Under the new offence of failure to prevent fraud, companies can incur liability as a result of acts by their "associated persons". In this episode Elizabeth Head, Rob Hunt and Shannan Casey-Black discuss the types of third parties that can be "associated persons" for this purpose, consider how this compares with similar concepts under the Bribery Act 2010 and the Criminal Finances Act 2017, and provide some advice to companies as they start to think about their risks in this area. The Miami Dolphins defeated the Dallas Cowboys last weekend and now travel to Baltimore for a game against the AFC-leading Ravens. Baltimore toppled the San Francisco 49ers with the help of five turnovers last week. How can Miami, despite running a similar system, escape the same fate? Miami's offensive line allows an average of 1.8 sacks per game but will be put to the test against a Ravens' defense that leads the league in Sacks. Rob Hunt and Austin Jackson may return to the unit on Sunday, but Miami's challenges begin on the second level with Patrick Queen and Roquan Smith patrolling the center of the field. Flipping the script, should the Dolphins try to limit Baltimore's offense by shadowing Zay Flowers with Jalen Ramsey while letting Christian Wilkins and Zach Sieler win the game inside?
