. Anderson had three errors in the first two innings of Chicago’s 11-1 loss in the opener of a doubleheader and made the gesture toward a fan while out in the field. NFL – Slime Time: Nickelodeon to broadcast Christmas Day NFL game The NFL game on Christmas Day between the Broncos and Rams will be broadcast by Nickelodeon. The Super Bowl champion Rams will host the game, which also will be streamed by Paramount+. The San Mateo County District Attorney’s Office says Tuesday that it closed the case. The victim and Tyson requested that charges not be filed. The video shows Tyson repeatedly striking the unidentified man in the head, drawing blood. The Texas Longhorns needed some wins in a bad way on the baseball diamond and managed to do that in dramatic fashion, taking a 2-1 series win over the Oklahoma Sooners. After splitting the Friday and Saturday matchups, Texas fell behind 7-1 in the rubber match but scored 11 unanswered runs to take a lead and the series. The Texas pitching got back on track Friday, but the bullpen yet again let them down on Saturday and Sunday, so what can Texas do moving forward to keep the ship afloat? The winning wasn't just contained to the baseball diamond, the softball, track, and golf teams were all in action this weekend -- and all brought home wins in their competition. NHL – National Hockey League Last Night New York Rangers 5, Detroit Red Wings 4 – OT Rangers 5, Red Wings 4 – OT – Copp lifts Rangers over Red Wings in OT for 4th straight win Andrew Copp scored 1:34 into overtime and the New York Rangers extended their winning streak to four games by beating the Detroit Red Wings 5-4. Artemi Panarin had a goal and assisted on two others, including Copp’s winner, as New York swept back-to-back road games beginning with Tuesday night’s big victory over division rival Pittsburgh. Chris Kreider scored his 46th goal overall and NHL-high 24th on the power play. Ryan Reaves and Filip Chytil also scored for the Rangers, while Alexandar Georgiev made 22 saves. Michael Rasmussen, Jakub Vrana, Tyler Bertuzzi and Adam Erne scored for Detroit, and Moritz Seider added two assists. Alex Nedeljkovic stopped 29 shots, but the Red Wings lost their fourth straight. Vaughn was diagnosed with a hip pointer and could return to game action in one to two weeks. NFL – Arians retires as Bucs’ coach, Bowles promoted to top spot Bruce Arians has decided to retire as coach of the Tampa Bay Buccaneers and move into a front-office role with the team, a stunning move announced Wednesday night. Arians, who will turn 70 this coming season, coached the Bucs to the Super Bowl title in the 2020 season which was Tom Brady’s first with Tampa Bay. The Bucs were 31-18 in Arians’ three seasons there and he was 80-48-1 in eight seasons as a head coach overall when adding in his five seasons with the Arizona Cardinals. Defensive coordinator Todd Bowles will replace Arians as coach. WNBA – WNBA players break silence on Brittney Griner Two of Brittney Griner’s USA Basketball teammates have broken their silence on the star player’s imprisonment in Russia. Most WNBA players have been hesitant to talk about Griner’s detention on apparent drug charges in Russia, hoping to avoid potentially hurting her case. Players have been keeping discussions about how to best help Griner within their community. WNBA players have been very cohesive in the past when rallying behind issues such as voter registration or the Black Lives Matters movement. For the first few weeks, it was decided that it was clearly better for them to say less. NCAA – Emmert claims progress in women’s NCAAs, not close on pay A year after glaring inequities were revealed at the women’s NCAA Tournament and less than two weeks after sharp criticism from Congress, NCAA President Mark Emmert says he is happy with the institution’s progress but said there had only been “preliminary discussions” about distributing tournament revenues to women’s programs. Emmert said the work ahead improving conditions for women’s basketball includes negotiating a new television contract for the women’s tournament and potentially having a similar revenue distribution protocol as the men’s event. Emmert was careful not to call for specific changes ahead of discussions by the NCAA’s hundreds of member schools, and he declined to offer his own viewpoint. NCAA – March Madness paying off for players under mishmash of rules This week, Kansas, Villanova, North Carolina and Duke will play in the first Final Four to take place under the new world of “name, image and likeness” endorsements in college sports. It allows college players to earn money through endorsements. This new world is comprised of a loosely regulated mishmash of state laws and university-written rules that set different standards across the nation with little transparency about who gets what or where it comes from. On the one hand, it’s seen as a long-overdue development that will forever change the landscape of what has been widely disparaged as among the most unfair labor markets in America. On the other, trouble could be looming for an industry with few rules that doles out big bucks to teenagers with big dreams. NCAA – Women’s Final Four can be a financial windfall for players Women’s basketball is ranked second, behind only college football and ahead of men’s basketball, when it comes to the amount of income generated by name, image and likeness deals. That is according to Blake Lawrence, the chief executive of Opendorse. His company helps colleges and athletes navigate the celebrity endorsement landscape, which was opened last summer by the NCAA and now has millions of dollars flowing through it. He says making it to the Final Four will only increase the deals coming to social-media influencers such as Stanford’s Cameron Brink and UConn’s Paige Bueckers. Soccer – CONCACAR – US returns to World Cup despite 2-0 loss at Costa Rica The United States men are returning to the World Cup after the trauma of missing the 2018 tournament, clinching a berth for this year’s championship in Qatar despite a 2-0 loss to Costa Rica on the final night of qualifying. Juan Pablo Vargas got behind Walker Zimmerman and headed Brandon Aguilera’s corner kick past goalkeeper Zack Steffen in the 51st minute, and Anthony Contreras knocked in a cross off a scramble in the 59th after Steffen couldn’t hold onto a free kick. A sellout crowd of about 35,000 in National Stadium came to life, but the Americans’ 5-1 rout of Panama at home last weekend gave them a huge goal-difference margin over Costa Rica. Soccer – World Cup – FIFA, Qatar prepare for unprecedented World Cup finals draw A World Cup like no other in its 92-year history will take shape this week at an unprecedented tournament draw. When FIFA and host nation Qatar stage the draw ceremony show Friday three of the 32 entries will be placeholders. That’s because the three-year qualifying program has been delayed by the pandemic and war in Ukraine. It means 37 nations will be involved Friday. Five of those ultimately won’t play in November when the first “winter” World Cup kicks off. Qatar is in the draw pot of top-seeded teams with the world’s best: Brazil, Belgium, France, Argentina, England, Spain and Portugal.
